R5Q CC Presentation Devel Review Fee 2-13-2019 Final CC meeting1 Development Review Fee Analysis & Recommendations February 13, 2019 City Commission 2 Have less dependence on major developments Not penalizing residents for minor improvements Historic Preservation Balancing staff review/preparation time and fees Address issues with antiquated Code 3 Prior to 2015 – $10,000 cap on fees October 2015 Department cost recovery goals Removed $10,000 cap April 2017 - City Commission requested reassessment and stakeholder input Planning staff began analysis, brought in Keith & Schnars in 2018 4 Fee Schedule was compared with other municipalities City staff feedback, MDPL and Chamber of Commerce Recommendations were developed Fee collection data was reviewed for 2 years worth of projects Ran tests with different variables Consideration of Department budget expectations Finance Committee - October and December City Commission January 16, 2019 – Referrals to: Planning Board, Land Use & Development Committee and Finance & Citywide Projects Committee 5 Immediate Changes Changes to make in 6 -8 months Long Term Changes 6 Remove subsidized Commissioner sponsorship of Land Use Amendments City Commission - First Reading on March 13, 2019 Establish a temporary cap on fees over $40,000 (which were charged current 0.50 per square foot) Finance & Citywide Projects Committee – February discussion 7 Apply the per -square -foot fee to all types of development equally Exceptions: Replacement railings, balconies, awnings, carports Reduce the 0.50 per -square -foot fee to 0.30 per - square -foot 8 Establish fees for Conditional Use applications which involve Neighborhood Impact Establishments $2,500 each in addition to the standard $2,500 application fee Remove the “Excessive Review Fee”, and replace with a flat “Resubmittal Fee” $1,250 to be charged after the 2nd review of an application 9 Address variances in 3 ways: Amend the Land Development Regulations to eliminate requests for the most common types of variances Implement an “Administrative Variance” for minor variances Increase the fees for standard Variances from $500 each to $750 each 10 Comprehensive revisions to the Land Development Regulations Reduce complexity and reflect the current vision of the City Increase predictability and shorten review time Review Departmental Building Permit Fees Building, Fire, Public Works, and Planning 11 Application of the per -square -foot fee to all types of development applications. Reduction in the per -square -foot fee. A fee adjustment for Conditional Use and Neighborhood Impact Establishment applications. Revisions to the resubmittal and excessive review fees. The consultant for review fees shall be tasked with reviewing departmental fees (Building, Fire, Public Works and Planning) and provide a recommendation as appropriate.
