A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, URGING THE FLORIDA
LEGISLATURE TO ENACT LEGISLATION THAT WOULD PROHIBIT
DISCRIMINATION ON THE BASIS OF SEXUAL ORIENTATION AND
GENDER IDENTITY IN HOUSING, EMPLOYMENT, AND PUBLIC
ACCOMMODATIONS; AND, DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF THIS RESOLUTION TO THE ENTITIES
AND OFFICIALS SET FORTH HEREIN.
WHEREAS, the City of Miami Beach is a diverse and inclusive community and has a
long history of opposing discrimination on the basis of, among other things, sexual orientation
and gender identity; and
WHEREAS, currently the State of Florida does not offer protections in housing,
employment, and public accommodations to lesbian, gay, bisexual, and transgender Floridians;
and
WHEREAS, because Florida law currently fails to prohibit discrimination statewide on
the basis on sexual orientation and gender identity, the lesbian, gay, bisexual, and transgender
Floridians who reside in municipalities and counties with no local protections are vulnerable to,
and without recourse against, such invidious discrimination; and
WHEREAS, nearly sixty percent (60%) of Floridians currently live in counties and
municipalities that have passed measures prohibiting discrimination based on sexual orientation
and gender identity; and
WHEREAS, in addition to ensuring basic fairness and equal treatment for all Floridians,
legislation prohibiting discrimination on the basis of sexual orientation and gender identity is
increasingly regarded as essential to attracting the best applicants to Florida's workforce; and
WHEREAS, in its 2018 Corporate Equality Index, the Human Rights Campaign
Foundation reported that ninety-one percent (91%) of Fortune 500-ranked businesses include
sexual orientation in their nondiscrimination policies and eighty-three percent (83%) include
gender identity in such policies, reflecting a link between strong anti-discrimination laws and the
ability to draw the best and the brightest talent; and
WHEREAS, to ensure that all Floridians are protected against discrimination on the
basis of sexual orientation and gender identity, and to ensure that Florida remains competitive in
attracting the best and brightest workers and businesses to the State, it is imperative that the
Legislature take action in the upcoming session to enact legislation that would prohibit
discrimination in Florida on the basis of sexual orientation and gender identity in housing,
employment, and public accommodations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge the Florida Legislature to adopt legislation that would prohibit
discrimination on the basis of sexual orientation and gender identity in housing, employment,
public accommodations; and, directing the City Clerk to transmit a copy of this Resolution to the
Miami-Dade County Legislative Delegation, Governor Ron DeSantis, the Florida Senate
President, and the Florida House Speaker.
