A RESOLUTION AUTHORIZING AND DIRECTING THE
CITY ATTORNEY TO FILE EMINENT DOMAIN PROCEED-
INGS IN ORDER TO ACQUIRE CERTAIN PROPERTY
DESCRIBED AS LOT 13, BLOCK 1, AMENDED PLAT OF
SECOND OCEAN FRONT SUBDIVISION.
WHEREAS, the City Commission. of the City of Miami Beach
finds it necessary to acquire the fee simple interest in that
certain property situate within the City of Miami Beach described
as Lot 13, Block 1,, Amended Plat of Ocean Front Subdivision, as
recorded in Plat Book 28 at Page 28 of) the Public Records of Dade
County, for the purposes of constructig an ocean front park.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: The above recitals are true and correct.
SECTION 2 : The City Attorney be and he is hereby authorized
and directed to file proceedings pursuant to
Chapter 73, Florida Statutes, 'in order to acquire the fee simple
title to the above-described property for and on behalf of the
City of Miami Beach.
SECTION 3 : That the City Manager and the City Attorney be
and they are hereby authorized to retain the
services of such appraisers, surveyors or other professionals as
may be necessary in order to assist the City Attorney in connec-
tion with the proceedings undertaken pursuant to this Resolution,:.
and the City Manager be and he is hereby authorized to pay said
professionals from such funds of the .City as may be available for
such purposes.
SECTION 4 : That the City Attorney and City Manager be and
they are authorized to attempt to negotiate the
acquisition of the said property if in their opinion the property
could be acquired on advantageous terms through negotiation.
PASSED and ADOPTED this 20th day of September, 1979.
