Resolution 11611 RESOLUTION NO. 11611
WHEREAS the City Council of the City of Miami Beach,
Florida, by its Resolution No. 11457, adopted on the 7th day of
April, 1965, authorized the execution of an Agreement between
the City of Miami Beach and Metropolitan Dade County for the
utilization by said City of the services of the Metropolitan
Dade County Planning Department for local planning as may be
requested by said City from time to time, and
WHEREAS the City Council of the City of Miami Beach,
Florida deems it to be in the best interests of the City and
its citizens that said Resolution be amended by further author-
izing the Mayor and the City Clerk to enter into and to execute
for and in the name of the City that certain "Open-Space Land
Acquisition Agreement", prepared by Metropolitan Dade County,
and a copy of which is attached hereto and made a part hereof.

2. The Public Bodies will acquire open-space la n :he

as identified 4 (1) above, amendments thereto or modification gear
may be agreed upon from time to time by the parties hereto, and will use
their best efforts to increase their open-space land acquisition program+
proportion to any grants received under the Federal Opece Land

S. The Public Bodies will provide funds for such acquisitio
within their respective ,jurisdictions as needed .
4. In order to assure that individual acquisitionsAte in
accordance with the County-wide master plan and with any ap*eovec' amend-•
laents thereto, each Public Body, prior to final acquisition action on lane
to be used for open-space purposes or before submission of an applicatiel
for Title VII assistance , will submit to the Metropolitan Dade County
Planning Advisory Board for review all descriptions of proposed acquisi-
tions . The Public Bodies further agree to be guided by the review of the

S. Nothing herein contained is intended to require a Public Body
co take any action which it is not, authorized to take or to refrain from

6 . This agreement , shall take effect upon execution Metropol i

OPEN-SPACE LAND ACQUISITION AGREEMENT
This agreement was initially made and entered into on the 27th day of Qctober,
1964, by Metropolitan Dade County and the municipalities of Miami and North Miami
hereinafter referred to as "Public Bodies."
WITNESSET H:
WHEREAS, the Public Bodies are authorized by law to exercise responsibilities
for the preservation of open-space land in Dade County, Florida, through the
acquisition by gift, purchase, or condemnation of title to or other permanent in-
terest in undeveloped or predominantly undeveloped land which has value for park
and recreational purposes, conservation of land and other natural resourcee, or
historic or scenic purposes;
WHEREAS, Metropolitan Dade County is charged by law with making and adopting
a county-wide master plan for the physical development of the territory within
Dade County, comprising 2,352 square miles in the southeast part of the Stete of
Florida, which plan must be made with the general purpose of guiding and accomplish-
ing a coordinated, adjusted and harmonious development of the entire county;
WHEREAS, the parties to this Agreement are fully cognizant of the urgency of
the need to expedite the process of acquiring open-space land in accordance with
an orderly, cooperative plan and recognize the importance of joint and combined
efforts on the part of local governments of the area in the provision of open-space
land in accordance with an area-wide plan therefore;
NOW, THEREFORE, AGREEMENT WITNESSETH, that Metropolitan Dade County awl each
Public Body do agree as follows:

1. As a basis for programs for the acquisition of title to or other permanent
interests in land to be used as open-space land or parks, the parties heretq have
made, subscribed to and endorsed a county-wide plan, identified as the Metrqpolitan
Dade County General Land Use Master Plan, completed in October, 1963, which plan is
a comprehensive land-use plan for the entire county.
2. The Public Bodies will acquire open-space land within their respective
jurisdictions in accordance with this county-wide master plan as identified in (1)
above, amendments thereto or modifications thereof as may be agreed upon frqm time
to time by the parties hereto, and will use their best efforts to increase their
open-space land acquisition program in proportion to any grants received unler the
Federal Open-Space Land Program.
3. The Public Bodies will provide funds for such acquisition within their
respective jurisdictions as needed.
4. In order to assure that individual acquisitions are in accordance with the
county-wide master plan and with any approved amendments thereto, each Public Body,
prior to final acquisition action on land to be used for open-space purposes or
before submission of an application for Title VII assistance, will submit tq the
Metropolitan Dade County Planning Advisory Board for review all descriptions of
proposed acquisitions. The Public Bodies further agree to be guided by the review
of the Metropolitan Dade County Planning Advisory Board in proceeding with the
acquisition of open-space lands.
5. Nothing herein contained is intended to require a Public Body to take any
action which it is not authorized to take or to refrain from taking any act#on which
it is required to take, pursuant to the State or local law under which such Public
Body is created or under which it exercises responsibilities for the preservation
of open-space land.

6. This agreement shall take effect upon execution by Metropolitan Dade County
and the Cities of Miami and North Miami. Thereafter, additional public bodies may,
from time to time, execute this agreement and such execution subsequent to the date
of this agreement shall not be deemed to require its re-execution by Metropplitan
Dade County and each Public Body which had theretofore executed the same.
The City of Miami Beach hereby becomes a party to this agreement, as pro-
vided in paragraph number six above, and approves and executes same on this 1st
day of September , 1965.
