A RESOLUTION DETERMINING THE NEED FOR URBAN PARKS
AND RECREATION RECOVERY FUNDS FOR USE IN CONJUNCTION
WITH THE RECREATION AND OPEN SPACE PLAN OF THE CITY
OF MIAMI BEACH, AUTHORIZING AND DIRECTING THE CITY
MANAGER TO ENTER INTO AND EXECUTE GRANT APPLICATIONS
AND INTERGOVERNMENTAL GRANTS, PLANNING, AND DEVELOP-
MENT AGREEMENTS WITH COUNTY, STATE AND FEDERAL
GOVERNMENTS; TO PROCESS SAME WITH THE UNITED STATES
DEPARTMENT OF INTERIOR HERITAGE CONSERVATION AND
RECREATION SERVICE; EMPOWERING THE CITY MANAGER TO
ENTER INTO, EXECUTE AND SUBMIT SUCH GRANT APPLICA-
TIONS, INTERGOVERNMENTAL GRANTS, PLANNING AND DEVEL-
OPMENT AGREEMENTS, SUPPLEMENTS, AMENDMENTS AND
SUPPORTING DATA TO THE APPROPRIATE GOVERNMENTAL
AGENCIES; AND CERTIFYING THAT THE CITY WILL COMPLY
WITH ALL ASSURANCES AS REQUIRED BY THE UNITED STATES
DEPARTMENT OF THE INTERIOR„
WHEREAS, the City of Miami Beach has adopted a Recreation
and Open Space Plan which encourages intergovernmental cooperation
in the development of grant applications, planning, and development
agreements; and
WHEREAS, the City, County, State, and Federal governments
have in the past successfully planned and developed public amenities
that have accrued to the general benefit to the citizens of Miami
Beach; and
WHEREAS, the U.S . Department of Interior' s Heritage Con-
servation and Recreation Service has instituted and conducts a con-
tinuing grant program known and referred to as the Urban Park and
Recreation Recovery Program, hereinafter referred to as (UPARR) ,
whereby funds are made available to local governments for purposes
of rehabilitation of critically needed recreation areas , the physical
rehabilitation and revitalization of parks and recreation systems ,
and development of improved recreation programs; and
WHEREAS, the U.S. Department of Interior' s Heritage Con-
servation and Recreation Service has designated Miami Beach, Florida,
as one of the cities eligible for the Urban Parks and Recreation
Recovery Program and thus eligible to receive UPARR funds; and
WHEREAS, the City Commission finds that receipt of and use
of said UPARR funds will increase the City' s eligibility and com-
petative status of the City to receive Federal Funds pursuant to the
UPARR Program; and
WHEREAS, Dade County and the City of Miami Beach have
applied to the U.S . Department of Interior' s Heritage Conservation
and Recreation Service for Recovery Action Program planning funds
under the Urban Park and Recreation Recovery Program; and
WHEREAS, Dade County and the City of Miami Beach have
received notice of approval by the Heritage Conservation and
Recreation Service for the development of a Comprehensive Urban
Action Plan; and
WHEREAS, Dade County and the City of Miami Beach are
cooperating in the development of said plan; and

WHEREAS, a Grant Agreement has been signed by the
Heritage Conservation and Recreation Service and Dade County,
which now enables the City of Miami Beach to begin development
of the Urban Plan Component for its jurisdiction; and
WHEREAS, the City of Miami Beach is eligible to enter
into intergovernmental agreements to apply for UPARR funds;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: All of the facts set forth in the preamble are hereby
found and determined to be true and incorporated herein.
SECTION 2 : It is hereby found that the public health, safety, morals
and welfare of the residents of the City of Miami Beach
will be best served by the development of a Comprehensive Urban
Action Plan which will be supportive and consistent with the Recrea-
tion and Open Space Plan.
SECTION 3 : It is hereby found and determined that in order to
develop the Comprehensive Urban Action Plan that the
use of Federal UPARR funds are appropriate and in the best interest
of the general public.
SECTION 4 : It is hereby found and determined that in order to
implement the recommendations and projects as defined
in the City' s Recreation and Open Space Plan that from time to
time it would be in the best advantage of the City to enter into
and execute grant applications and intergovernmental agreements ,
planning, and development grants.
SECTION 5 (a) In order to implement, facilitate and effect the
processing and obtaining of said UPARR funds , it is
found and determined that certain official action must be taken
by this Commission by way of authorization and direction to the
City Manager, and certification by the Commission that it will com-
ply with requisite assurances and declaration of mechanics for use
and administration of said funds.
(b) Accordingly, this Commission resolves that the City
Manager is hereby authorized and directed to prepare
and execute Federal Assistance Grant Applications and intergovern-
mental agreements and to oversee and supervise the filing, submis-
sion and processing of said applications and agreements. The City
Manager is further empowered to approve, execute and supervise the
processing of all supplements, amendments and supporting data to
said applications and agreements which he may determine shall be
required from time to time from the date of filing thereof until
the time of completion of said applications and agreements and in
performing such responsibilities, said City Manager shall be empowered
to consult with the City Attorney, and any and all other governmental
agencies, federal, state, county, municipal and private counsel
and consultants, as he deems proper and necessary, all in order to
carry forward the Commission' s finding and expression of intent that
the application and agreements be processed as rapidly, effectively,
and expeditiously as is possible in order that the funds applied for
may be obtained and utilized for the proposed purposes hereof.
