Resolution 11627 RESOLUTION NO. 11627 WHEREAS, the ground surface of the following described parcel of land, to wit: Commencing approximately 65 ' East of the Southeast corner of Meridian Court and 17th Street as point of beginning; thence run 375 ' + East along the South side of 17th Street; thence South 300' ; thence West 375 ' + on the North side of North Lincoln Lane; thence North 300 ' on Meridian Court to the Point of Beginning has been and is being used for municipal parking purposes, and WHEREAS said parcel of land is advantageously and strategi- cally situated in relation to the Lincoln Road Mall, which con- stitutes an internationally famous retail shopping area, and WHEREAS the Air Space or Air Lot of the hereinabove described parcel of land is therefore possessed of substantial value, and WHEREAS the City Council has found and determined that there is not now nor will there be in the foreseeable future any need of the said Air Space or Air Lot for any municipal purpose, and WHEREAS the utilization of the said Air Space or Air Lot for an appropriate and suitable Air Rights structure and improve- ment for use solely as a Merchandise Mart with no retail stores, and solely for the display and exhibition of sample merchandise, would greatly promote the general welfare of the City and its residents by attracting great numbers of manufacturers and buyers from distant places, and provide exceptional employment opportunities for many persons , and would promote the economy of every facet of the community, including hotels, restaurants and retail stores . NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA that the City Manager be and he is hereby authorized and directed to advertise forthwith for sealed Competitive Bids for a lease for a term of Ninety-nine (99) years for the Air Space or Air Lot of the hereinabove described parcel of land; said lease to be predicated upon the following specifications and covenants, to wit: 1. That the lessees shall construct an appropriate and suitable Air Rights structure or improve- ment to be devoted solely to use as a Merchan- dise Mart; said structure to be so designed and constructed as to assure to the City the full use of the ground surface of said parcel of land for municipal parking purposes, except that the proposed lease shall include a provi- sion for sufficient ground surface for -1- corridor, elevator and stairway space for the proposed structure, as well as a sufficient area for a ramp for vehicular traffic, permit- ting ingress to and egress from a second floor parking area. 2 . The proposed structure will have an area at its base of 112, 500 square feet and shall be not less than stories nor more than 14 stories in height. 3 . The proposed structure shall provide a hori- 1 zontal plane of clearance over the existing municipal parking lot of not less than twelve (12) feet . 4. The ground surface of said parcel of land with the exception of that area described in Para- graph 1, will be maintained by the City and shall be devoted to municipal parking lot purposes. 5 . The proposed lease shall expressly provide that the fee simple title to the parcel of land and Air Space described herein will not be subordinated to tne lien of any encumbrance, and that said Air Space structure shall be subject to ad valorem taxes payable by the lessee . 6 . Said invitation for sealed Competitive Bids. shall also provide that the City will accept proposals varying from the above specifica- tions solely for tne purpose of ascertaining other more feasible or advantageous methods of leasing the hereinabove described Air Space or Air Lot and that the City expressly reserves the right to reject any and all bids or to waive defects of form in any proposed bid. Said invitation for bids shall expressly recite that in the consideration and acceptance of any proposal, the City Council shall be entitled 4 to exercise every measure of lawful discretion in evaluating tne financial history and ability of the proposer and his or its past performance in ventures of this or similar nature, and that such data will be considered either as a material or controlling factor in the acceptance of any proposal submitted. Said invitation may also, in the discretion of the City Manager, set forth any other provisions not in conflict here- with usually and customarily utilized by the City in its standard procedures in obtaining competi- tive bids .
