A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, FIXING A TIME AND PLACE AT WHICH
THE OWNERS OF PROPERTIES SPECIALLY BENEFITTED BY THE
CREATION OF A SPECIAL ASSESSMENT DISTRICT FOR THE
CONSTRUCTION OF A CAPITAL IMPROVEMENT PROJECT SPECIALLY
BENEFITING REAL PROPERTIES ON SUNSET ISLANDS 3 AND 4 (THE
DISTRICT) ; ALL LYING WITHIN THE CORPORATE LIMITS OF THE
CITY OF MIAMI BEACH, OR ANY OTHER PERSONS INTERESTED
THEREIN MAY APPEAR BEFORE THE CITY COMMISSION OF SAID
CITY TO BE HEARD AS TO THE PROPRIETY, ADVISABILITY AND
COST OF MAKING SUCH IMPROVEMENT, AGAINST EACH PROPERTY SO
IMPROVED, SUCH HEARING TO BE HELD IN ACCORDANCE WITH
ORDINANCE NO. 92-2782 .
WHEREAS, pursuant to the requirements of Ordinance No. 92-
2782, the City' s Home Rule Ordinance, the City adopted Resolution
No. 94-21146, known as the Initial Resolution, authorizing the
construction of a capital improvement project for the underground
conversion of all electric, telephone and cable television service
on Sunset Islands # & 4 , said project to be funded through the
creation of a special assessment district, and as more specifically
set forth in Resolution No. 94-21146, attached hereto and
incorporated herein as Exhibit "A" ; and
WHEREAS, Ordinance No. 92-2872 , requires that a public hearing
be held to hear the testimony of all property owners to be assessed
and any other interested parties pertaining to the propriety and
advisability of making such improvements, the cost thereof, the
manner of payment therefor, and the amount thereof to be assessed
against each property so improved within the District; and
WHEREAS, Ordinance No. 92-2782 , provides that consideration
of the special assessment will be given after hearing testimony
from the affected property owners as to making the improvements and
funding them with special assessments, and further provides that,
following testimony, the Mayor and City Commission of the City of
Miami Beach shall make a decision on whether to adopt an Approving
Resolution which will approve the plans, specifications, cost
estimates and the tentative assessment roll and confirm the Initial
Resolution; and,
WHEREAS, a tentative assessment roll has been completed and
filed of record with the Clerk of the City of Miami Beach.
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
of the City of Miami Beach, Florida:
Section 1. All findings and recitals contained in this
resolution are hereby adopted and incorporated
herein.
Section 2 . A public hearing is hereby scheduled to take place
before the Mayor and City Commission in the City
Commission Chamber, 1700 Convention Center Drive,
Miami Beach, Florida November 16, 1994 at 4:30 p.m.
o'clock . The Mayor and City Commission shall
hear testimony of all affected property owners and
any other interested parties pertaining to this
special assessment for Sunset Islands 3 and 4 .

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CONSTRUCTION OF
A CAPITAL IMPROVEMENT PROJECT SPECIALLY BENEFITING REAL
PROPERTIES ON SUNSET ISLANDS 3 AND 4; IDENTIFYING THE
SPECIFIC LOCATION AND ESTIMATED COST OF THE PROJECT, AS
WELL AS THE METHOD OF ASSESSMENT FOR THE FUNDING OF THE
PROJECT, AND FURTHER DIRECTING THE ADMINISTRATION TO
PREPARE PLANS AND SPECIFICATIONS RELATED TO THE PROJECT
IMPROVEMENTS AND A TENTATIVE ASSESSMENT ROLA..
WHEREAS, Ordinance No. 92-2782, provides for the levy and
payment of special assessments to fund the construction and
acquisition of local improvements; and
WHEREAS, the residents of Sunset Islands 3 and 4 desire to
improve the islands by relocating all overhead electrical,
telephone and television cable service underground (the Project) as
described in the attached Exhibit "A"; and
WHEREAS, the Project will specially benefit property by
protecting these utility services during certain severe weather
conditions, while also enhancing the aesthetic appearance of the
islands; and
WHEREAS, the total cost of the Project is estimated to be
$1,523,500 as represented in the attached Exhibit "B"; and
WHEREAS, the properties to be specially benefited by the
Project improvements will be assessed for their respective share of
the total cost of the Project based upon the total assessed
valuation (exclusive of all exemptions) of their respective
properties, based upon the property tax roll, as determined by the
Dade County Property Appraiser, in the year in which the assessment
is levied; and
WHEREAS, the City will prepare, or cause to be prepared, the
plans and specifications related to the Project, the tentative
assessment roll for the properties specially benefited, and their
4 required contribution; and
WHEREAS, pursuant to the requirements of Ordinance No. 92-
2782, this shall be known as the Initial Resolution, providing for
the identification, location and estimated cost of the Project, and
calling for the preparation of plans, specifications, and a
tentative assessment roll.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission adopt this Initial Resolution, as required by City
of Miami Beach Ordinance No. 92-2782, ordering the construction of
a capital improvement project specially benefiting real property on
,Sunset Islands 3 and 4, identifying the specific location, and
esti�ated cost of the Project, as well as the method 4f assessment
for the funding of the Project, and further directinngq the
Administration to pr•ppaarrs plans and specifications related to the
Project, and a tentative assessment roll.

SUBJECT: SCHEDULE PUBLIC HEARING - SUNSET ISLANDS 3 & 4 SPECIAL
ASSESSMENT DISTRICT FOR UNDERGROUND CONVERSION OF
UTILITIES
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission adopt the
attached resolution to set the required public hearing on the
Sunset Island 3 & 4 Special Assessment District for November 2,
1994 .
BACKGROUND:
The homeowners on Sunset Islands 3 and 4 have expressed a desire to
protect their electrical, telephone and cable television services
�- during severe weather and also improve the appearance of the
islands by relocating these overhead utility services underground.
A formal request to proceed with this project is contained in the
attached Exhibit "A" .
On April 20, 1994, the City Commission adopted Resolution No. 94-
21146, (Initial Resolution) which called for the preparation of
plans and specifications and estimated cost of improvements and the
tentative assessment roll with respect to the underground
conversion of electrical, telephone and cable television utilities
on Sunset Islands 3 & 4 . The project design and cost estimates have
now been completed by the respective utility companies. The
estimated cost is $1, 539, 500, which will be allocated from the Gulf
Breeze Loan Pool. The project cost will be fully reimbursible
through assessments over a 20 year period.
Pursuant to the Home Rule Special Assessment Ordinance No. 92-2782 ,
a public hearing must be held to hear testimony from the affected
property owners as to making the improvements and funding them with
special assessment. Following this testimony, the City Commission
shall make a decision on whether to adopt an Approving Resolution
which will approve the plans, specifications, cost estimates and
the tentative assessment roll and confirm the Initial Resolution. 194
