A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
CITY OF MIAMI BEACH, ON BEHALF OF THE MIAMI BEACH
POLICE DEPARTMENT, TO DONATE $41,722.88 IN HOLIDAY
TOY DRIVE FUNDS TO THE MIAMI BEACH POLICE ATHLETIC
LEAGUE, INC., A NONPROFIT ORGANIZATION.
WHEREAS, the Miami Beach Police Department has acquired funds donated by
the community, and has traditionally hosted an annual holiday toy drive and giveaway
event which has been in existence since 1982; and
WHEREAS, the annual holiday toy giveaway event is attended by approximately
400 children from lower-income families throughout the City, who receive toys and other
gifts for the holiday season; and
WHEREAS, the bank account that has held the toy drive funds was recently
closed for inactivity, and the Miami Beach Police Department believes it would be
appropriate to transfer the $41,722.88 to a nonprofit entity to facilitate this event; and
WHEREAS, the Police Department has identified the Miami Beach Police
Athletic League, Inc. ("PAL"), a 501(0)(3) nonprofit organization, whose overall mission is
perfectly aligned with the annual holiday toy drive and giveaway event, and who has
previously collaborated with the Miami Beach Police Department to be involved with this
event; and
WHEREAS, the PAL has voted to support this endeavor, and has agreed to
accept the donation and serve as a partner with the Miami Beach Police Department for
this exceptional event; and
WHEREAS, the PAL will earmark and disburse such donated funds for the
annual holiday toy drive and giveaway, and other similar events which provide gifts to
disadvantaged or underprivileged children in the City.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the City of Miami Beach, on behalf of the Miami Beach
Police Department, to donate $41,722.88 in holiday toy drive funds to the Miami Beach
Police Athletic League, Inc., a nonprofit organization.

ANALYSIS
Since 1982, the Miami Beach Police Department (MBPD) has spread a little extra holiday cheer by
hosting the annual Toy Giveaway. The event, which takes place at the Police Department every
December, is attended by hundreds of disadvantaged children who are Miami Beach residents. This
cherished event each year provides an ideal opportunity for law enforcement to connect with these
children on a personnel level. This is an important MBPD community outreach effort that has an
impact on both the children and their parents' perceptions of police officers, police work and MBPD's
community engagement. While the Toy Giveaway is but one touch point, it is an important event that
often leads to stronger relationships between officers and the community.
Each year the MBPD partners with community members, volunteers and local businesses to raise
funds for the nearly 400 youth who participate in the December event. Until recently, the fund balance
was maintained in a Bank of America account, with a balance of$41,722.88. This summer, Bank of
America chose to close the account for lack of sufficient activity, returning the check to the City.
Accordingly, the Police Department needs to identify a new way to safeguard the funds.
The Toy Giveaway's purpose is perfectly aligned with the mission of the Miami Beach Police Athletic
League (PAL), which for over 50 years, has focused on creating better relations between law
enforcement and youth. The PAL has partnered with the MBPD for many years to host, select toy
recipients and help staff during the Toy Giveaway event. Accordingly, moving the existing fund
balance to the PAL is a logical move. In addition, as a 501(c)(3) organization, the PAL is an ideal
partner to ensure that future donors to the Toy Giveaway are able to claim financial contributions as
charitable gifts and receive a tax benefit.
Chief Oates recently approached the PAL President and Board of Directors about the opportunity to
enter into this partnership. Subsequently, the PAL Board of Directors voted unanimously to support
this offer. As a result of the conversations between the PAL leadership and Chief Oates, both agree
that the Toy Giveaway monies—the 41,722.88 that exists today and all future contributions -- will be
segregated apart and not comingled with other PAL assets. These donations will be specifically
earmarked and disbursed only for the annual Toy Giveaway or occasional related events involving
gifts to disadvantaged Miami Beach children, such as several years ago, when 30 children were

presented with new bicycles paid for by the Fund during a Ciclovia event in June. Future funds
collected will be deposited in the PAL's Toy Giveaway account for expenses related to the annual
Toy Drive and occasional other MBPD gift initiatives for disadvantaged Miami Beach youth.
The MBPD is hereby requesting the Mayor and City Commission to approve for the MBPD to
donate $41,722.88 in holiday toy drive funds to the Miami Beach Police Athletic League, Inc., and for
the PAL to receive all future donations for the Toy Giveaway for the reasons described above.
