No. 11939 9/7/66 RESOLUTION NO. 11921 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That the following questions relating to proposed amendments to Chapter 7672, Laws of Florida, Acts of 1917, as amended, the same being the Charter of the City of Miami Beach, Florida, shall be submitted to the voters of the City of Miami Beach, Florida, for their approval or rejection, at a Spe- cial Election to be held in the City of Miami Beach, Florida, on the 8th day of November, 1966: QUESTION ONE: Shall the City Charter be amended so as to provide for a Council-City Man- ager form of government, whereby the City Manager, appointed by and serving at the will of the Council, shall be the Chief Administrative Officer of the City, with powers appropriate to the office and with power to appoint and remove all officers of the City in the Unclassified Service, except those appointed • by the Council, and whereby the Council may, by ordi- nance, abolish all offices except those filled by the people, and except the offices of City Manager, City Attorney, Municipal Judge and two Associate Municipal Judges, who shall be appointed by and serve at the will of the Council, and create, by ordinance, such new offices and Departments under the control and direction of the City Manager as the Council shall deem necessary or proper for the efficient administra- tion of the City Government, and to provide for the appointment of Department Directors by the City Man- ager, with the approval of the Council and who shall serve at the will of the City Manager, and to provide that the Council and its members shall deal with ad- ministrative affairs of the City only through the City Manager, without, however, precluding the Coun- cil from requesting or receiving information from its administrative agencies , and to provide for such other matters necessarily or properly related to a Council-City Manager form of Government? QUESTION TWO: Shall the City Charter be amended so as to provide that general obligation or revenue bonds of the City may be sold in denomina- • tions of $500.00, $1, 000.00 or any multiple thereof? QUESTION THREE: Shall the City Charter be amended so as to authorize the City to impose, levy and_collect a tax on the rent of every occupancy of a room or rooms in any hotel, motel or apartment house when the renting is for a period of six consecutive months or less ; and upon the total sales price of all items of food and alcoholic beverages sold at retail by any establishment engaged in the sale of alcoholic - 1 - beverages and/or food for consumption on the premises ; said tax to be paid by the person paying the rent or paying for the food and/or alcoholic beverage herein specified and to be collected by the person renting said rooms or selling said food or alcoholic beverage for the use and benefit of the City. Sales or rentals exempted by Chapter 212, Florida Statutes 1965, shall also be exempt from the tax hereby authorized. That the total receipts from the above tax levy shall be kept and maintained in a separate fund and shall in no event be transferred to the General Fund, and that the said fund shall be used for the promotion of the tourist industry, which shall include , but not be restricted to the following: Publicity . . . Advertising . . . News Bureau . . . Promotional Events . . . Convention Bureau Activities . . . Capital Improvements and the Mainten- ance of all Physical Assets in connection therewith; and for the payment of the reasonable and necessary expenses of collecting, handling and processing of said tax. That the Council shall have the authority and power by ordinance to determine and fix the amount of said tax levy after public hearing not in excess of 2%? QUESTION FOUR: Shall the City Charter be amended so as to provide that all secretarial and administrative employees in the City Manager's Office and in the Office of the Mayor; the Chief Assistants to each Department Head; and those posi- tions which require peculiar and exceptional qualifi- cations of a scientific, managerial, professional or educational character which positions do not fall within any existing qualification and the duties of which do not fall within the scope of the specifica- tions set up for any existing classification, where such positions are created and filled by ordinance or resolution duly enacted by the City Council, shall be in the Unclassified Service of the City? QUESTION FIVE: Shall the City Charter be amended so as to provide that on original appoint- ment, a person whose name appears on an open competi- tive eligible list and who is certified and passed over three times, may be removed from the Eligible List by the Director of Personnel with approval of the City Manager? QUESTION SIX: Shall the City Charter be amended so as to pro,ride that -.ny incumbent councilman uho desires to qualify as a candidate for -2- Mayor or Councilman at an election at which his own term does not expire must qualify as such candidate not less than ten days before the last day for quali- fication for candidates and his office shall be deemed vacant on the day of said election, and any eligible elector may qualify as a candidate for elec- tion tion for the unexpired portion of the term of the office so vacated? QUESTION SEVEN: Shall the City Charter be amended so as to delete therefrom the existing limitations as to millage of tax levies for publicity and advertising purposes? QUESTION EIGHT: Shall the City Charter be amended so as to authorize the City Council, at its discretion, to provide for the office of Public Defender, who shall be appointed by and serve at the will of the City Council, and whose duties and salary shall be prescribed by ordinance? SECTION 2 : That for the purpose of holding and conducting the election to be so held, the City of Miami Beach is hereby divided into voting precincts or election districts, with polling places therein as follows : -3- PRECINCT NO. 58: That part of the City of Miami Beach lying West of the center line of Tatum Waterway and North of the center line of Indian Creek; the Polling Place of which shall be at the Biscayne Elementary School, situated at 800 - 77th Street. PRECINCT NO . 59: Bounded on the North by the center line of 77th Street; bounded on the South by the center line of 71st Street; bounded on the East by the Easterly boundary of the State of Florida; bounded on the West by the center line of Indian Creek and the center line of Tatum Waterway; the Polling Place of which shall be at the North Shore Park Teen Center, situated at the corner of Byron Avenue and 72nd Street. PRECINCT NO. 60: That part of the City of Miami Beach known as Normandy Isle, which lies South of the center line of Normandy Drive; the Polling Place of which shall be at the Normandy Isle Municipal Pool, situated at 7030 Trouville Esplanade . PRECINCT NO. 80: Bounded on the North by the center line of LaGorce Canal from Biscayne Bay to the West line of Indian Creek and the center line of 63rd Street from the East Shore of Allison Island to the Atlantic Ocean; bounded on the South by the center line of 51st Street and its Westerly and Easterly exten- sions; bounded on the East by the East boundary of the State of Florida; bounded on the West by the City Limits of Miami; the Polling Place of which shall be at the 69th Street Fire Station, situated at 6860 Indian Creek Drive . PRECINCT NO. 81 : Bounded on the North by the center line of 44th Street and its Easterly and Westerly extensions; bounded on the South by the center line of 34th Street and its Easterly and Westerly extensions; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Biscayne Waterway; the Polling Place of which shall be at the North Beach Elementary School, situated at 711 Arthur Godfrey Road. PRECINCT NO. 82: Bounded on the North by the center line of West 51st Street (City of Miami Beach) and its Easterly and Westerly extension along section lines; bounded on the South by the center line of Biscayne Waterway, from its intersection with the center line of the Westerly extension of West 34th Street, Westerly to the Eastern shore line of Biscayne Bay; thence due West to the West boundary line of the City of Miami Beach; bounded on the East by the center line of Biscayne Waterway, from its inter- section with the center line of West 34th Street extended West, to its intersection with the South Shore line of Surprise Lake; thence run Easterly and Northeasterly along the South shore line of Surprise Lake to its intersection with the center line of Flamingo Waterway; thence run Northeasterly along the center line of Flamingo Waterway to its intersection with the center line of Indian Creek; thence run North along the center line of Indian Creek to its intersection with the center line of West 51st Street extended East; bounded on the West by the East boundary line of the City of Miami; the Polling Place of which shall be at the Polo Park Recreation Building, situated at 805 - 42nd Street. PRECINCT NO. 115 : Bounded on the North by the center line of 11th Street; bounded on the South by the center line of 6th Street and its Westerly extension from Biscayne Bay to Alton Road and the center line of 7th Street from Alton Road to Michigan Avenue; bounded on the East by the center line of Michigan Avenue from 11th Street to 7th Street and the center line of Alton Road from 7th Street to 6th Street; bounded on the West by the Easterly Shore of Biscayne Bay; the Polling Place of which shall be at the Miami Beach Employees ' Benevolent Association, situated at 920 Alton Road. PRECINCT NO. 116 : Bounded on the North by the center line of 7th Street; bounded on the South by the center line of 3rd Street; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Alton Road; together with that part, bounded on the North by the center line of 6th Street and its Westerly extension; bounded on the South by the South line of Lot 32, Block 111, Ocean Beach Addition No . 3, as recorded in Plat Book 2 at Page 81 of the Public Records of Dade County, Florida; bounded on the East by the center line of Alton Road; bounded on the West by the Easterly Shore of Biscayne Bay; together with Hibiscus, Palm and Star Islands and the surrounding waters North of the center line of MacArthur Causeway, South of the Westerly extension of 14th Street and East of the City Limit of Miami; the Polling Place of which shall be at the South Beach Elementary School, situated at 335 Lenox Avenue . PRECINCT NO. 148: Bounded on the North by the center line of 3rd Street (City of Miami Beach) and its Easterly production from the Eastern boundary of the State of Florida Westerly to the center line of Alton Road, thence Northwesterly along the center line of Alton Road to the intersection with the South Line of Lot 32, Block ill, Ocean Beach Addition No. 3, as recorded in Plat Book 2, at page 81 of the Public Records of Dade County, Florida, produced Northeasterly, thence Southwesterly along the South line of said Lot 32 and its production to the Eastern shore line of Biscayne Bay, thence Northwesterly along the Eastern shore line of Biscayne Bay to the center line of MacArthur Causeway, thence Westerly along the center line of MacArthur Cause- way to the Western boundary line of the City of Miami Beach; bounded on the South by a straight line running Southeasterly from the intersection of the center line of South East 8th Street (City of Miami ) and the Western shore line of Biscayne Bay to a point in Norris Cut halfway between the most Southerly point on Fisher's Island and the most Northerly point on Virginia Key; bounded on the East by the Eastern boundary line of the State of Florida; bounded on the West by the Western boundary line of the City of Miami Beach; the Polling Place of which shall be at the South Shore Park Recreation Center Building, situated at 930 Biscayne Street . PRECINCT NO. 273: Bounded on the North and East by the center line of Indian Creek; bounded on the South by the center line of Normandy Drive; bounded on the West by the City Limits of Miami Beach; the Polling Place of which shall be at the Normandy Shores Golf Course Clubhouse, situated at the West end of North Normandy Isle . PRECINCT NO. 274: That part of the City of Miami Beach lying East of the center line of Tatum Waterway and North of the center line of 77th Street; the Polling Place of which shall be at the Temple Ner-Tamid, situated at 7902 Carlyle Avenue . PRECINCT NO. 275: Those parts of the City of Miami Beach known as LaGorce Island and Allison Island together with that part of the City of P'iiami Beach, bounded on the North by the cneter line of 71st Street; bounded on the South by the center line of 63rd Street and its Easterly extension; bounded on the East by the Eastern boundary of the State of Florida; bounded on the West by the center line of Indian Creek; the Polling Place of which shall be at the North Shore Park Teen Center, situated at the corner of Byron Avenue and 72nd Street. PRECINCT NO. 276: Bounded on the North by the center line of 51st Street and its Easterly extension; bounded on the South by the center line of 44th Street and its Easterly and Westerly extensions; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Biscayne Waterway, Lake Surprise, and Flamingo Waterway; the Polling Place of which shall be at the Saint John's on the Lake ilethodist Church, situated at 4760 Pine Tree Drive . PRECINCT NO. 288: Bounded on the North by the center line of Dade Boulevard; bounded on the South by the center line of 15th Street; bounded on the East by the center line of Meridian Avenue; bounded on the West by the center line of Lenox Avenue; the Polling Place of which shall be at the Miami Beach Auditorium, situated at 1700 Washington Avenue . PRECINCT NO. 289: Bounded on the North by the center line of 15th Street and its Easterly extension; bounded on the South by the center line of 13th Street; bounded on the East by the East boundary of the State of Florida: bounded on the West by the center line of Meridian Avenue; the Polling Place of which shall be at the Ida M. Fisher Junior High School, situated at 11420 Drexel Avenue . PRECINCT NO. 290: Bounded on the North by the center line of 11th Street; bounded on the South by the center line of 7th Street; bounded on the East by the center line of Euclid Avenue; bounded on the West by the center line of Michigan Avenue; the Polling Place of which shall be at the Ocean Front Auditorium, situated at 10th Street and Ocean Drive . PRECINCT NO. 291 : Bounded on the North by the center line of 7th Street; bounded on the South by the center line of 3rd Street; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Meridian Avenue; the Polling Place of which shall be at the Miami Beach South Shore Library, situated at 225 Washington Avenue . SECTION 3 : That said election shall be held at the Polling Places for the respective voting precincts as above set forth, and all electors shall vote at the Polling Places in the precinct in which the Registration Books in said City show that said electors reside. SECTION 4: That said election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 :00 o ' clock A. M. to 7 :00 o ' clock P. SECTION 6: That the City Clerk, who is also the Supervisor of Registration, open the books of said City from 9 :00 o 'clock A.M. until 5 :00 o'clock P.M. each day, Saturdays, Sundays and Holidays excepted, from August 25, 1966 to September 11, 1966, both inclusive, and on each day, Sundays and Holidays excepted, from September 12 , 1966 to October 8, 1966, both inclusive, for the purpose of registering those electors who are qualified to register for this election, and after October 8, 1966, no elector shall be registered for said election. SECTION 7: That Notice of said Election shall be given by the City Clerk of said City by publishing the notice hereinafter provided for, once each week for a period of five consecutive weeks next preceding said election in the Miami Beach Daily Sun, a newspaper of general circulation published in the City of Miami Beach, Florida.
