WHEREAS, CARL COHEN and BARBARA L. COHEN, his wife, are
the owners in fee simple of the following described parcel of
land situate, lying and being in the City of Miami Beach, Dade
County, Florida:
The North 1/2 of Lot 13, and all of Lot
14, Block 1, SAN MARINO ISLAND, accord-
ing to the plat thereof, as recorded in
Plat Book 9, at page 22 of the public
records of Dade County, Florida;
and
WHEREAS, the public records of Dade County, Florida, re-
flect that the City of Miami Beach had been granted an easement
for storm sewer purposes in the Northerly 2-1/2 feet of Lot 13,
Block 1, San Marino Island; and
WHEREAS, the City Council of the City of Miami Beach, on
October 20, 1937, authorized the release and surrender of said
easement, because the same was not needed, and a quitclaim deed
releasing and surrendering said easement was delivered to Fogal
Boatyard, Inc. , a predecessor in title to the said CARL COHEN
and BARBARA L. COHEN, his wife, but apparently said quitclaim
deed was not recorded; and
WHEREAS, the City of Miami Beach, in 1955, was granted a
storm sewer easement through the Northerly five feet of the
South 1/2 of Lot 13, Block 1, SAN MARINO ISLAND, which easement
is adequate and sufficient for drainage needs in the area and
now contains a 15" storm sewer; and
WHEREAS, the City Council of the City of Miami Beach,
Florida, finds and determines that it is for the best interest
of the City of Miami Beach, its residents and inhabitants, to
again authorize the execution of a quitclaim deed to the said
storm sewer easement in the Northerly 2-1/2 feet of Lot 13,
Block 1, San Marino Island; and
WHEREAS, a proposed quitclaim deed has been prepared for
execution by the Mayor and the City Clerk and Finance Director
of the City;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk and Finance Director be and they are hereby authorized and
directed to execute, in the name of and on behalf of the City of
Miami Beach, the said quitclaim deed to CARL COHEN and BARBARA L.
COHEN, the present owners of said property, releasing and sur-
rendering the said storm sewer easement in the Northerly 2-1/2
feet of Lot 13, Block 1, San Marino Island, as per plat recorded
in Plat Book 9, page 22 of the public records of Dade County,
Florida.
PASSED and ADOPTED this 15th day of November , 1967.
