RESOLUTION NO. 10936
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, CANVASSING THE RETURNS
OF THE SPECIAL MUNICIPAL ELECTION HELD ON
MARCH 5 , 1963 , AND DECLARING THE RESULT TO BE
FOR THE APPROVAL OF THE ORDINANCE KNOWN AS
ORDINANCE NO. 1480, PASSED AND ADOPTED ON ITS
THIRD AND FINAL READING ON THE 16TH DAY OF
JANUARY, 1963 .
WHEREAS the City Council has made a canvass of the returns of
the certificates of the Inspectors and Clerks who held and con-
ducted the Special Municipal Election held on March 5, 1963 , for
the approval or disapproval of Ordinance No. 1480, such canvass
having been made solely, exclusively and entirely from such
returns;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida , that we do hereby find and declare
that the total number of votes cast in said election for the appro-
val of said Ordinance No. 1480 and the total number of votes cast
in said election against the approval of said Ordinance No. 1480
were as follows:
Upon the question: "Shall the ordinance known as Ordinance
No. 1480, passed and adopted on its third
and final reading on the 16th day of
January, 1963 , and entitled: 'AN ORDI-
NANCE GRANTING TO MALL TRANSPORT, INC. ,
A FLORIDA CORPORATION, AND TO ITS
SUCCESSORS AND ASSIGNS, THE RIGHT TO USE
THAT PORTION OF LINCOLN ROAD LYING WEST
OF THE WESTERLY LINE OF WASHINGTON AVENUE
TO THE EASTERLY LINE OF ALTON ROAD, OTHER-
WISE KNOWN AS THE LINCOLN ROAD MALL, AND
ANY FUTURE EASTERLY AND/OR WESTERLY EXTEN-
SION OF SAID MALL ON SAID LINCOLN ROAD,
IN THE CITY OF MIAMI BEACH, AND ITS SUC-
CESSORS FOR AND DURING A PERIOD OF FIVE
(5) YEARS, FOR THE PURPOSE OF ESTABLISHING,
OPERATING AND MAINTAINING A VEHICULAR
TRANSPORTATION SYSTEM FOR TRANSPORTING
PASSENGERS FOR COMPENSATION, IN CONFORMITY
WITH AND SUBJECT TO ALL PROVISIONS , TERMS
AND CONDITIONS HEREIN RECITED ' BE APPROVED
OR DISAPPROVED?" 1 , 945 votes were cast ,
of which 1 , 206 votes were cast "For the
Ordinance" and 739 votes were cast
"Against the Ordinance" .
AND, THEREFORE, BE IT FURTHER RESOLVED that we do hereby declare that
the ordinance known as Ordinance No. 1480, passed and adopted on its
third and final reading on the 16th day of March, 1963 , has been
duly and legally approved by the voters as provided by law.
PASSED and ADOPTED this 6th day of March, 1963 .
