Resolution 11687 RESOLUTION NO. 11687 WHEREAS, the City of Miami Beach has instituted, and there is now pending an Eminent Domain proceeding in the Dade County Circuit Court for the acquisition by the City of the following described property, to-wit: Lots 23, 24 and 25 of FIRST OCEAN FRONT SUB- DIVISION, according to the amended plat thereof, recorded in Plat Book 9, at page 78 of the Public Records of Dade County, Florida; and also That certain parcel of land lying between Collins Avenue and Indian Creek Westerly of Lots 23, 24 and 25 of FIRST OCEAN FRONT SUB- DIVISION, bounded as follows, to wit: Bounded on the Southerly side by the South- erly line of Outlot 23 of said subdivision produced Westerly; bounded on the Northerly side by the Northerly line of Outlot 25 of said subdivision produced Westerly; bounded on the Westerly side by a portion of the line described as follows: Beginning at a point on the Southerly line of Lot 23 of said subdivision produced Westerly, and 161 feet Westerly of the Easterly line of Collins Avenue, measured along the Southerly line of said Lot 23 produced Westerly; thence run Northerly to a point on the Northerly line of Lot 231 of said subdivision produced Westerly, and 278 feet Westerly of the Easterly line of Collins Avenue, measured along the Northerly line of said Lot 231 produced Westerly; bounded on the Easterly side by a line para- llel to, and 31 feet Easterly of, the above described Westerly boundary. WHEREAS, extensive negotiations have since been had with the owners of the above described property for the purchase thereof, and WHEREAS the owners have agreed to sell said described land for the sum of One Million, Five Hundred Eighty Thousand ($1, 580, 000.00) Dollars, and WHEREAS, the City Council, after considering said offer, has determined that it is to the best interests of the City, its citizens and its residents to accept said offer, rather than to proceed with said Condemnation proceedings, and WHEREAS, an Escrow Agreement for the purchase of said land in accordance with the foregoing has been prepared and the City Council being familiar with the provisions thereof, - 1 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA that said Escrow Agreement for the purchase of said land for the sum of One Million, Five Hun- dred Eighty Thousand ($1, 580, 000.00) Dollars as aforesaid be and the same is hereby approved and agreed to and the Mayor and the City Clerk be and they are hereby authorized and directed to execute for and in the name of the City the said Escrow Agreement hereinabove described and prepared by the City Attor- ney, and the appropriate financial and disbursing officials of the City of Miami Beach be and they are hereby directed to pay and disburse the sums specified and set forth in said Agreement, and that upon the consummation of said Agreement the pending Condemnation suit be dismissed. PASSED and ADOPTED this 16th day of December, 1965.
