Resolution 11858 RESOLUTION NO. 11858
WHEREAS, the City Council of the City of Miami Beach,
Florida, deems it to be necessary to increase to 130 feet the
width of that portion of Collins Avenue adjacent on the west to
Lots 1, 2, and 3, Block 2, Second Ocean Front Subdivision, accord-
ing to the amended plat thereof recorded in Plat Book 28 at page
28 of the Public Records of Dade County, Florida; and
WHEREAS in order to increase the width of Collins Avenue, as
aforesaid, it will be necessary for the City to acquire title to
a portion of said lots, as well as to acquire and fill additional
submerged lands in Indian Creek; and
WHEREAS, the owners of Lots 1, 2, and 3, Block 2, Second
Ocean Front Subdivision, have heretofore indicated their willing-
ness to execute and deliver a deed conveying a portion of said
lots to said City and have executed an Agreement which has been
prepared by the Attorney for the City for that purpose, which
sets forth the terms and conditions upon which said owners will
deliver such deed, the City Council being familiar with the con-
tents of said Agreement; and
WHEREAS, the City Council deems it to be to the best inter-
, est of the City to acquire a portion of said lots upon the terms
and in the manner set forth in said Agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA that the Mayor and the City Clerk be
and they are hereby authorized and directed to execute said
Agreement in the name of and on behalf of said City.
BE IT FURTHER RESOLVED that the City Manager be and he is
hereby authorized and directed to carry out the terms of said
Agreement for and on behalf of said City and that the disbursing
officers of the City be and they are hereby authorized and
directed to pay out such sums of money as the City is obligated
to pay out under the terms of said agreement from funds available
for such purpose.
