Resolution 12389 RESOLUTION NO. 12389
WHEREAS the City Council of the City of Miami
Beach; Florida, is considering amending Ordinance No. 289,
commonly known as the "Zoning Ordinance of Miami Beach, Florida" ,
and the maps attached thereto and made a part thereof, by
adding thereto, immediately following Area District 76, a
new Area District to be numbered Area District 77, and to
read as follows:
"DISTRICT ATO 77. There shall be a front
yard having a depth of not less than 40 feet when
measured from the harbor line described in and
established by Ordinances numbered 1212, 1250 and
1277, of the City of Miami Beach, Florida" ;
and to include in said Area District Noo 77, the following
described land, situate in the City of Miami Beach, Dade
County, Florida, that certain parcel of land described as
follows, to wit:
Beginning at a point on the northerly line, produced
easterly, of Lot 43, Block 1, SECOND OCEAN FRONT
SUBDIVISION, according to the Amended Plat thereof,
recorded in Plat Book 28, at page 28 of the Public
Records of Dade County, Florida, said point being
three hundred thirty-three (333) feet easterly of the
easterly line of Collins Avenue, measured at right angles
to the said easterly line of Collins Avenue;
Thence run in a northerly direction along a line
parallel to; and three hundred thirty--three (333) feet
easterly of the easterly line of Collins Avenue to a
point on the northerly line produced easterly of Lot 44,
Block 1, of the aforementioned subdivision;
Thence run northerly along a straight line parallel to
and three hundred thirty-three (333) feet easterly of the
easterly line of Collins Avenue to a point on the northerly
line, produced easterly of Lot 1, Block B, ATLANTIC
HEIGHTS, as said Avenue, Lot, Block and Subdivision are
shown on Plat recorded in Plat Book 9, at page 14 of the
Public Records of Dade County, Florida;
Thence run in a northerly direction to a point on the
northerly line produced easterly of Lot 1, Block A, of
the above mentioned subdivision, said point being two
hundred ninety (290) feet easterly of the easterly line
of Collins Avenue, measured along the said northerly line
of Lot 1, and said northerly line produced easterly;
Thence run in a northerly direction to a point on the
center line, produced easterly, of Seventy-first (71st)
Street, as said Seventy-fi?::st (71st) Street is shown on
the Plat of NORMANDY BEACH SOUTH, recorded in Plat Book 21,
at page 54 of the Public Records of Dade County, Florida,

said point being two hundred seventy-seven (277) feet
easterly of the easterly line of Collins Avenue, measured
along the said center line of Seventy-first (71st) Street,
and said center line produced easterly;
Thence run in a northerly direction to a point on the
northerly line, produced easterly, of Lot 1, Block 9,
of the last mentioned subdivision, said point being
three hundred (300) feet easterly of the easterly line
of Collins Avenue, measured along said northerly line of
Lot 1, and said northerly line produced easterly;
Thence run in a northerly direction to a point on a line
parallel to and forty (40) feet southerly of the northerly
line of Seventy-third (73rd) Street, produced easterly,
as said Seventy-Third (73rd) Street is shown on the Plat
of HARDING TOWNSITE as recorded in Plat Book 34, at
page 4 of the Public Records of Dade County, Florida,
the said point being four hundred eighteen (418) feet
easterly of the easterly line of Collins Avenue, as
Collins Avenue is shown on the said Plat of HARDING
TOWNSITE, measured along the said line parallel to and
forty (40) feet southerly of the northerly line of
Seventy-third (73rd) Street, and said parallel line
produced easterly;
Thence run to a point on a line parallel to and sixty-two
(62) feet northerly of the southerly line of Seventy-
fifth (75th) Street, produced easterly, as said Seventy-
fifth (75th) Street is shown on the Plat of HARDING TOWN-
SITE, recorded in plat Book 34, at page 4 of the Public
Records of Dade County, Florida, said point being four
hundred seventeen (417) feet easterly of the easterly line
of Collins Avenue, as Collins Avenue is shown on the
said Plat of HARDING TOWNSITE, measured along the said
line parallel to and sixty-two (62) feet northerly of the
southerly line of Seventy-fifth (75th) Street, and said
parallel line produced easterly;
Thence run westerly forty (40) feet to a point on a line
parallel to and si:;ty-two (62) feet northerly of the
southerly line of Seventy-fifth (75th) Street produced
easterly as said Seventy-fifth (75th) Street is shown on
the Plat of HARDING TOWNSITE, recorded in Plat Book 34,
at page 4 of the Public Records of Dade County, Florida,
said potnt being three hundred seventy-seven (377) feet
easterly of the easterly line of Collins Avenue, as
Collins Avenue is shown on the said Plat of HARDING TOWNSITE,
measured along said line parallel to and sixty-two (62)
feet northerly of the southerly line of Seventy-fifth
(75th) Street, and said parallel line produced easterly;
Thence run southerly to a point on a line parallel to
and forty (40) feet southerly of the northerly line of
Seventh-third (73rd) Street produced easterly as said
Seventh-third (73rd) Street is shown on the Plat of
HARDING TOWNSITE as recorded in Plat Book 34, at page 4
of the Public Records of Dade County, Florida, said

point being three hundred seventy-eight (378) feet
easterly of the easterly line of Collins Avenue, as
Collins Avenue is shown on the said Plat of HARDING
TOVNSITE, measured along the said line parallel to and
forty (40) feet southerly of the northerly line of
Seventy-third (73rd) Street, and the said parallel line
produced easterly;
Thence run southerly to a point on the northerly line
produced easterly of Lot 1, Block 9, NORMANDY BEACH SOUTH,
recorded in Plat Book 21, at page 54 of the Public Records
of Dade County, Florida, said point being two hundred
sixty (260) feet easterly of the easterly line of Collins
Avenue, measured along said northerly line of Lot 1, and
said northerly line produced easterly;
Thence run southerly to a point on the center line produced
easterly of Seventy-first (71st) Street, as said Seventy-
first (71st) Street is shown on the Plat of NORMANDY BEACH
SOUTH, as recorded in Plat Book 21, at page 54 of the
Public Records of Dade County, Florida, said point being
two hundred thirty-seven (237) feet easterly of the
easterly line of Collins Avenue, measured along the said
center line of `>eventy-first (71st) Street, and said
center line produced easterly;
Thence run in a southerly direction to a point on the
northerly lino produced easterly of Lot 1, Block A of
ATLANTIC HEIGHTS SUBDIVISION, according to the corrected
Plat thereof, recorded in Plat Book 9, at page 14 of the
Public Records of Dade County, Florida, said point being
two hundred fifty (250) feet easterly of the easterly
line of Collins Avenue, measured along the said northerly
line of Lot 1, and said northerly line produced easterly;
Thence run southerly to a point on the northerly line
produced easterly of Lot 1, Block B, ATLANTIC HEIGHTS,
as recorded in Plat Book 9, at page 14 of the Public
Records of Dade Co=ty, Florida, said point being two
hundred ninety-three (293) feet easterly of the easterly
line of Collins Avenue, measured at right angles to the
said easterly line of Collins Avenue as said avenue is
shown on the above mentioned Plat;.
Thence run in a southerly direction to a point on the
northerly line of Lot 44, Block 1, SECOND OCEAN FRONT
SUBDIVISION, according to the Amended Plat thereof,
recorded in Plat Book 28, at page 28 of the Public Records
of Dade County; Florida, said point being two hundred
ninety-three (293) feet easterly of the easterly line of
Collins Avenue, measured at right angles to said easterly
line of Collins Avenue;
Thence run in a southerly direction to a point on a line
produced easterly of Lot 43, Block 1, SECOND OCEAN FRONT
SUBDIVISION, according to the Amended Plat thereof,

recorded in Plat Book 28, at page 28 of the Public
Records of Dade County, Florida, said point being two
hundred ninety-three (293) feet easterly of the easterly
line on Collins Avenue, measured at right angles to
said easterly line of Collins Avenue;
Thence run forty (40) feet in an easterly direction to
point of beginning.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing
be and the same is hereby called to be held on the 17th day
of April, 1968, at 3:00 o'clock P.M. , in the Council Chambers,
City Hall, Miami Beach, Florida, for the consideration of said
amendmont.
BE IT FURTHER RESOLVED that the City Clerk and
Finance Director be and she is hereby directed to give fifteen
(15) days' notice of the time, place and object of said hearing
by public notice thereof, published in the Miami Beach Daily
Sun, a daily newspaper of general circulation in said City.
