Resolution 12506 RESOLUTION NO. 12506 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA : SECTION 1 : That the following questions relating to proposed amendments to Chapter 7672 , Laws of Florida, Acts of 1917, as amended, the same being the Charter of the City of Miami Beach, Florida, shall be submitted to the electors of the City of Miami Beach, Florida, for their approval or rejection at a special election to be held in the City of Miami Beach, Florida, on the fifth day of November, 1968 : 1. Shall the City Charter be amended to provide, commencing November, 1969, and every two years thereafter, that the primary election for Mayor and Councilmen shall be held on the first Tuesday following the first Monday in November; that the general election shall be held two weeks thereafter, and that the terms of the Mayor and Councilmen whose terms would expire in June, 1969, and the terms of the Councilmen whose terms would expire in June, 1971, shall be extended until November, 1969 and November, 1971, respectively? 2 . Shall the City Charter be amended so as to provide that the City shall be authorized to convey in fee simple the land commonly known as the "Par 3 Golf Course" to the Dade County Board of Public Instruction as a site for the construction of an "Educational Complex" in consideration of the conveyance to the City by the Dade County Board of Public Instruction of the several School Board properties known as Ida 4. Fisher Jr. High; South Beach Elementary; Feinberg Elementary (Central Beach) ; Nautilus Junior High; North Beach Elementary Teacherage ; and Biscayne Elementary; and in further consideration of the payment by the City to the School Board of the sum of $4, 700, 000. 00, said sum being the proceeds of general obligation bonds to be issued and to mature over a 20-year period,all in accordance with the agreement set forth in Resolutions Nos • 12361 and 12429 of the City Council of the City of Miami Beach, and Resolution No. 68-19 of the Dade County Board of Public Instruction on file in the office of the City Clerk, a more particular description of the lands to be conveyed by the City and the School Board being also on file in the office of the City Clerk? 3 . Shall the City Charter be amended so as to require a five-sevenths vote of the City Council to approve any variance granted by the Zoning Board of Adjustment? 4. Shall the City Charter be amended so as to provide that the retirement benefits payable under the General Employees Pension System shall be not less than 65% of final average earnings on service-connected disability, nor less than 30% of final average earnings on non- service connected disability? 5 . Shall the City Charter be amended so as to authorize the City Council to amend the General Employees Pension System Ordinance so as to provide a benefit of 2 1/2% of the member ' s average compensation for his two highest paid years for each of the first 25 years of his creditable service, and 2% of such compensation for each year of creditable service in excess of 25 years , with a maximum benefit of 80% of such compensation? -1- 6. Shall Chapter 23414, Laws of Florida, Acts of 1945, being a part of the Charter of the City of Miami Beach, Florida, be amended so as to provide to members of the City Pension Fund for Firemen and Policemen in the City of Miami Beach and/or to their beneficiaries increased pension benefits, vested pensions payable at age fifty upon completion of ten years of creditable service if accumulated contributions are not withdrawn, increased future widows ' and children's pensions payable upon service and non-service connected deaths and deaths after retirement, retroactive increased widows ' benefits payable upon non-service connected death Jf a member or death after retirement ,which deaths occur subsequent to October 1, 1967, and percentage increases in pension benefits to all pensioners and beneficiaries on the roll of the Fund in accordance with year of retirement of a member, providing all of the foregoing increased benefits to members and their beneficiaries shall be covered from funds available therefor which shall arise as a result of an increase in the valuation interest rate? 7. Shall Chapter 23414, Laws of Florida, Acts of 1945, being a part of the Charter of the City of Miami Beach, Florida, be amended so as to provide lifetime benefit increases to pensioners and retirants on the roll of the City Pension Fund for Firemen and Policemen in the City of Miami Beach, when the Consumer Price Index has been increased by increments of at least 3%, providing such lifetime increases can be covered by accumulated excess investment returns on the funds of the City Pension Fund for Firemen and Policemen in the City of Miami Beach or by an increase in the valuation interest assumption rate of the Fund? 8. Shall Chapter 23414, Laws of Florida, Acts of 1945, being a part of the Charter of the City of Miami Beach, Florida, be amended so as to permit members of the City Pension Fund for Firemen and Policemen in the City of Miami Beach to buy back creditable pension service time for all past services in any department of the City of Miami Beach, whether the same is provisional or probationary time? SECTION 2 : That for the purpose of holding and conducting the election to be so held, the City of Miami Beach is hereby divided into voting precincts or election districts with polling places therein as follows : -2- PRECINCT NO. 58: That part of the City of Miami Beach bounded on the North and West by the limits of the City of Miami Beach; bounded on the South by the center line of Indian Creek; bounded on the East by a line described as follows: beginning at the intersection of the center line of Indian Creek and the center line of Tatum Waterway run Northerly along Tatum Waterway to the Southerly extension of the center line of Hawthorne Ave. , thence run Northerly along the center line of Hawthorne Ave. to the center line of 81 Street, Miami Beach; thence run Easterly along the center line of 81 Street to the center line of Tatum Waterway; thence run Northerly to the boundary of the City of Miami Beach; the Polling Place of which shall be at the Biscayne Elementary School , situated at 800 - 77th Street. PRECINCT NO. 59: Bounded on the North by the center line of 77th Street; bounded on the South by the center line of 71st Street; bounded on the East by the Easterly boundary of the State of Florida; bounded on the !lest by the center line of Indian Creek and the center line of Tatum Waterway; the Polling Place of which shall be at the North Shore Park Teen Center, situated at the corner of Byron Avenue and 72nd Street. PRECINCT NO. 60: All that part of Miami Beach known as Normandy Isle and its surrounding waters which lie Southerly of the line described as follows: beginning at the East end of the 79th Street Causeway bridge run Easterly along the center line of Normandy Drive to the center line of Verdun; thence run Northwesterly along Verdun to the center line of Marseille Drive; thence run Easterly along Marseille Drive to the center line of Rue Notre Dame; thence run Southeasterly to the center line of Normandy Drive; thence run Easterly to Indian Creek; the Polling Place of which shall be at the Normandy Isle Municipal Pool , situated at 7030 Trouville Esplanade. PRECINCT NO. 80: Bounded on the North by the center line of LaGorce Canal from Biscayne Bay to the West line of Indian Creek and the center line of 63rd Street from the East Shore of Allison Island to the Atlantic Ocean; bounded on the South by the center line of 51st Street and its Westerly and Easterly exten- sions; bounded on the East by the East boundary of the State of Florida; bounded on the !!est by the City Limits of Miami ; the Polling Place of which shall be at the 69th Street Fire Station, situated at 6860 Indian Creek Drive. PRECINCT NO. 81 : Bounded on the North by the center line of 44th Street and its Easterly and Westerly extensions; bounded on the South by the center line of 34th Street and its Easterly and Westerly extensions; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Biscayne Waterway; the Polling Place of which shall be at the North Beach Elementary School , situated at 711 Arthur Godfrey Road. PRECINCT NO. 82: Bounded on the North by the center line of West 51st Street (City of Miami Beach) and its Easterly and Westerly extension along section lines; bounded on the South by the center line of Biscayne Waterway, from its intersection with the center line of the Westerly extension of West 34th Street; Westerly to the Eastern shore line of Biscayne Bay; thence due West to the West boundary line of the City of Miami Beach; bounded on the East by the center line of Biscayne Waterway, from its intersection with the center line of West 34th Street extended West, to its intersection with the South Shore line of Surprise Lake; thence run Easterly and Northeasterly along the South shore line of Surprise Lake to its intersection with the center line of Flamingo Waterway; thence run Northeasterly along the center line of Flamingo Waterway to its intersection with the center line of Indian Creek; thence run North along the center line of Indian Creek to its intersection with the center line of West 51st Street extended East; bounded on the West by the East boundary line of the City of Miami ; the Polling Place of which shall be at the Polo Park Recreation Building, situated. at 805 - 42nd Street. PRECINCT NO. 112: Bounded on the North by the center line of 14th Street (City of Miami Beach) from the Eastern shore line of Biscayne Bay East to the center line of Bay Road, thence North along the center line of Bay Road to the center line of 15th Street, thence East along the center line of 15th Street to the center line of Meridian Avenue; bounded on the South by the center line of 11th Street and its extension Westerly; bounded on the East by the center line of Meridian Avenue; bounded on the West by the Eastern shore line of Biscayne Bay, the Polling Place of which shall be at the Flamingo Park Teen Center, situated in Flamingo Park at 12th Street and Michigan Avenue. PRECINCT NO. 114: Bounded on the North by the center line of 11th Street; bounded on the South by the center line of 7th Street; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Euclid Avenue; the Polling Place of which shall be at the Ocean Front Auditorium, situated at 10th Street and Ocean Drive. PRECINCT NO. 115: Bounded on the North by the center line of 11th Street; bounded on the South by the center line of 6th Street and its Westerly extension from Biscayne Bay to Alton Road and the center line of 7th Street from Alton Road to Michigan Avenue; bounded on the East by the center line of Michigan Avenue from 11th Street to 7th Street and the center line of Alton Road from 7th Street to 6th Street; bounded on the West by the Easterly Shore of Biscayne Bay; the Polling Place of which shall be at the Miami Beach Employees' Benevolent Association, situated at 920 Alton Road. -4- PRECINCT NO. 116: Bounded on the North by the center line of 7th Street (Miami Beach) ; bounded on the South by the center line of 3rd Street (Miami Beach) ; bounded on the East by the center line of Meridian Avenue; bounded on the West by the Westerly right of way line of Alton Road; together with that part; bounded on the North by the center line of 6th Street and its Westerly extension; bounded on the South by the South line of Lot 32, Block III , Ocean Beach Addition No. 3, as recorded in Plat Book 2 at Page 81 of the Public Records of Dade County, Florida; bounded on the East by the Westerly right of way line of Alton Road; bounded on the West by the Easterly Shore of Biscayne Bay; together with that part; bounded on the North by a line that runs from a point 1500.00 feet south of the center line of the Venetian Causeway measured along the West Limits of the City of Miami Beach to the East Shore of Biscayne Bay at the Westerly extension of the center line of 14th Street; bounded on the South by the center line of MacArthur Causeway; bounded on the East by the West Shore of Miami Beach; bounded on the West by the West Limits of Miami Beach; the Polling Place of which shall beat the South Beach Elementary School , situated at 335 Lenox Avenue. PRECINCT NO. 148: Bounded on the North by the center line of 3rd Street (City of Miami Beach) and its Easterly production from the Eastern boundary of the State of Florida Westerly to the center line of Alton Road, thence Northwesterly along the center line of Alton Road to the intersection with the South Line of Lot 32, Block III , Ocean Beach Addition No. 3, as recorded in Plat Book 2, at page 81 of the Public Records of Dade County, Florida, produced Northeasterly, thence Southwesterly along the South line of said Lot 32 and its production to the Eastern shore line of Biscayne Bay, thence Northwesterly along the Eastern shore line of Biscayne Bay to the center line of MacArthur Causeway, thence Westerly along the center line of MacArthur Causeway to the Western boundary line of the City of Miami Beach; bounded on the South by a straight line running Southeasterly from the intersection of the center line of South East 8th Street (City of Miami) and the Western shore line of Biscayne Bay to a point in Norris Cut halfway between the most Southerly point on Fisher's Island and the most Northerly point on Virginia Key; bounded on the East by the Eastern boundary line of the State of Florida; bounded on the West by the Western boundary line of the City of Miami Beach; the Polling Place of which shall be at the South Shore Park Recreation Center Building, situated at 930 Biscayne Street. PRECINCT NO. 265: Bounded on the North by the center line of Dade Boulevard; bounded on the South by the center line of 15th Street; bounded on the East by Washington Avenue; bounded on the West by Meridian Avenue; the Polling Place of which shall be at the Ida M. Fisher Jr. High School Gymnasium, corner of 14th Place and Pennsylvania Avenue. PRECINCT NO. 273: All that part of Miami Beach known as Normandy Isle and its surrounding waters which lie Northerly of the line described as follows: beginning at the East end of the 79th Street Causeway bridge run Easterly along the center line of Normandy Drive to the center line of Verdun; thence run Northwesterly along Verdun to the center line of Marseille Drive; thence run Easterly along Marseille Drive to the center line of Rue Notre Dame; thence run Southeasterly along the center line of Rue Notre Dame to the center line of Normandy Drive; thence run Easterly along the center line of Normandy Drive to Indian Creek, the Polling Place of which shall be at the Normandy Shores Golf Course Clubhouse, situated at the West end of North Normandy Isle. PRECINCT NO. 276: Bounded on the North by the center line of 51st Street and its Easterly extension; bounded on the South by the center line of 44th Street and its Easterly and Westerly extensions; bounded on the East by the East Boundary of the State of Florida; bounded on the West by the center line of Biscayne Waterway, Lake Surprise, and Flamingo Waterway; the Polling Place of which shall be at the St. John' s on the Lake Methodist Church, situated at 4760 Pine Tree Drive. PRECINCT NO. 288: Bounded on the North by the center line of Dade Boulevard; bounded on the South by the center line of 15th Street; bounded on the East by the center line of Meridian Avenue; bounded on the West by the center line of Lenox Avenue; the Polling Place of which shall be at the Miami Beach Auditorium, situated at 1700 Washington Avenue. PRECINCT NO. 289: Bounded on the North by the center line of 15th Street and its Easterly extension; bounded on the South by the center line of 13th Street; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Meridian Avenue; the Polling Place of which shall be at the Ida M. Fisher Junior High School Gymnasium, Corner of 14th Place and Pennsylvania Avenue. PRECINCT NO. 290: Bounded on the North by the center line of 11th Street; bounded on the South by the center line of 7th Street; bounded on the East by the center line of Euclid Avenue; bounded on the West by the center line of Michigan Avenue; the Polling Place of which shall be at the new Fire Station , situated at 1051 Jefferson Avenue. PRECINCT NO. 291 Bounded on the North by the center line of 7th Street; bounded on the South by the center line of 3rd Street; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Meridian Avenue; the Polling Place of which shall be at the Ocean Front Auditorium, situated at 10th Street and Ocean Drive. -6- SECTION 3 : That the said election shall be held at the Polling Places for the respective voting precincts as above set forth and all electors shall vote at the Polling Places in the precinct in which the Registration Books in said City show that said electors reside. SECTION 4 : That said election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 :00 o'clock A.M. to 7 :00 o'clock P.M. on November 5, 1968, for the purpose of submitting the following questions : 1. SECTION 5 : That copies of the proposed amendments to the City Charter, in full, shall be made available to the electors at the office of the City Clerk not less than thirty days before the election. SECTION 6: That the City Clerk and Finance Director, who is also the Supervisor of Registration, open the books of said City from 9:00 o'clock A.M. until 5 :00 o'clock P.M. each day, Sundays and Holidays excepted, from September 5, 1968 to October 5, 1968, both inclusive, for the purpose of registering those electors who are qualified to register for this election, and after said October 5, 1968, no elector shall be registered for said election. SECTION 7 : That Notice of said Election shall be given by the City Clerk and Finance Director of said City by publishing the notice hereinafter provided for, once each week for a period of five consecutive weeks next preceding said election in the Miami Beach Daily Sun, a newspaper of general circulation published in the City of Miami Beach, Florida. SECTION 8: That Notice of such Election shall be in substantially the following form: "NOTICE OF SPECIAL ELECTION "NOTICE IS HEREBY GIVEN that by resolution duly passed and adopted by the City Council of the City of Miami Beach, Florida, a special election has been called and will be held in said City from 7:00 o'clock A.M. until 7 :00 o'clock P.M. on November 5, 1968 for the purpose of submitting the following questions : "1. Fisher Jr. High; South Beach Elementary; Feinberg Elementary (Central Beach) ; Nautilus Junior High;North Beach Elementary Teacherage; and Biscayne Elementary; and in further consideration of the payment by the City to the School Board of the sum of $4, 700, 000.00, said sum being the proceeds of general obligation bonds to be issued and to mature over a 20-year period, all in accordance with the agreement set forth in Resolutions Nos. 12361 and 12429 of the City Council of the City of Miami Beach, and Resolution No. 68-19 of the Dade County Board of Public Instruction on file in the office of the City Clerk, a more particular description of the lands to be conveyed by the City and the School Board being also on file in the office of the City Clerk? "3. Shall the City Charter be amended so as to require a five-sevenths vote of the City Council to approve any variance granted by the Zoning Board of Adjustment? "4. Shall the City Charter be amended so as to provide that the retirement benefits payable under the General Employees Pension System shall be not less than 65% of final average earnings on service-connected disability, nor less than 30% of final average earnings on non-service connected disability?
