A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF
THE REDEVELOPMENT AGENCY OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROPRIATING FUNDS, IN THE
AMOUNT OF $5'10,000, FROM THE REDEVELOPMENT
AGENCY (RDA), TAX INCREMENT 1998 BONDS, SERIES B,
FOR THE CONSTRUCTION OF THE CITY OF MIAMI BEACH
REGIONAL LIBRARY STREETSCAPE AND THE
COMPLETION OF THE STREETSCAPE AROUND THE MIAMI
CITY BALLET; SAID FUNDS TO BE USED FOR A CHANGE
ORDER TO THE CONTRACT BETWEEN THE TOWER
GROUP AND THE CITY OF MIAMI BEACH, FOR THE
CONSTRUCTION OF THE REGIONAL LIBRARY.
WHEREAS, on September 23, 1998, the Mayor and City Commission adopted
Resolution No. 98-2904, authorizing the Mayor and City Clerk to execute an
Agreement with the firm of Robert A. M. Stern Architects (Stern) for the
architectural and engineering design of a Regional Library, a 400-space Parking
Garage and Park and Streetscape Improvements in the area surrounding Collins
Park; and
WHEREAS, on November 2, 2001, the Regional Library documents were
advertised for bid and six bids were received on December 19, 2001; and
WHEREAS, on April 10, 2002, the City Administration recommended the Tower
Group for award of the construction contract for the Project and the Mayor and
City Commission approved the recommendation and adopted a Resolution
awarding the contract to the Tower Group; and
WHEREAS, the City has obtained several proposals for the construction of the
streetscape areas surrounding the Library including the remaining areas around
the Miami City Ballet not completed when the Bass Museum and the Ballet
building were constructed; and
WHEREAS, Homestead Concrete & Drainage, is the lowest of those received,
including the proposal received from The Tower Group to self-perform the work
and what appears to be a lower bid from Downrite Engineering and
Development Corporation, but which bid does not cover the entire area of
proposed work; and
WHEREAS, the proposal recommended by the City Administration for the
construction of the streetscape surrounding the Library and the Miami City Ballet
is for $510,000, and is proposed to be issued as a change order to the contract
between the City and The Tower Group for construction of the Regional Library;
and
WHEREAS, this approach has additional advantages in that it allows continuity in
the construction of the streetscape in unison with the construction of the Library
building and makes the Tower Group responsible for the installations and for
coordinating both projects, as well as for the schedule of completion; and
WHEREAS, the amount proposed and accepted by the City Administration is
consistent with the costs previously paid for the areas around the Bass Museum
and Miami City Ballet, and is competitive for this type of installation; and
WHEREAS, on the basis of the design requirements, the need to complete the
streetscape installations for the Regional Library, and the need to maintain
consistency throughout the Collins Park Cultural Center, the Executive Director
concurs with the City Administration and recommends that the chairman and
members of the RDA appropriate funding for same, in the amount of $510,000, to
be funded from City Center Redevelopment Agency funds.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN AND
MEMBERS OF THE REDEVELOPEMENT AGENCY OF THE CITY OF MIAMI
BEACH, FL., that the Chairman and Members herein, appropriate funds, in the
amount of $510,000, from the Redevelopment Agency (RDA), Tax Increment 1998
Bonds, Series B, for the construction of the City of Miami Beach Regional Library
Streetscape and the completion of the Streetscape around the Miami City Ballet; said
funds to be used for a change order to the contract between The Tower Group and the
City of Miami Beach for the construction of the Regional Library.

Item Summary/Recommendation:
The City has obtained several proposals for the construction of the streetscape areas
surrounding the Library and also to complete the installations around the Miami City Ballet not
installed when the Bass Museum and the Ballet building were completed. By constructing these
areas now, the streetscape installations surrounding the three principal buildings in the Collins
Park Cultural Center will be completed and only those areas related to the Collins Park project will
be remaining. The proposal recommended by staff for the construction of the streetscape
surrounding the Library and the Miami City Ballet is for $510,000 and will be issued as a change
order to the Tower Group. Staff has recommended this approach because it allows continuity in
the construction of the streetscape in unison with the construction of the Library building. This
approach also makes the Tower Group responsible for the installations and for coordinating both
projects as well as for the schedule of completion. The streetscape project consists of the
installation of new sidewalks, landscaping, irrigation, lighting and electrical installations, and
street fumiture such as benches, trash receptacles and bicycle racks. The installations will be the
same as those completed around the Bass Museum area and the portion in front of the Miami
City Ballet building and will maintain the consistency and continuity of the Stern design for the
complete Collins Park Cultural Center area. The amount proposed and accepted by staff is
consistent with the costs previously paid for the areas around the Bass Museum and Miami City
Ballet and are competitive for this type of installation. On the basis of the design requirements,
the needs to complete the streetscape installations for the Regional Library, and the need to
maintain consistency throughout the Collins Park Cultural Center, the Administration
recommends approval of the appropriation and a change order to the Tower Group, in the

Funding is available from the Redevelopment Agency (RDA).
ANALYSIS:
On September 23, 1998, the Mayor and City Commission adopted Resolution No. 98-22904,
authorizing the Mayor and City Clerk to execute an Agreement with the firm of Robert A. M. Stem
Architects (Stem) for the architectural and engineering design of a Regional Library, a 400-space
Parking Garage and Park and Streetscape Improvements in the area surrounding Collins Park.
On November 2, 2001, the Regional Library documents were advertised for bid. Six bids were
received on December 19, 2001. An Evaluation Committee reviewed the three lowest proposals,
which were within the budget constraints of the Project. The Project at that time did not include the
Parking Garage but two surface parking lots instead. The evaluation consisted of checking on the
submitted schedule of values and comparing it against the project estimates as well as the
references, financial status and other criteda showing the quality and ability of the bidders.
After extensive reviews, site visits and discussions with the Committee, the City Commission, and
Stern staff, the Administration recommended the Tower Group for award of the construction contract
for the Project. On April 10, 2002, the Mayor and City Commission approved the recommendation
and adopted a Resolution awarding the contract to the Tower Group.
The Tower Group has performed very well on the Project and is nearing completion of the intedor
and exterior work. Due to the continued quality performance of The Tower Group, staff is
recommending that a Change Order be approved to The Tower Group to construct the adjacent
streetscape previously designed by Stem pursuant to their Agreement. This would provide the
Library project and its surroundings with a "finished" look and would relieve the necessity of having

to return to the Library site at a later date to commence construction of the sidewalk.
It should be noted that this request for Change Order falls into the category of an "Owner's Request"
for additional work. The current Library project does not have the proposed streetscape work within
its scope as at the time the work was bid, the plan was to have the streetscape constructed by either
an independent contractor or by the contractor that would construct the proposed Collins Park
renovations. Based on the current timing for the Collins Park construction (estimated for FY 2005),
the logistical challenges of bringing a second contractor to the site immediately following the library
completion, the potential disruption to the Cultural Campus operations of maintaining the separation
of the Library and the Streetscape projects, and the quality work of The Tower Group, it is in the
City's interest to add this work to the current Regional Library Project.
As an alternative, and although staff does not believe there is an appreciable advantage to doing so,
the proposed Change Order work could be done by a separate contractor, or with the Collins Park
Project as it is not a necessary component of the Regional Library project. It simply makes sense to
perform this previously planned work now. By constructing these areas now, the streetscape
installations surrounding the three principal buildings in the Collins Park Cultural Center will be
completed and only those areas related to the Collins Park proper will be remaining. An amendment
to the Stern Agreement for the park portion of the Cultural Center Project is currently being
negotiated with Stern by the Administration and a recommendation for approval will be submitted to
the Mayor and City Commission at an upcoming Commission meeting.

the Library including the remaining areas around the Miami City Ballet not completed when the Bass
Museum and the Ballet building were constructed. The chosen proposal from Homestead Concrete
& Drainage, is the lowest of those received, including the proposal received from The Tower Group
to self-perform the work (although there appears to a be a lower bid from Downrite Engineering and
Development Corporation, this bid does not cover the entire area of proposed work). The Tower
Group has agreed to utilize Homestead as a sub-contractor and to coordinate the work. Finally,
Homestead was the contractor that completed the first phase of the streetscape work around the
Bass Museum of Art and a portion of the Miami Ballet.
The proposal recommended by staff for the construction of the streetscape surrounding the Library
and the Miami City Ballet is for $510,000 and is proposed to be issued as a change order to The
Tower Group. Additional advantages to this approach are that it allows continuity in the construction
of the streetscape in unison with the construction of the Library building. This approach also makes
the Tower Group responsible for the installations and for coordinating both projects as well as for
the schedule of completion.
The streetscape project consists of the installation of new sidewalks, landscaping, irrigation, lighting
and electrical installations, and street furniture such as benches, trash receptacles and bicycle
racks. The installations will be the same as those completed around the Bass Museum area and
the portion in front of the Miami City Ballet building and will maintain the consistency and continuity
of the Stern design for the complete Collins Park Cultural Center area.
The amount proposed and accepted by staff is consistent with the costs previously paid for the
areas around the Bass Museum and Miami City Ballet and are competitive for this type of
installation. The Administration reminds the Mayor and City Commission that the previously

design also includes a special pattern for the sidewalks which is distinctive from other sidewalk
patterns in the City and is more costly to install.
On the basis of the design requirements, the needs to complete the streetscape installations for the
Regional Library, and the need to maintain consistency throughout the Collins Park Cultural Center,
the Administration recommends approval of the change order to the Tower Group, in the amount of
$510,000, to be funded from City Center Redevelopment Agency funds.

We have completed our review of Change Order Request No.33, dated May 5, 2003
submitted by The Tower Group for the Streetscape Improvements work. We find the
proposed scope of work and dollar amount acceptable. A Change Order will be issued
for this work to increase The Tower Group's Contract amount by $ 509,953.00.
We would also like to address The Tower Group's contract modifications requested as
part of the above mentioned COR as follows:
COR Item No.I-URS Response: We are willing to recommend a time extension to the
contract, provided the contractor submits sufficient documentation to justify the time
extension request for our review and evaluation. The documentation should include but
not be limited to an acceptable revised construction schedule incorporating the new work
activities to show the actual impact on the remaining work.
COR Item No.2-URS Response: All communications will be done in accordance with the
contract documents for this project.
COR Item No.3-URS Response: Any requests for retainage reduction shall be done in
accordance with Article 4, Paragraph 4.2 of the contract agreement between the City of
Miami Beach and The Tower Group.
COR Item No.4-URS Response: We are willing to recommend a time extension to the
contract, provided the contractor submits sufficient documentation to justify the time
extension request for our review and evaluation. The documentation should include but
not be limited to an acceptable revised construction schedule incorporating the new work
