Resolution 12250 RESOLUTION NO. 12250
WHEREAS, BEATRICE L. SUSSMAN KIER, individually
and as Executrix of the Estate of William Sussman, deceased,
and HERBERT KIER, her husband; BEATRICE L. SUSSMAN KIER and
CITY NATIONAL BANK OF MIAMI BEACH, as successor co-trustee
under the Last Will and Testament of William Sussman,
Deceased, FELICE RONNIE COHEN and SELWYN DONALD SUSSMAN,
have offered to sell to the City for the sum of $204, 000. 00
cash, those certain parcels of land situate, lying and
being in the City of Miami Beach, County of Dade and
State of Florida, described as follows, to wit:
Lots 5, 6, the South 12-1/2 feet of
Lot 7, the North 1/2 of Lot 8, and
the South 37-1/2 feet of Lot 9, Block
22 , AMENDED PLAT OF GOLF COURSE
SUBDIVISION, according to the plat
thereof, recorded in Plat Book 6, at
page 26 of the public records of Dade
County, Florida.
TOGETHER with that portion of a strip of
land thirty (30) feet wide, known as the
"Bridle Path" , abutting on and easterly
of the above described Lots 5, 6, the South
12-1/2 feet of Lot 7, the North 1/2 of
Lot 8, and the South 37-1/2 feet of Lot 9,
Block 22, AMENDED PLAT OF GOLF COURSE
SUBDIVISION, according to the plat thereof,
recorded in Plat Book 6, at page 26 of the
public records of Dade County, Florida;
and
WHEREAS, the City Council of the City of Miami Beach
deems it to be to the best interest of said City to acquire
said property at said price and on the terms and conditions
set forth in said offer, for off the street parking of
automobiles; and
WHEREAS, there is presently pending in the Circuit
Court of Dade County, Florida, proceedings for the condemnation
of various parcels of land, of which the above described parcel
is a part, in the Circuit Court of Dade County, Florida, being
Case No. 67 - 13631, entitled "City of Miami Beach, a Florida
municipal corporation, vs. William G. Mechanic and Hilda
Mechanic, his wife, et al" , which suit will be dismissed as
to the said Sussmans, the owners of the property hereinabove
described, and as to the property hereinabove described, upon
consummation of the transaction hereinabove set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney
be and he is hereby authorized and directed to prepare an
agreement embodying the terms and conditions of the offer
hereinabove set forth, and that the Mayor and the City Clerk

and Finance Director be and they are hereby authorized
and directed to execute the said agreement in the name
of and on behalf of said City, and that the disbursing
officers of said City be and they are hereby authorized
and directed to disburse the monies required by the
terms of said agreement from funds of the City available
for such purpose.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that SAUL Z. BENNETT, the
City's negotiator in connection with this transaction,
be paid a fee for his services as such negotiator
upon consummation of said proposed transaction in the sum
$4, 080.00, and that the proper disbursing officers of the
City be and they are hereby authorized and directed to
disburse said sum as aforesaid from funds of the City
available for such purpose.
