Resolution 11677 RESOLUTION NO. 11677
WHEREAS, since the filing of the plat of First Ocean Front Sub-
division, which was recorded in Plat Book 9 at page 78 of the public
records of Dade County, Florida, the boundaries of Collins Avenue
have been altered so that there now exists between Lots 233 to 236,
inclusive/ of said subdivision and the easterly line of Collins Avenue
as it now exists a strip of land which is no longer used for highway
purposes; and
WHEREAS, the City of Miami Beach and the holders of public
utility franchises are now using portions of said strip of land for
underground utilities; and
WHEREAS, the City of Miami Beach and the owner of said Lots 233 to
236, inclusive, have heretofore agreed that the City will execute and
deliver to said owner a quit-claim deed covering said strip of land
and the said owner will deliver to said City a perpetual easement for
underground utilities over, under and across said strip of land; and
WHEREAS, the Attorney for the City has prepared said quit-claim
deed and the said grant of perpetual easement, with the terms of which
the City Council is familiar;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Miami Beach, Florida, that the Mayor and the City Clerk be and they
are hereby authorized and directed to execute said quit-claim deed
in the name of and on behalf of said City, which said quit-claim deed
is to be delivered in exchange for a duly executed grant of easement,
as hereinbefore referred to and described.
