A RESOLUTION OF THE MIAMI BEACH REDEVELOPMENT
AGENCY AUTHORIZING ACTIONS NECESSARY TO VACATE
MERIDIAN AVENUE BETWEEN 1ST STREET AND 2ND
STREET AND MELOY COURT BETWEEN WASHINGTON
AVENUE AND MERIDIAN AVENUE AND TO ABANDON
RELATED PUBLIC AND PRIVATE UTILITIES AND
EASEMENTS WITHIN THOSE RIGHTS-OF-WAY FOR THE
COBB DEVELOPMENT PROJECT
WHEREAS, as part of the contractual obligations included in
the Development Agreement dated March 31, 1989, between the Miami
Beach Redevelopment Agency ("Agency") and Cobb Partners
Development, Inc. ("Developer"), the Agency is required to provide
Parcel 2 consisting of Block 53 and the adjacent Meridian Avenue
right-of-way to the Developer; and
WHEREAS, prior to effectuating and closing on Parcel 2, it is
necessary for the rights-of-way described below to be vacated and
public and private utilities and easements to be abandoned:
1) A seventy (70) foot roadway known as Meridian Avenue
located between 1st Street and 2nd Street, in Ocean Beach
Addition No.3, as recorded in Plat Book 2, Page 81, of
the public records of Dade County, Florida; and
2) A fifteen (15) foot roadway known as Meloy Court, located
between Meridian Avenue and Washington Avenue, wi thin
Block 53 of Ocean Beach Addition No.3, as recorded in
Plat Book 2, Page 81, of the public records of Dade
County, Florida; and
WHEREAS, the Chairman and Members of the Agency held a public
hearing on January 18, 1995, and determined that the abandonment of
public or private utility lines or easements and vacation of the
above referenced rights-of-way would be in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CHAIRMAN AND MEMBERS OF
THE BOARD OF THE REDEVELOPMENT AGENCY OF THE CITY OF MIAMI BEACH,
FLORIDA: that the Chairman and Members of the Miami Beach
Redevelopment Agency hereby find and determine that it is in the
public interest of the City of Miami Beach to vacate the public
rights-of-way and abandon related public and private utilities and
easements within the rights-of-way located as follows:
1) A seventy (70) foot roadway known as Meridian Avenue
located between 1st Street and 2nd Street, in Ocean Beach
Addition No.3, as recorded in Plat Book 2, Page 81, of
the public records of Dade County, Florida; and
2) A fifteen (15) foot roadway known as Meloy Court, located
between Meridian Avenue and Washington Avenue, wi thin
Block 53 of Ocean Beach Addition No.3, as recorded in
Plat Book 2, Page 81, of the public records of Dade
County, Florida; and
PASSED and ADOPTED this 18th

RECOMMENDATION:
It is recommended that the City of Miami Beach and the Miami Beach
Redevelopment Agency approve a resolution authorizing the necessary
actions to vacate Meridian Avenue between 1st Street and 2nd Street and
Meloy Court between Washington Avenue and Meridian Avenue (see attached
map, Exhibit A), and abandon the existing public and private utilities
and easements within said right-of-way for the Cobb project.
BACKGROUND:
As part of the contractual obligation included in the Development
Agreement dated March 31, 1989, between the Miami Beach Redevelopment
Agency and Cobb Partners Development, Inc., the Agency is required to
provide Parcel 2 consisting of Block 53 and the adjacent Meridian Avenue
right-of-way to the developer. Prior to effectuating and closing on the
aforementioned parcel, it is necessary for rights-of-way to be vacated
and public and private utilities and easements located therein to be
abandoned. These acti vi ties include, but are not limited to, the
following locations within or adjacent to Block 53:

west of Meridian Avenue was conveyed by the Miami
Redevelopment Agency to Cobb Partners South Beach Limited.

Addition No.3, as recorded in Plat Book 2, Page 81, of the public
records of Dade County, Florida.
Title to the property to the north and south of Meloy Court is held
by the Miami Beach Redevelopment Agency.
ANALYSIS:
Pursuant to the Development Agreement, the Redevelopment Agency is
obligated to deliver Parcel 2 to the developer after abandoning public or
private utility lines or easement and vacating rights-of-way. The Public
Works Director has been requested to take all necessary action to
facilitate vacating these utility lines, easements and rights of way.
The twenty-year franchise agreement between the City of Miami Beach and
Peoples Gas System, Inc., requires the utility company to remove and
relocate the utilities at their expense.
Settlement was reached with Florida Power & Light during mediation of
Block 53 that requires the Agency to reimburse the utility company in the
amount not to exceed $10,000 for utility relocation.
To facilitate a closing on Block 53 between the Redevelopment Agency and
the developer, initiating activities as described above is required.
