HomeMy WebLinkAbout2003-25245 Reso RESOLUTION NO. 2003-25245 A RESOLUTION OF THE MAYOR AND COMMISSION OF THE CiTY OF MIAMI BEACH, FLORIDA, APPROPRIATING $100,000 FROM THE CAPITAL RESERVE FUND FOR DESIGN AND CONSTRUCTION OF EMERGENCY REPAIRS TO TWO HISTORIC STRUCTURES IN ALTOS DEL MAR PARK THAT ARE CURRENTLY LEASED FROM THE STATE OF FLORIDA; AND STIPULATING THAT ENGINEERING FEES TO EVALUATE THE TWO HISTORIC STRUCTURES SHALL NOT EXCEED TEN PERCENT OF THE $100,000; AND SAID FUNDS TO BE REPAID FROM GENERAL OBLIGATION BOND FUNDS AT SUCH TIME AS THE LAND TITLE IS TRANSFERRED TO THE CITY OF MIAMI BEACH. WHEREAS, the land designated for development of the future "Altos Del Mar Park" is presently leased by the City of Miami Beach from the State of Florida; and WHEREAS, the City has allocated $2.9 million in GO Bond funds to develop Altos Del Mar Park; however, the City cannot legally spend the Bond funds on leased property; and WHEREAS, within the boundaries of the park are two residential structures that are historically and architecturally significant and plans for development of the park include restoration of the exterior of these buildings to their original exterior appearance, and adaptive reuse of the interior of the structures for park-related purposes; and WHEREAS, the condition of these historically significant structures has deteriorated due to a long period of abandonment; and WHEREAS, the Building and Planning Departments have strongly recommended the sealing of the buildings and the taking of corrective remedial action now, as opposed to later; and WHEREAS, the cost of engineering fees for the initial phase of evaluating the two historic buildings is not expected to exceed ten percent (10%) of the total cost of design and construction of the emergency repairs; and WHEREAS, funds for the emergency repairs are available from the Capital Reserve Fund, to be reimbursed from the $2.9 million allocated from GO Bond funds to develop Altos Del Mar Park at such time as the land title is transferred to the City of Miami Beach from the State of Florida. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby appropriate $100,000 from the capital reserve fund for design and construction of emergency repairs to two historic structures in Altos Del Mar Park that are currently leased from the State of Florida, and stipulating that the engineering fees to evaluate the two historic structures shall not exceed ten percent of the $100,000, with such funds to be repaid from general obligation bond funds at such time as the land title is transferred to the City of Miami Beach. Issue: Should the City Commission appropriate $100,000 from the Capital Reserve Fund for emergency repairs to two historic buildings in Altos Del Mar Park, to be reimbursed from GO Bonds at such time as the land title is transferred from the State of Florida? Item Summary/Recommendation: The land reserved for the future Altos Del Mar Park is currently leased by the City of Miami Beach from the State of Florida. Under the terms of the lease, the City is responsible for maintenance and repairs to the property. The two vacant historic homes located within the site have fallen into a state of critical disrepair and require emergency repairs to stabilize them until long term use and restoration plans can be completed. Although a total of $2.9 million in GO Bonds have been earmarked for this park, including historic restoration of the buildings, the City is prohibited from using these funds until title to the land is transferred from the State. As an interim measure, the Administration recommends appropriating $100,000 from the Capital Reserve Fund, to be repaid later from the GO Bond funds. On July 26, 2000 the Commission approved an agreement with Falcon & Bueno, pursuant to RFQ No. 41-99/00, to provide planning, design, and engineering, construction administration for the park. The Administration proposes to authorize the consultant to proceed with the task in the Scope of Services that includes a structural evaluation and recommendations for repair of the buildings. Construction of the emergency repairs will be accomplished through Job Order Contracting. FUNDING Funds for the emergency repairs are available from the Capital Reserve Fund, to be reimbursed from the $2.9 million allocated from GO Bond funds to develop Altos Del Mar Park. ANALYSIS The land designated for development of the future "Altos Del Mar Park" is presently leased by the City of Miami Beach from the State of Florida as a part of a lease that originally included North Shore Open Space Park, the "west lots" and 22 lots in the Altos Del Mar subdivision that were purchased with the intent of expanding the North Shore Open Space Park. The City has allocated $2.9 million in GO Bond funds to develop Altos Del Mar Park. The City cannot legally spend the Bond funds on leased property, and has been waiting for three years for the State to complete the sale of 11 scattered lots and the transfer of the title for the Altos Del Mar Park property to the City. The sale of the 11 lots has been completed, but the transfer of title for the park land has been delayed temporarily because State law has failed to keep pace with the changing Cabinet, which was reduced from six members to three through a constitutional amendment, and still requires five positive votes from the Governor and Cabinet to approve actions involving the disposition of State lands. July 2, 2003 Commission Memorandum Resolution - Emergency Repairs To Two Historic Structures In Altos Del Mar Park Page 2 of 3 The legislation to correct this contradiction was processed during this legislative session, and the Governor and Cabinet aro scheduled to approve the land transfer in August, 2003. The design and use of the proposed Altos Del Mar Park has not yet been determined. A team of consultants has been selected through an RFQ process and the City Commission has approved the negotiated agreement for planning and design services. The team is headed by Falcon & Bueno, landscape architects, and also includes Alan Shulman, architect, and Brill and Rodriguez, engineers. The contract is on hold, pending receipt of the property deed from the State. The Altos Del Mar Park project includes conceptual planning, design and development of a new park on a 2-acre undeveloped tract of oceanfront land located east of Collins Avenue between 76th and 77th Streets. The park site lies within the Harding Townsite/South Altos Del Mar local historic district, and is adjacent to the Altos Del Mar single family local historic district. The park is intended to be developed primarily as passive open space; however, active recreational uses may be considered if they are compatible with the historic character of the neighborhood and supported by neighborhood residents. Within the boundaries of the park are two residential structures that are historically and architecturally significant. The design services required for this park include restoration of the exterior of these buildings to their original exterior appearance, and adaptive rouse of the interior of the structures. Potential uses for the buildings include a historical interpretive center, restaurant/cafb, or headquarters for the North Beach district lifeguards. Recently, members of the Planning and Building Departments visited these two (2) existing historic structures to determine the conditions of the structures. Following are the initial findings based upon an inspection of the exterior of the structures. · The roof, eaves and overhang are badly deteriorated and need to be replaced as soon as possible. · The building is in need of better sealing, such as masonry at the first level. · No external structural problems were visible, with the exception of the one-story appendage on the west side of the building closest to Ocean Terrace. · The concrete strength of the structure is likely weak (estimated to be around 1400 psi). · Chloride is likely to be found within the concrete walls. The Building and Planning Departments have strongly recommended the sealing of the buildings and the taking of corrective remedial action now, as opposed to later. Specifically, the following is recommended: 1 The City's Consultant shall conduct a detailed structural evaluation of the existing historic buildings on the Project site, and submit a report, certified by a structural engineer, licensed in the State of Florida. The report shall contain the following: July 2, 2003 Commission Memorandum Resolution - Emergency Repairs To Two Historic Structures In Altos Del Mar Park Page 3 of 3 · An evaluation of the overall structural condition of each building, inclusive of, but not limited to foundations, exterior walls, columns, floors, load bearing interior partitions, and roof structure. · Recommendations for all corrective structural measures, including an opinion of methods and procedures required to stabilize and restore the structure of each building for compliance with all applicable codes and regulations for occupancy of the buildings by public park-related uses. · Color photographs of all elevations and for all conditions requiring structural remediation. · Cost estimates for structural, and flood protection work required to bring each building into compliance with applicable codes and regulations. 2. The Consultant shall prepare an evaluation of the feasibility and cost of complete historic restoration for adaptive reuse of the two historic homes for park-related purposes, such as, but not limited to historical interpretive center, restaurant/caf~ and life guard headquarters. 3. Based on #1 and #2 above, the City will make a determination as to whether the condition of the buildings and the cost of repairs and historic restoration warrant proceeding. If authorized by the City, the Consultant will proceed to prepare construction drawings for any repairs deemed necessary to stabilize and protect the buildings from further deterioration until such time as overall plans are completed for improvements to the park. Such repairs may include, as needed, a new roof, windows and any structural repair work required for the walls, foundation, second level floor plate and beams. 4. Finally, the Consultant will provide construction administration services for implementation of the repair plans. Once the shells of the structures have been stabilized, the buildings can sit idle until they are programmed. Once they are programmed, the interior finish work can commence (plumbing, electrical, mechanical, etc.). As Hurricane Season has begun, this evaluation and repair work taking place as soon as possible is all the more critical. CONCLUSION: The Administration recommends that the Mayor and City Commission adopt the attached Resolution.
