Resolution 77-15510 RESOLUTION NO. 77-15510 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AGREEING, IN PRINCIPLE, A PROGRAM FOR THE DESIGN AND CON- STRUCTION OF WATER SUPPLY FACILITIES TO MEET REQUIREMENTS OF THE MUNICIPALITIES OF THE VILLAGE OF BAL HARBOUR AND TOWN OF BAY HARBOR ISLANDS AND AUTHORIZING THE CITY MANAGER TO EMPLOY POST, BUCKLEY, SCHUH & JERNIGAN, INC. AS CONSULTING ENGINEERS AND PLANNERS FOR SAID PROPOSED PROJECT AND THE PREPARATION OF AN APPROPRIATE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND SAID MUNIC- IPALITIES, INCLUDING A RATE ARBITRATION CLAUSE THEREIN AND ADVISING MIAMI-DADE WATER AND SEWER AUTHORITY OF THE PURPOSE AND INTENT OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH TO ACCOM- PLISH THE FOREGOING. WHEREAS, the municipalities of the Village of Bal Harbour and the Town of Bay Harbor Islands desire and require further and additional water pressures and supplies within their corporate limits to meet the present and future needs of their citizens and residents, and WHEREAS, representatives of said municipalities and of the City of Miami Beach have appeared before the Miami-Dade Water and Sewer Authority on a number of occasions for the purpose of addressing and determining the most feasible solution, from a practical and legal standpoint, of the problems involved, and WHEREAS, the said Authority has recommended that the City of Miami Beach and the Village of Bal Harbour and the Town of Bay Harbor Islands evolve and thereafter implement an appropriate plan for meeting the water requirements of the Village of Bal Harbour and the Town of Bay Harbor Islands, and WHEREAS, said Authority has requested that the City Com- mission of the City of Miami Beach formally express good faith assurances that the City of Miami Beach will design and construct such additional facilities and additions to the existing City of Miami Beach water system to meet the needs of said municipalities and to prepare an appropriate agreement, including a rate structure to be set forth therein with suitable provisions for arbitration in the event of differences of interpretation thereof, between said municipalities, with all reasonable speed and dispatch, and WHEREAS, the City Manager has presented to the City Com- mission his Memorandum No. 6642 dated December 21, 1977, the contents whereof being familiar to the City Commission of the City of Miami Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that said Commission Memorandum No. 6642 be and the same is hereby expressly incorporated herein by reference; that the City Commission of the City of Miami Beach does hereby approve, ratify and confirm the contents thereof; BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager of the City of Miami Beach be and he is hereby authorized and directed to execute and implement the purposes and content of said Commission Memoran- dum No. 6642; OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE-MIAMI BEACH,FLORIDA 33139 BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that certified copies of this Resolution be transmitted forthwith to the Miami-Dade Water and Sewer Authority, the Village of Bal Harbour and the Town of Bay Harbor Islands; BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager be and he is hereby authorized and directed to submit, with all convenient speed, to the City Commission of the City of Miami Beach appro- priate summaries of progress in the implementation hereof; it being the desire, purpose and intention of the City Commission of the City of Miami Beach that interim and final approval of plans, specifications and contract documents be procured from said City Commission in compliance with all requirements of law. Southern City Manager SUBJECT:' INCREASED WATER SUPPLY FOR BAL HARBOUR AND BAY HARBOR ISLANDS The City of Miami Beach has for many years supplied water to the Village of Bal Harbour through a master water meter located at 87th Street, and through their jointly owned water transmission system, Bal Harbour has supplied water to the Town of Bay Harbor Islands. In addition, these municipalities have been purchasing water from the City of North Miami Beach. This arrangement has not been satisfactory to Bay Harbor Islands and Bal Harbour for various reasons which, in recent years, have resulted in low water pressures within their water distribution systems, and for the Town of Bay Harbor Islands, an inability to meet the recently adopted Metropolitan Dade County fire flow requirements. Also, within the last year the City of North Miami Beach has notified the two municipalities of intent to discontinue selling water to them. Based upon several meetings with engineers and representatives from Bal Harbour and Bay Harbor Islands, together with internal engineering reviews, it has been determined that: 1) Miami Beach has ample water supply to meet the need; 2) a water distribution system can be designed and constructed to provide the water volumes and pressures required and/or desired; and 3) with minimum modifications and construction within the City of Miami Beach, a new 20-inch water main can be installed in 86th Street from Collins Avenue to Byron Avenue interconnecting all existing water mains in the North end of the City. The new 20-inch main within the City limits, together with engineering costs and the installation of two master meters at 86th and Byron Avenue, can be accomplished in a relatively short time period at an estimated cost of $74,000. Funding for this work can be immediately arranged in the City Capital Improvements Budget, and surveying and engineering design can commence immediately with completion in approximately 30 days. AGENDA ITEM R "7 - 3 —1— DATE l-e - COMMISSION MEMORANDUM NO. 6642 The City of Miami Beach has always provided water service through master meters at 87th Street, and can provide proper water supply and pressure at that point of service within 45 days, or less, from commencement of construction. The work can be accomplished with City personnel; therefore, there will not be any delay due to the preparation of bid specifications, bidding, bid award, execution of contract documents, etc. Further, so that there is no question concerning Miami Beach' s ability and willingness to fully supply the total water require- ments, such an affirmative, positive position should be set forth by City Commission resolution. In addition to improvement of the Miami Beach water distribution along the northern city limits, it will be necessary: 1) to jointly consider with Bal Harbour and Bay Harbor Islands the best method of financing and construction the required addi- tional_ water system improvements within those communities; 2) to provide mutual assistance, including joint legal actions if necessary, to expedite obtaining any easements required and to expedite construction; 3) to offer and negotiate mutual emergency repair assistance, or to provide full maintenance service by agreement should it be determined that Bal Harbour and Bay Harbor Islands will continue to own and operate the major water distribution systems, including storage and pumping facilities, within their communities as in the past; and 4) to negotiate an extended term major water user agreement that would contain provisions regarding utility cost accounting, a standard water rate costing formula and other standard and accepted pro- visions currently being used between the Dade Water and Sewer Authority and that Authority' s more recent water customers. To proceed further, the City Commission must be willing to accept and endorse the basic concepts embodied here, doing so by adoption of the positions by resolutions for forwarding to Bal Harbour, Bay Harbor Islands and the Metropolitan Dade County Water and Sewer Authority.
