Resolution 12406 RESOLUTION NO. 12406
WHEREAS the City Council of the City of Miami Beach, Florida
deems it to be necessary for the welfare of said City and to the
inhabitants thereof,to acquire, for street and highway purposes, the
following described parcel of land situate, lying and being in
Miami Beach, Dade County, Florida, to wit:
Lot 3_ , r? ,:?\`r 77JGO BAY SJBDIV:c;SIGO No. 1, according
to the Plat thereof as recorded in Plat Book 6
at page 101 of the Public Records of Dade County,
Florida; less the following described portion of
Lot 1:
Begin at a point of crossing of the tangents of a
circular curve, having a central angle of 93 degrees
30' , a radius of 15 feet; said tangents being the
northerly line of 41st Street extended westerly,
and easterly line of Pine Tree Drive extended
southerly, as same is on FLAMINGO BAY SUBDIVISION
NO, I, Plat Book 6, Page 101; thence run easterly
along the tangent of said curve, or westerly
projection of 41st Street a distance of 15.945
feet to point of curvature of said circular
curve or point of beginning of tract of land
herein described:
From said point of beginning run northwesterly
along arc of a circular curve deflecting to the
right, having for its elements a central angle
of 63 degrees, 26' 05.8" a radius of 15 feet a
distance of 16.072 feet to a point, (chord of
said curve making an angle from tangent to chord
of 31 degrees 43' 02.9" , and having a length
of 15.772 feet) said point being the crossing of
the arc of said curve with a line parallel to
and 7.5 feet north from northerly line of 41st
Street or southerly line of said Lot 1, FLAMINGO
BAY SUBDIVISION NO. 1, thence run easterly along
a line parallel to and 7.5 feet distant northerly
from southerly line of said Lot 1, FLAMINGO BAY
SUBDIVISION NO. 1, said 7.5 feet being measured
at right angles to said southerly line of Lot 1,
FLAMINGO BAY SUBDIVISION NO. 1, a distance of
392.504 feet to a point, said point being 395.0'
easterly from the tangent of said curve on easterly
line of Pine Tree Drive, extended southerly;
thence run southeasterly along a line deflecting
to the right 8 degrees 40' 15", a distance of
40.253 feet to a point on the water face of concrete
bulkhead on westerly shore of Indian Creek; thence
run southwesterly along a line deflecting 85 degrees
21' 25" to right, aAeng water face of concrete
bulkhead on westerly shore of Indian Creek, a
distance of 1.435 feet to a point, said point being
crossing of water face of concrete bulkhead on
westerly shore of Indian Creek with southerly line
of said Lot 1, FLAMINGO BAY SUBDIVISION NO. 1;
thence run along a line deflecting to right 85 degrees
58' 20" , along southerly line of said Lot 1, FLAMINGO
BAY SUBDIVISION NO. 1. or no:ctherly line of said
41st Street, a distance of 419.206 feet to point
of beginning.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that it is necessary that the
fee simple title to the above described property be acquired for
street and highway purposes, for the benefit of said City and its
inhabitants.
BE IT FURTHER RESOLVED that the City Attorney be and he is
hereby authorized and directed to institute the necessary legal
proceedings in the name of said City in the exercise of its :right
of eminent domain for the condemnation of said property for said
purpose.
