A RESOLUTION CALLING PUBLIC HEARING ON RECOM-
MENDATION OF THE PLANNING BOARD TO AMEND ZONING
ORDINANCE NO. 1891 SO AS TO: DEFINE THE TERMS
COMMERCIAL VESSEL, HOUSEBARGE, PLEASURE CRAFT
OR PLEASURE BOAT, AND LIVE ABOARD; CREATE NEW
ZONING DISTRICTS MD-I AND MD-II MARINE DIS-
TRICTS; PROVIDE FOR- USES PERMITTED, MINIMUM
YARDS, MAXIMUM STRUCTURE HEIGHT, AND MINIMUM
LOT WIDTHS IN SAID DISTRICTS; ESTABLISH LAND-
SCAPE CRITERIA, AND PROVIDE THAT THE BOARD OF
ADJUSTMENT MAY GRANT VARIANCES WITH RESPECT TO
SAME; REZONE A PARCEL OF LAND LYING ALONG THE
EASTERN BANK OF INDIAN CREEK WATERWAY BETWEEN
55th STREET AND 41ST STREET FROM ZONING CLASSI-
FICATION RS-4 TO MD-II; REZONE A PORTION OF
LAND ALONG THE EASTERN BANK OF INDIAN CREEK
WATERWAY AND LAKE PANCOAST BETWEEN 41ST STREET
AND 24TH STREET FROM CLASSIFICATION RS-4 TO
MD-I; AMEND THE CITY OF MIAMI BEACH ZONING DIS-
TRICT MAP ACCORDINGLY; AND PROVIDE THAT IN
CASES OF CONFLICT THE MAP SHALL GOVERN OVER
WRITTEN DESCRIPTIONS CONTAINED HEREIN.
WHEREAS, the Planning Board of the City of Miami Beach,
after a Public Hearing held on March 8, 1978, approved a proposed
amendment to the City' s Zoning Ordinance No. 1891, so as to: (1)
amend Section 3-2 by defining the terms Commercial Vessel, House=
barge, Pleasure Craft or Pleasure Boat and Live Aboard; (2) amend
Section 6 by adding new subsections thereto creating new zoning
districts to be designated MD-I and MD-II Marine Districts and
providing for uses permitted, minimum yards, maximum structure
height, minimum lot widths and establishing landscape criteria
therein; (3) rezone a parcel of land lying along the eastern •bank
of Indian Creek Waterway between 55th Street and 41st Street from
zoning classification RS-4 to MD-II; (4) rezone a portion of land
along the eastern bank of Indian Creek Waterway and Lake Pancoast
between 41st Street and 24th Street from classification RS-4 to
MD-I; (5) amend the City of Miami Beach Zoning District Map accord-
ingly; and (6) provide that in cases of conflict the Map shall
govern over written descriptions contained herein, and
WHEREAS, said action of the Planning Board has been duly
transmitted to the City Commission pursuant to Section 16 of said
Zoning Ordinance;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that a Public Hearing for the
consideration of said proposed amendment to said Zoning Ordinance
is hereby called to be held before the City Commission at its
Chambers in City Hall, Miami Beach, Florida, beginning at the hour
of 3: 00 p.m. , on June 21, 1978, and the City Clerk is hereby
authorized and directed to publish an appropriate Public Notice of
"'said Public Hearing to be published in a newspaper of general
circulation in the City of Miami Beach, at which time and place
all interested parties will be heard.
PASSED and ADOPTED this 17th day of May, 1978 .
