206-95 RDA RESOLUTION NO. 206-95 A RESOLUTION OF THE MIAMI BEACH REDEVELOPMENT AGENCY SETTING A PUBLIC HEARING TO CONSIDER VACATING THE RIGHT-OF-WAY LOCATED AT 16TH STREET BETWEEN COLLINS AVENUE AND THE EROSION CONTROL LINE AND ABANDONING RELATED PUBLIC AND PRIVATE UTILITIES AND EASEMENTS, AS APPROPRIATE, WITHIN SAID RIGHT- OF-WAY FOR THE CONVENTION CENTER HOTEL DEVELOPMENT PROJECT WHEREAS, the Miami Beach Redevelopment Agency ("Agency") has negotiated with Loews Hotel Corporation for the development of a convention center hotel located at the sites of the St. Moritz hotel and the former poinciana and Sands-New Yorker hotels (collectively, the "Site"; and WHEREAS, the Site includes a 70 foot right-of-way known as 16th Street end, located between Collins Avenue and the erosion control line, in Fisher's First Subdivision of Alton Beach, as recorded in Plat Book 2, page 77 of the public records of Dade County, Florida; and WHEREAS, prior to the Agency executing an agreement to dispose of the Site it is necessary for the right-of-way to be vacated and public and private utilities and easements located therein to be abandoned, as appropriate; and WHEREAS, the Chairman and Members of the Agency wish to hold a public hearing to determine whether abandonment of public and private utility lines and easements, as appropriate, and vacation of the above referenced right -of -way would be ln the public welfare. NOW, THEREFORE, REDEVELOPMENT AGENCY: BE IT RESOLVED BY THE MIAMI BEACH Section 1, That the Chairman and Members of the Agency hereby find and determine that it is in the public interest of the City of Miami Beach to call for a public hearing to consider vacating the public right-of-way known as the 16th Street end, located between Collins Avenue and the erosion control line, in Fisher's First Subdivision of Alton Beach, as recorded in Plat Book 2, page 77, of the public records of Dade County, Florida, and abandoning related public and private utilities and easements, as appropriate, located within said right-of-way. The public July 26 hearing shall be held , 1995 atlO:lOa.m.o'clock. on Section 2. BACKGROUND The Miami Beach Redevelopment Agency ("Agency"), through the efforts of the Hotel Negotiating Committee, has successfully negotiated with Loews Hotel Corporation for the development of a convention center hotel at the sites of the St. Moritz hotel and the former Poinciana and Sands-New Yorker hotels, collectively the "Site". SVUTti VVI~ l?edevel()pment ()lstr1ct Crn-' CI:~l? l?edevel()pment ()1str1ct AGENDA ITEM 2-F June 7, 1995 Prior to the Agency's executing an agreement to dispose of the Site, it is necessary for the right-of-way to be vacated and public and private utilities and easements located therein to be abandoned, as appropriate. A public hearing was set for May 17, 1995, but was cancelled as there was no title policy on the parcel. It is now necessary to re-set the public hearing in order to consider vacating the public right-of-way. Should the vacation be approved, the City Commission may then consider authorizing the execution of a quit-claim deed of the 16th Street end in favor of the Agency. CONCLUSION Setting a public hearing and implementing this process will enable the Agency to complete the necessary steps to enter into an agreement for the development of the convention center hotel on the site.
