Resolution 12484 RESOLUTION NO., 12484
WHEREAS , on August 2 , 1966 , one Jack Melvin Dressner ,
while employed by the City of Miami Beach was injured when he
sprained his low back while pulling out tree roots on a municipal
golf course , and
WHEREAS , the injured employee was treated or examined by
the City Physician, Dr. Leo Grossman, by Dr. J. W. Barrett and by
St. Francis Hospital , all authorized by the City, and
WHEREAS, the said employee's attorney had the employee
seen and treated by Dr. Warren Zundell , who gave the employee a
rating of 5% - 10% permanent partial disability of the body as a
whole , and
WHEREAS, a hearing was held on November 8 , 1967 before
Judge Leonard P. Cardone at the Florida Industrial Commission,
and
WHEREAS , the said employee was awarded at said hearing
compensation based upon 5% permanent partial disability of the
body as a whole , an attorney's fee of $250. 00 and other benefits
all totalling approximately $1 ,100. 00 , and
WHEREAS , the City filed an Application For Review before
the Full Commission in Tallahassee, subsequent to which said
employee's attorney initiated settlement negotiations with the
legal department , and
WHEREAS , it is felt by the legal department that it is in
the City' s best interests to enter into a compromise settlement
stipulation under the provisions of §440. 20 (10) , Florida Statutes ,
as amended 1967 , such settlement to be as follows: $354. 00 to
Mr. Dressner; $206. 00 to Mr. Dressner's attorney, representing his
fee and certain costs incurred; and $140. 00 to Dr. Warren Zundell
for services rendered claimant; totalling $700. 00 payable by the
City, and
WHEREAS , payment of the sum hereinbefore set forth will
discharge forever the City's liability of every description for
past , present and future Workmen's Compensation benefits payable
as a result of the accident of August 2 , 1966 , and
WHEREAS , the Order of the Judge approving said stipulation
will not be subject to modification or review , and
WHEREAS , the City Council deems it to be in the best
interests of the City to enter into a final settlement stipulation
upon the terms hereinbefore set forth;
NOW,THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE
CITY OF MIAMI BEACH, that the legal department be authorized to
enter into a final settlement stipulation with Jack Melvin Dressner
and his attorney, and if said agreement is approved by the Judge of
Industrial Claims , the Mayor and Finance Director and Insurance
Manager, be, and they are hereby authorized and directed to comply
with the Order of the Judge approving said stipulation.
