A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING AND DIRECTING
EXECUTION AND DELIVERY OF GRANT OF EASEMENT
TO MIAMI BEACH HOUSING AUTHORITY FOR FORTY
FOOT EASEMENT DIRECTLY NORTH OF REBECCA
TOWERS NORTH AND SUBJECT TO THE CONDITIONS
THEREIN EXPRESSED.
WHEREAS, the City Commission of the City of Miami Beach
has been requested by the Miami Beach Housing Authority to grant
to it a forty foot easement immediately north of Rebecca Towers
North for the purpose of providing twenty-seven parking spaces for
the use of the occupants, guests or personnel of Rebecca Towers
North, and
WHEREAS, the land upon which said easement is requested
forms a portion of the ,Redevelopment Plan of the Miami Beach
Redevelopment Agency, and
• WHEREAS, the Housing Authority and the Redevelopment
Agency have agreed to the grant of said easement subject to the
conditions and provisions set forth in a Grant of Easement pre-
pared by the City Attorney and approved as to form by him, and
WHEREAS, the City Commission of the City of Miami Beach
deems it to be in the best interest of the City of Miami Beach,
its citizens and residents that said easement be granted subject
to the conditions set forth in said instrument;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk be and they are hereby authorized and directed to execute
and deliver said Grant of Easement for and in the name of the City
of Miami Beach, Florida.

THIS DEED, made this 19th day of July , 1978,
'between the CITY OF MIAMI BEACH, a Florida municipal corporation,
having its principal place of business at 1700. Convention Center
Drive, Miami Beach, Florida, party of the first part, and the
MIAMI BEACH HOUSING AUTHORITY, a body corporate existing under the
laws of the State of Florida, having its principal place of busi-
ness at 156 Alton Road, Miami Beach, Florida, party of the second

. That the said party of the first part, for and in con-
sideration of the sum of Ten Dollars ($10. 00) , to it in hand paid
by the said party of the second part, the receipt where-
of is hereby acknowledged, has granted, bargained and sold to the
said party of the second part, its successors and assigs forever,
the following easement upon the land situate, lying and being in
the County of Dade and State of Florida, to-wit: .

its Redevelopment Plan at such time as the MIAMI BEACH REDEVELOP-
MENT AGENCY shall require said land as and when evidenced by an
appropriate resolution by the MIAMI BEACH REDEVELOPMENT AGENCY,

the easement hereby granted shall immediately be terminated;
provided, however, that the REDEVELOPMENT AGENCY shall provide to
the HOUSING AUTHORITY twenty-seven (27) parking spaces directly in
front of Rebecca Towers North as shown by the sketch attached
hereto and made a part hereof, authenticated by the Public Utili-
ties Director, said twenty-seven (27) parking spaces to be used by
the HOUSING AUTHORITY for parking in conjunction with the use and
occupancy of Rebecca Towers North, without cost or obligation to
the HOUSING AUTHORITY_ Provided, further, that if the REDEVELOP-
MENT AGENCY, in its need for the land upon which said easement is
to be exercised, the twenty-seven (27) parking spaces cannot be
provided to the HOUSING AUTHORITY directly in front of Rebecca
Towers North, then the REDEVELOPMENT AGENCY shall within 180 days
temporarily provide twenty-seven (27) parking spaces to the south
of Rebecca Towers North until twenty-seven (27) parking spaces can
be provided directly in front of Rebecca Towers North. If . the
REDEVELOPMENT AGENCY does not provide twenty-seven (27) parking
spaces as above set forth within the said 180 days, then the
easement herein described shall automatically be revived and.
reinstated until such time as the twenty-seven (27) parking spaces
directly in front of Rebecca Towers North are made available.
Provided, further, that the grant of this easement to the MIAMI -
BEACH HOUSING AUTHORITY shall be_ further subject to the right of
the REDEVELOPMENT AGENCY to have access across said easement to
the marine facilities lying waterside to the west of the easement
and said Rebecca Towers North.
IN WITNESS WHEREOF, the said party of the first part has
caused these presents to be signed in its name by its Mayor and its
corpb;ate seal to be affixed, attested by its City Clerk, the day
