Resolution 10968 RESOLUTION NO. 10968
WHEREAS, in order to acquire the right of way necessary for the
widening of Collins Avenue opposite Lots 1 to 30, inclusive, and
Lot 231, First Ocean Front Subdivision, it was necessary for the
City of Miami Beach to acquire the outlots which comprise a strip
of land opposite these lots lying between Collins Avenue and Indian
Creek; and
WHEREAS, escrow agreements have been prepared and executed by
the City and the owners, by the terms of which said outlots are to be
conveyed to the City and the City is to deliver to the respective
owners conveyances from the Trustees of the Internal Improvement Fund
of the State of Florida conveying a submerged area which the City
is to fill for the benefit of said owners; and
WHEREAS, in the case of Outlot No. 23 of said subdivision,
the deed from the Trustees of the Internal Improvement Fund names
the City as the grantee; and
WHEREAS, in order to comply with the terms of the escrow
agreement, it - is necessary for the City to execute a conveyance
of said szbmerged area to the owners of the existing Outlot No. 23
and;
WHEREAS, the Attorney for the City has prepared a conveyance
from the City to said owners of said submerged area;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA , that the Mayor and the City Clerk be
and they are hereby authorized and directed to execute said deed
conveying said submerged area to the owners of said Outlot No. 23
and to place said deed in escrow with the City Clerk in accordance
with the provisions of said escrow agreement.
