Amendment No. 3 to the Agreement with the School Board of Miami-Dade County (2) AMENDMENT NO. 3 TO AGREEMENT AMONG THE SCHOOL BOARD OF MIAMI-DADE COUNTY, MIAMI, FLORIDA And THE CITY OF MIAMI BEACH, FLORIDA And THE FLORIDA INTERNATIONAL UNIVERSITY BOARD OF TRUSTEES, MIAMI, FLORIDA This Amendment No. 3 (the "Amendment")to the Agreement, dated March 19, 2015, as amended by Amendment No. 1, dated May 26, 2016, and Amendment No. 2, dated October 25, 2017, (collectively, the "Agreement"), by and among the City of Miami Beach, Florida, a municipal corporation organized and existing under the laws of the State of Florida, having its principal place of business at 1700 Convention Center Drive, Miami Beach, Florida 33139 ("CMB"), The School Board Of Miami-Dade County, a body corporate and political subdivision of the State of Florida, having its principal place of business at 1450 N.E. 2nd Avenue Miami, Florida ("M-DCPS"), and The Florida International University Board of Trustees, a member of the State University System of Florida, having its principal place of business at 11200 S.W. 8th Street, Miami, Florida 33199 ("FIU") (CMB, M-DCPS and FIU may be individually referred to as a party or collectively as parties), is entered into this a') day of ` , 2018 (Effective Date): RECITALS WHEREAS, FIU and M-DCPS entered into an inter-institutional agreement in summer 2018 (the "M-DCPS-FIU Agreement") to promote educational opportunities through the dual enrollment program in Miami-Dade County, a copy of which is attached as Exhibit A and incorporated into this Agreement by reference; WHEREAS, in accordance with the M-DCPS-FIU Agreement, CMB seeks to deploy its resources with M-DCPS and FIU in order to increase the competitiveness of the students of Miami Beach Senior High School by nurturing and supporting the dual enrollment programs taught at Miami Beach Senior High School (the "High School"), Nautilus Middle School (the"Middle School") and the Fienberg Fisher K-8 Center(the""K-8 Center") ; and WHEREAS, the parties desire to again amend the Agreement to expand the program, as FIU resources permit, by providing dual enrollment classes at the Middle School in order to provide 8th graders who attend the Middle School and the K-8 Center with the opportunity to take dual enrollment courses at the Middle School, and establish guidelines for CMB to financially support the dual enrollment courses taught at the High School and Middle School. NOW THEREFORE, in consideration of the mutual promises and conditions contained herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, CMB, M-DCPS and FIU hereby agree to amend the Agreement as follows: 1. ABOVE RECITALS. The above recitals are true and correct and are incorporated as part of this Amendment. 1 2. MODIFICATIONS. The Agreement is hereby amended (deleted items struck through and inserted items underlined)as follows: (a) Subsection 1.02 is hereby deleted in its entirety and replaced with the following: 1.02 Adlunct"Instructor: The appointment and credentialing of instructional staff at the High School and Middle School, which may include FIU Professors or courtesy appointment lecturers such as High School Teachers or Middle School Teachers, as applicable, CMB Residents or CMB Employees, as described in subsection 2.03(C), except that, FIU shall provide opportunities to applicants for Adjunct Instructor positions, as follows: first, the High School Teachers or Middle School Teachers, as applicable; second, FIU Professors; third, CMB Residents; and fourth CMB Employees. (b) A new subsection 1.06 is hereby added to the Agreement as follows: 1.06 Fienberq Fisher K-8 Center (the "K-8 Center"). A public school which matriculates students from kindergarten through 8th grade, located at 1420 Washington Avenue, Miami Beach, Florida, 33139. (c) Subsection 1.06 is hereby renumbered as subsection 1.07. (d) Subsection 1.07 is hereby renumbered as subsection 1.08 and deleted in its entirety and replaced with the following: 1.08 High School Teacher(s) and Middle School Teacher(s). A Miami-Dade classroom teacher, as defined in Section 1012.01(2)(a), Florida Statutes, as may be amended, who is employed on a full-time basis at Miami Beach Senior High School or Nautilus Middle School. (e) A new subsection 1.09 is hereby added to the Agreement as follows: 1.09 Nautilus Middle School (the "Middle School"). A middle school located at 4301 North Michigan Avenue, Miami Beach, Florida 33140. (f) The first full paragraph of Section 2.01 of the Agreement is hereby deleted in its entirety and replaced with the following: 2.01 Term of Agreement. The term of this Agreement shall be effective as of the last date signed by all parties through the 30th of June, 2019, unless the Agreement is terminated earlier pursuant to Section 3.02 below or the M-DCPS- FIU Agreement is terminated. This Agreement may be renewed for additional periods of time upon the mutual written consent of the parties and subject to such terms and conditions as the parties shall determine in writing. 2 (g) Subsection 2.03 is hereby deleted in their entirety and replaced with the following: 2.03 FIU courses offered on the High School and the Middle School Campuses. CMB will provide financial support, as set forth below, for eligible students to engage in a rigorous curriculum at the Middle School and High School that offers FIU college credit and also counts toward a high school diploma. Registration at the Middle School and K-8 Center, and for 9th, 10th,11th, and 12th grade students at the High School will be facilitated via FIU's off-campus program. M-DCPS agrees to permit High School and Middle School students enrolled at such schools (or who otherwise qualify pursuant to Section 1007.271, Florida Statutes)who have been certified by their principals as qualified, to dually enroll in regularly offered FIU courses at the High School or Middle School. In general, the majority of the dual enrollment courses are available to Juniors and Senior's with the exception of those courses identified in Appendix D of the MDCPS-FIU Agreement. Only courses providing a minimum and maximum of three (3) credits per course will be funded by CMB. Additionally, no courses that require a pre-requisite class will be funded by the City, only general dual enrollment classes with no pre-requisite class may be funded by the City. All dual enrollment courses funded by the City must be accessible to all eligible students with no pre-requisite college course requirement. M-DCPS agrees to permit eligible 8th grade students attending the K-8 Center to attend dual enrollment courses at the Middle School. A. Marketing. FIU, M-DCPS and the CMB will work collaboratively to market the programs, provide professional development opportunities for credentialed CMB teachers, transition students, and assess overall results. B. Payment. The funds for the dual enrollment classes will be allocated as follows: 1. M-DCPS shall pay FIU $1,500 for academic monitoring and oversight by an FIU monitor Lthe Oversight fee) per unique dual enrollment course taught by a High School Teacher or Middle School Teacher who serves as a courtesy appointment lecturer for FIU. At the request of CMB and as agreed upon by FIU, credentialed CMB Employees or CMB Residents shall receive monitoring and oversight during the first semester of instruction at the High School or Middle School. The Oversight fee is waived when an FIU faculty or adjunct instructor teaches the course, and during the first semester of instruction, when a CMB Employee or Resident teaches the course. FIU's APA will invoice the District for these Oversight fees two (2) weeks after the registration period has ended. 2. If an FIU faculty/adiunct instructor is hired to teach a class on the High School or Middle School campus, M-DCPS shall pay FIU a fee of$ 5,000 for the provision of educational services. 3. CMB shall reimburse M-DCPS for the Benefits and FIU faculty/adjunct instructor salary described in the preceding subsection 2.03(6)(2). With respect to any courtesy appointment lecturer who is a High 3 School Teacher or Middle School Teacher, CMB shall not be responsible for reimbursing M-DCPS for the Benefits or the courtesy appointment lecturer's salary, but shall be responsible for reimbursing M-DCPS for the Oversight Fee described in section 2.03(B)(1), per unique dual enrollment course taught at the High School or Middle School. The total amount for reimbursements paid by CMB under this Agreement ("CMB Contributions") shall be paid within thirty (30) days from receipt of a detailed invoice from M-DCPS, setting forth the breakdown of the charges and the number of registered students for each course. CMB Contributions shall not exceed $62,000 in a given fiscal year (from October 1 or a given year to September 30 of a subsequent year) and shall be subject to budget appropriation and funding approval by the City Commission for each fiscal year. 4. In terms of future annual dual enrollment agreements, academic monitoring and oversight fees, FIU faculty/adjunct cost, and/or the introduction of other fees, will be re-evaluated annually in spring terms within the context of FIU's availability of resources. Furthermore, depending on the availability of such resources, any proposed change in the fee structure will be communicated in advance, and in writing, to M-DCPS prior to the renewal of dual enrollment agreement(s). 5. M-DCPS shall pay all student instructional material costs, with a cost • anticipated by M-DCPS of $36,000 (in Fall and Spring of each school year based upon 300 enrolled students in twelve (12) or more dual enrollment classes). C. Teacher Credentialing for High School Teachers, Middle School Teachers, CMB Residents or CMB employees. In order to increase the pool of qualified teachers, qualified High School Teachers, or Middle School Teachers, as applicable, CMB Residents and CMB Employees may become credentialed as Adjunct Instructors by their respective academic departments at FIU in accordance with the provisions of the M-DCPS-FIU Agreement. As provided in the Agreement, the credentialinq of Adjunct Instructors is at FIU's sole discretion. The principal of the High School or Middle School shall be responsible for proposing prospective teachers for the credentialing process. D. Policies and Procedures at the High School and Middle School. Prior to commencing any class at the High School or Middle School, an Adjunct Instructor shall meet with the principal of the High School or Middle School to discuss and acknowledge any site specific policies and procedures of the High School or Middle School, including, without limitation, the Miami-Dade County public school attendance policies and procedures, with which the Adjunct Instructor shall comply. E. Course Selection and Scheduling. The High School or Middle School principal shall select the dual enrollment courses to be taught at the High School or Middle School, as applicable, provided that the courses are 4 • selected from the dual enrollment courses identified in the M-DCPS-FIU Agreement (the list of courses is subject to change). The dual enrollment courses offered at the High School shall be accessible to all university/college eligible students and may not be restricted to students enrolled in a specific high school academy or program and must be offered courses accessible to the entire student population based on university eligibility. The FIU faculty/adjunct instructor will strictly adhere to the 2018- 2019 Miami-Dade County Public Schools calendar and schedule, a copy of which is attached hereto as Exhibit B. The FIU faculty/adjunct instructor shall provide instruction per the established class schedule as determined by the High School or Middle School for the Fall semester, from August 20, 2018 through January 17, 2019, and for the Spring semester, from January 22, 2019 through June 6, 2019. - 3. RATIFICATION. Except as amended herein, all other terms and conditions of the Agreement shall remain unchanged and in full,force and effect. In the event there is a conflict between the provisions of this Amendment and the Agreement, the provisions of this Amendment shall govern. The Parties agree that the foregoing recitals are true and correct and that such recitals are incorporated herein by reference. ARTICLE 2 -SPECIAL CONDITION 2.01 Term of Agreement. The term of this Agreement shall be effective as of its signing through June 30,2020,unless the Agreement is terminated earlier pursuant to Section 4.04 of this Agreement. The Agreement may be renewed for additional two-year periods of time upon the mutual written consent of the Parties and subject to such terms and conditions as the Parties shall determine in writing based on an evaluation of the results of the dual enrollment agreement undergoing possible renewal. Such extension would require either a new agreement or an amendment of the Agreement to incorporate eligibility criteria and requirements. A new agreement or an amendment would require the approval of authorities of M-DCPS and FIU. 2.02 Joint Responsibilities. M-DCPS and FIU shall maintain responsibility for implementing the various components of this Agreement as delineated in Articles 3,4,and 5 of this'Agreement. 2.03 Indemnification.To the extent permitted by law,each Party agrees to be fully responsible for its acts of negligence or its agent's acts of negligence when acting within the course and scope of their employment. Each Party agrees to be liable for any damages resulting from said negligence. 3 s r i • ARTICLE 3 -DUAL ENROLLMENT } 3.01 Recruitment Procedures. A. Overview. The dual enrollment program is an opportunity to take challenging college courses and pursue accelerated educational opportunities.Dual enrollment courses at the • 1000-2000 instruction level are recommended to advance student success. Dual enrollment courses become a part of a student's permanent college transcript.M-DCPS is committed to promoting and explaining eligibility criteria for participation in accelerated academic learning opportunities to students and parents;thus,M-DCPS will explain the process by which students and parents can exercise their option to participate. The District's curriculum bulletin and parent informational sessions should provide students and families with documents to describe the educational benefits and eligibility requirements of the various acceleration program options,as well as a copy of the Dual Enrollment Transfer Guarantees(s. 1007.271, • F.S.). (Refer to Appendix A.) As part of the commitment—and process to inform students • and parents of the opportunity to participate in the dual enrollment program,each high school curriculum guide will describe the acceleration options. FIU requires that M-DCPS provide, in writing,to students and parents the eligibility requirements and,furthermore,indicate the expectations in terms of participation in dual enrollment and rigorous college-level coursework.An orientation should be held by M-DCPS at least once a year at high schools and other District school venues to discuss eligibility requirements and expectations with parents and students.FIU Dual Enrollment staff could attend,as invited.Parent-teacher conferences also provide an opportunity to update parents on progress of students regarding dual enrollment coursework. B. M-DCPS will share with students and parents the Transfer Guarantee statement,prior to ;. enrollment in a dual enrollment course,regarding the potential for the dual enrollment course(s)to articulate as an elective or a General Education course into a degree program. The statement may include additional information regarding dual enrollment options, guarantees,privileges,and responsibilities. In the case of minors,M-DCPS will obtain the written consent of parents via an FIU consent form to ensure that parents approve students' enrollment in specific dual enrollment courses. M-DCPS will send the written consent to FIU. C. In a cooperative effort,admissions and registration personnel from FIU will be available to local area high schools and other schools,as requested by M-DCPS,to provide additional information and answer specific student questions about FIU and FIU's Admissions requirements and deadlines. • 4 • D. Students of FIU's on-and off-campus dual enrollment and online dual enrollment must be informed of FlU's Academic Grievance process. Refer to Section 3.07, "Academic Grievance(s)." 3.02 Pre-Registration Advising` • A. Requirements. The guidance departments at appropriate M-DCPS schools have the • responsibility of advising students as to FIU dual enrollment course offerings and for f` providing information on eligibility requirements. M-DCPS guidance departments will provide students the recommendation forms for admissions,and will indicate the specific courses in which eligible students can be enrolled. The Dual Enrollment staff at FIU will provide appropriate forms to participating schools and will work jointly with the designated • schools' guidance staff to fulfill application and registration requirements. 1. M-DCPS' pre-registration advising will focus on the curricular expectations of college-level,rigorous academic work,which typically exceeds the work required of • high school courses. Pre-registration advising will include information on FIU's add/drop policies and deadlines. The advising will also focus on the impact of performance in dual enrollment courses,which becomes a part of a student's permanent college transcript and permanent postsecondary grade point average (GPA). 2. M-DCPS confirms and/or verifies student eligibility and provides approval for • student participation in dual enrollment; M-DCPS also monitors student performance under this dual enrollment agreement. 3.03 Registration Procedures. A. Required Documentation.Each student must submit the following documents to FIU, Modesto A.Maidique Campus,APA,prior to registration and in accordance with registration deadlines and practices posted on the FIU website for dual enrollment students. • 1. The Proof of Immunization Form must be provided by the student if attending FIU classes for the first time on FIU campuses.As a prerequisite to registration,FIU requires all students to comply with the immunization policy regulations of the Florida Board of Governors regarding measles,mumps,rubella,meningococcal meningitis and hepatitis B immunity. 2. The student must provide an official Dual Enrollment Authorization Request Form(FM 6477)signed by the school principal or designee to ensure that the dual enrollment 5 • course(s)will count as credit towards the high school diploma. It is the responsibility of the student and the school guidance counselor and/or Dual Enrollment coordinators to complete the required sections of the form and select the courses from the approved dual credit course list(Appendix B carries the link to the Dual Enrollment Course-High School Subject Area Equivalency List). 3. The student must provide Scholastic Aptitude Test(SAT)scores,American College Test (ACT)scores or the Post-Secondary Readiness Test(PERT) scores. Additionally,other discipline-specific placement for enrollment in Mathematics courses will be required (i.e.,the ALEKS Math Skills Assessment). 4. In terms of FIU's off-campus dual enrollment program,a waiver system is in place. Refer to 3.15,B,for more information regarding the M-DCPS Waiver Form. B. ,Application System.An online application system has been developed by FIU and made available to M-DCPS to support both the on-campus and high school dual enrollment. (Note that AAA students apply directly through the regular PantherSoft system.) Deadlines are established,and communicated by APA's Dual Enrollment staff,to facilitate the application process. 3.04 Withdrawal Procedures. A. Process.All dual enrollment students are responsible for officially withdrawing from classes that they are no longer attending in accordance with FIU requirements. Depending on the mode of delivery(i.e.,whether FIU is offering the dual enrollment coursers] on campus, summer online courses,or at local public schools),the withdrawal procedure will vary. Students who do not officially withdraw from a class may receive a failing grade. Such a failing grade becomes a part of their permanent transcript records and could have a negative effect on future college admissions,scholarship opportunities,and/or financial aid. 1. On-campus dual enrollment withdrawal is aligned to FIU's"Drop and Add"Period and is initiated by the dual enrollment student;the Registrar's Office must receive an official withdrawal from a dual enrollment course(s)within the stipulated timeframe. All on- campus dual enrollment students are responsible for notifying the high school guidance counselor, in writing,prior to withdrawal from any dual enrollment course. (Note that in _ the case of online dual enrollment summer courses,notification of counselors and/or Dual • Enrollment coordinators will not be possible if the public schools are not in academic session. Thus, students will be responsible for maintaining abreast of applicable withdrawal procedures.) 6 2. Off-campus dual enrollment students must withdraw within the timeframe established and communicated to school administrators by the FIU Dual Enrollment staff. Students who do not officially withdraw from a class may receive a failing grade; high school teachers and the M-DCPS' counselors and/or Dual enrollment coordinators must monitor students vis-à-vis request for withdrawal and implementation of withdrawal procedures. Withdrawals must have the approval, in writing, of the counselors and/or Dual Enrollment coordinators. B. M-DCPS cannot charge a student for dual enrollment tuition if the student withdraws from courses. 3.05 Eligibility Criteria. A. Dual enrollment is an acceleration program that allows students in grades six(6)through 12 to take post-secondary coursework and simultaneously earn credit toward high school completion and college coursework. B. FIU agrees to permit eligible students enrolled in public schools in Miami-Dade County, who have been certified by their principals as qualified,to dually enroll in regularly offered courses that will also meet the student's high school diploma requirements. Upon meeting eligibility requirements, students can participate in FIU dual enrollment opportunities. Students participating in dual enrollment options must meet the following entrance eligibility requirements: 1. be enrolled in a course of study which will fulfill requirements for high school E • graduation; 2. have a 3.0 unweighted high school GPA; 3. standardized college placement tests indicating college readiness; 4. satisfy any course prerequisites;and, 5. meet any additional criteria set by FIU as the post-secondary institution. In order to continue in the program, students must maintain a 3.0 unweighted GPA in their high school academic work and earn a 3.0 or better in college-level work,as confirmed by their school guidance counselors and/or Dual Enrollment coordinators. To ensure student readiness for post-secondary instruction,all students in grades six(6) • through 12 must meet high school GPA and present standardized college placement tests • indicating college readiness to be able to participate in dual enrollment at FIU. FIU may establish additional,initial student eligibility requirements to ensure student readiness; 7 students,however,who have demonstrated the ability to master advanced courses can participate in dual enrollment courses. In terms of the waiver system for the off-campus dual enrollment program,refer to 3.15,B for more information. C. As approved in writing by parents,eligible sixth(6)-to-eighth(8) graders have the choice to come to FlU to take the dual enrollment class at FIU's Modesto A.Maidique Campus or the Biscayne Bay Campus. These students are responsible for their transportation. In providing written consent of eligible sixth-to-eighth graders to participate in dual enrollment courses at FIU,parents acknowledge that FIU is an open campus and that FIU cannot be responsible for the supervision of these sixth(6)-to-eighth(8)grade students beyond the delivery of • instruction in the classroom setting. While appropriate for college-level study, course materials and class discussions may reflect topics not typically included in sixth(6)-to-eighth (8)grade courses or high school courses,which some parents may consider advanced for minors. Courses will not be modified to accommodate variations in student age and/or maturity. I. Dual Enrollment Instruction at Middle Schools. In case that FIU faculty or instructors are available,FIU can also arrange to offer after school dual enrollment classes directly at middle schools. If an FIU faculty or adjunct instructor is hired to teach a'class at the middle school campus,a fee of$5,000 will be charged to the middle school for the provision of educational services. Special Note: In terms of future annual Dual Enrollment agreements,academic monitoring and oversight fees, FIU faculty/adjunct cost and/or other charges will be evaluated annually in the spring term. Depending on availability of FIU fmancial resources, any change in the fee structure will be communicated in advance,and in writing,to M-DCPS prior to the renewal of dual enrollment agreement(s). The adjunct instructor will provide instruction consistent with the M-DCPS' school calendar and schedule,unless otherwise agreed upon in writing by the school site principal. On a case-by-case basis FIU could credential a middle school instructor to teach a FIU course in the case he/she has the qualification requirements per credentialing standards. D. Dual enrollment courses become a part of a student's permanent college transcript;thus, grades will become part of permanent high school and college transcripts. FIU and M-DCPS are committed to ensuring student success,while providing access to accelerated educational • opportunities. As long as students achieve, and maintain a GPA of 3.0 or better in FlU college- level coursework and a 3.0 unweighted GPA in their high school academic work(as,confirmed by school guidance counselors and/or Dual Enrollment coordinators),students will be allowed to continue in the FIU dual enrollment program. This GPA requirement extends alike to on- 8 campus,online, and off-campus FIU dual enrollment. Any student who earns a grade lower than a'C' in any one(1)dual enrollment course will not,however,be allowed to continue participating in the dual enrollment program. While 'Cs' are allowed as long as a GPA of 3.0 or better is maintained,the District will communicate to the parents the potential repercussions of having a 'C' in a permanent transcript vis-à-vis scholarship opportunities and future • university/college selectivity/acceptance. A cautionary statement will be included in the M- DCPS and FIU parent consent form to bring attention to the potential risk. 1. For students taking dual enrollment courses for the first time in their studies: In the case that a student takes the first course ever as a dual enrollment course and obtains a 'C' in his/her first dual enrollment course,the student will be allowed to continue in the dual enrollment program contingent on a request from the counselor and/or Dual Enrollment coordinators to continue eligibility based on: a)the offering of additional academic support from the school involved and b)the close monitoring of the student's progress in the second dual enrollment course. If,however, a student earns a'C' in another course taken during his/her semester as a first-time dual • enrollment student(special note: consider that a college GPA of 3.0 has not been established),the student's eligibility will be discontinued. FIU will monitor the status of the student's eligibility closely and communicate directly with the District findings related to the academic performance of the student. E. Special dual enrollment credit programs,as applicable,may have admissions requirements that differ from those stated above.Additional eligibility criteria may apply to special programs. Generally, students can take courses indicated in the Dual Enrollment Course-High • School Subject Area Equivalency List accessed via http://www.fldoe.org/core/fileparse.php/5421/urlt/0078394-delist.pdf with approval by the District and included in the District's Curriculum Bulletin. (Special Note: This list can be revised from time to time by the Florida Department of Education.) Dual enrollment courses not referenced in the equivalency list maintained by the Florida Department of Education may be taken by those students enrolled in special programs,as applicable,described within this Agreement with approval of M-DCPS. 3.06 Code of Conduct. Dual enrollment students are responsible for following FIU's student code of conduct,which outlines acceptable and unacceptable academic or behavioral misconduct applicable to FIU students. Unacceptable behavior includes cheating and plagiarism. The student code of conduct delineates appropriate.disciplinary procedures and sanctions in the case of unacceptable behavior.FlU's Student Code of Conduct can be accessed via http://studentaffairs.fiu.edu/about/student-handbook/ 9 - 1 • 3.07 Academic Grievance(sl. FlU's policy on Academic Grievances,accessible at https://policies.fiu.edu/files/737.pdf,will be applicable to dual enrollment students enrolled in FIU's dual enrollment courses at FIU's Modesto A.Maidique and Biscayne Bay Campuses,at • local high schools,and online dual enrollment. Collaborating with M-DCPS,FIU Dual .• Enrollment Staff will communicate the policy and procedure(s)to dual enrollment students upon their enrollment in FIU courses. Appendix C contains the Dual Enrollment Formal Grievance Form that will need to be completed by students in case of a grievance. In addition,the following link describes the flow process regarding filing an academic grievance: intergrity.fiu.edu Students will be also given this link upon enrollment. Students have the option to contact for more information the Office of Academic Integrity at 305-348-2943. 3.08 Dual Enrollment Costs. For dual enrollment offered at FIU, including AAA dual enrollment the school district will pay the standard tuition rate per credit hour from the Florida Department of Education's Florida Education Finance Program(FEFP). Additionally,registration and laboratory fees are not included in the school district payments; students are exempt from paying any registration,tuition,or laboratory fees. The school district will not receive funds under FEFP for summers;therefore,summer enrollment is exempt from payment from the school district. Subject to annual appropriation in the General Appropriations Act,FIU shall receive an amount of funding equivalent to the standard tuition rate per credit hour for each dual enrollment course taken by a student during the summer term. For dual enrollment offered at either the middle or high schools, refer to sections 3.05 C, 1 (above) and 3.15(below) related to cost and billing modality. Refer to Section 3.14 for costs related to the online dual enrollment deployment modalities. • A. Centralized Billing Modality. 1. rrocess. FIU and M-DCPS have agreed upon,and established,a Centralized Billing Process for invoicing the standard tuition rate per credit hour of the dual enrollment courses offered on FIU's campuses. Within a month of the official FIU Drop/Add date for the fall and spring terms,FIU's Student Financial Services of the Office of the Controllers will invoice M-DCPS at the address listed as Division of Academic Support, 1501 N.E.2nd Avenue, Suite 327-R,Miami,FL 33132,for student tuition in all Dual Enrollment courses, including: 1. The traditional on-campus dual enrollment offered on FIU campuses; 2. The dual enrollment deployed via the AAA; 3. The full-time Dual Enrollment program(Early Admissions); • 10 4. Florida Action for Minorities in Engineering(FLAME)program; and, (Special Note: In the case that a special dual enrollment initiative, such as FLAME,provides an additional learning experience through non-credit workshops that develop student skills and knowledge,FIU will propose a separate budget to M-DCPS for consideration and funding. Such value-added non-credit programs will not be implemented without the written approval of M- DCPS. The non-credit component will be billed through the pertinent academic unit and not via the centralized billing modality. (Refer,for example,to Section 3.13 A. [FLAME] for more information.) In order to facilitate the reconciliation process,the FIU dual enrollment invoice will include the following information, as generated by FIU's Student Financials'database: • Term and Year • School Name • Student Name and Date of Birth(DOB) • Course Prefix# • Course Title • Credit Hours Earned 2. peadline(s). M-DCPS will reconcile the records provided on the FIU invoice and will issue payment within 60 days maximum to Florida International University. The payment modality is via a check payment. Non-centralized billing modality by APA's Dual Enrollment Office 1. Payment Modality Process. FIU's APA will be responsible for the invoicing of online dual enrollment courses deployed under the modalities known as Facilitated Dedicated Section with Coordination and Facilitated Dedicated Section without Coordination. See section 3.14,A, 3 for detailed description. 2. Payment must be received from M-DCPS in a timely manner(i.e., within 60 days of the receipt of the invoice by M-DCPS). Special Note: Failure to pay the students'tuition in a timely manner as stipulated above could lead to the assessment on M-DCPS of a late payment fee of five(5)percent of the pending balance. Failure to pay may be considered a breach of contract for which FIU may terminate the Agreement based on the provisions of Section 4.04("Termination"). 3.09 Program Quality. A. Credits. All students enrolled in dual enrollment classes will be graded on the same basis as other college students enrolled in the same courses. Students participating in dual enrollment at FIU will receive grades and credit for their college work. These grades and credits are posted on the college transcript. Dual enrollment course grades become part of a student's permanent college and high school transcript and are calculated into the student's permanent postsecondary GPA maintained by FIU. Grades issued by FIU faculty and adjuncts teaching dual enrollment courses at FIU are transmitted electronically to M-DCPS, including online instruction. At the end of each semester,the M-DCPS will send dual enrollment final grades to school site principals and registrars for inclusion in students' high school course records and transcripts. B. Materials and Equipment. The M-DCPS shall provide dual enrollment students,free of charge,required college textbooks and other instructional materials in accordance with s. 1007.271(17),F.S. 1. Rooks. M-DCPS is responsible for the purchase of the textbooks provided to eligible students participating in the dual enrollment program at FIU,including online dual 12 • enrollment. M-DCPS has established a book voucher system with bookstores at MMC and Biscayne Bay Campus (BBC). When available,students will be issued used books. The student is'responsible for returning to the school each textbook issued. Textbook •• affiliated costs for licensing fees or electronic media access which are password protected are paid by the school District. A process has been established between the school District and bookstores at MMC and BBC in order to reduce costs. The • bookstores will buy back books used by eligible dual enrollment students at the end of each term. Fines,however, can be charged by M-DCPS,per its discretion,related to instructional textbooks that are lost or returned in a late manner. 2. Technology.M-DCPS will provide computers and web access as necessary to FIU dual enrollment students taking dual enrollment courses on the high school campus. C. Student Records. Subject to applicable laws,all documentation, including,but not • limited to,test results,course credits,and any other educational records maintained by FIU,that will assist school personnel and handled in accordance with state and federal confidentiality and privacy acts. FIU understands and agrees that it is subject to all federal and state laws related to the confidentiality of student information. FIU agrees to comply with the Family Educational Rights and Privacy Act(FERPA)and M-DCPS policies and rules pertaining thereto. FIU shall treat all School/FIU Cooperative Agreement and dual enrollment student information as confidential and will not disclose the student information to any third party,except as provided by law. According to federal regulations, if a student is attending a postsecondary institution-at any age -the rights under FERPA have transferred to the student. However, in a situation where a student is enrolled in both a high school and a postsecondary institution,the two(2) • schools/institutions may exchange information on that student. If the student is under 18,the • parents still retain the rights under FERPA at the high school and may inspect and review any • records sent by the post-secondary institution to the high school. I. i .. Inasmuch as dual enrollment students are FIU students,FIU faculty and staff"with a legitimate educational interest"may access student records in accordance with all applicable federal and state laws related to the confidentiality of student,as well as FIU and M-DCPS rules. D. Course Offerings.3 Dual enrollment courses for M-DCPS students are limited to those indicated in http://www.fldoe.org/core/fileparse.php/5421/urlt/0078394-delist.pdf and M-DCPS Curriculum Bulletins. With the exception of Full-time Dual Enrollment/Early Admission and AAA programs,FIU and M-DCPS recommend that a student enroll in a 3 The scope of this Agreement does not include non-degree seeking students who might be interested in taking courses at FIU as regular paying students. • 13 maximum of two (2)courses each semester(excluding labs)in order to ensure academic success. Additional coursework should be approved by the School District Office and FIU on • an individual basis. (Please refer to the information on the AAA regarding course offerings and maximum number of courses allowed, as well as information on Full-time Dual Enrollment [below].) Taking into account the exceptions indicated above, in terms of the on-campus program, in order to ensure academic success, it is recommended that students consider only taking up to two (2)courses per semester regardless of delivery mode(i.e., face-to-face dual enrollment at FTU campus(es)or online). Dual enrollment courses at the 1000-2000 instruction • level are recommended to advance student success. Special Note: Courses offered through FIU's on-campus program, can include some web- assisted components involving access to course materials and preparation and submission of assignments. • 3.10 Full-time Dual Enrollment at FIU. i .. A. Early Admission. Early admission is a form of dual enrollment on the FTU campus(es). This type of dual enrollment allows eligible high school ascending Seniors to enroll at FIU on a full-time basis in courses that are creditable toward high school diplomas and college ' coursework. The two (2)semesters of college coursework are substituted for the Senior year of high school. A student must enroll in a minimum of 12 college credit hours per semester to participate in the early admission program and have an unweighted high school,GPA of 3.5 and must meet college-readiness test score requirements,per FIU;however,a student may not enroll in more than 15 college credit hours per semester. Students enrolled pursuant to this subsection are exempt from the payment of registration,tuition,and laboratory fees. Eligibility criteria will • be communicated by M-DCPS to prospective full-time/early admission dual enrollment students; school principals,counselors,parent/guardians will need to authorize enrollment in FlU's full- time/early admission dual enrollment program. • 3.11 HomeEducation Students. A. Eligibility and Requirements.An eligible home education student must provide proof of enrollment in a home education program. The student must be registered with the M-DCPS' Home School Office. For home education students born between January 1 and August 31,this • Agreement will automatically terminate on the last day of Session Two (2)in the year of said student's 18th birthday or on the last day of the student's participation in the home education program,whichever comes first. If the home education student was born between September 1 • and December 31,enrollment under this Agreement will automatically terminate on the last day • of Session Two (2) in the year immediately following said student's 18 birthday or on the last • day of the student's participation in the home education program,whichever comes first. If a 14 home education student will be dually enrolled in courses at FIU prior to his/her 16th birthday, enrollment under this Agreement shall automatically terminate two(2)years after its date of origination or, on the last day of the current session not to exceed two(2)consecutive years of . academic instruction. 1. According to the Florida Department of Education's interpretation of the Florida Statute as articulated in its Frequently Asked Questions(source: http://www.fldoe.org/core/fileparse.php/5423/urlt/DualEnrollmentFAQ.pdf),a minimum GPA is not required for Home Educated Students. Students must earn,however, a 3.0 GPA or better in college-level work to maintain continued eligibility. B. Resnonsibility and Consent. Home education students must be responsible for their own transportation to FIU. Home education students, and in the case of minors,their parents,must sign a home education articulation agreement with FIU. C. Xnstructional Materials: Per S. 1007.271,F.S.,home education students are no longer required to purchase their own instructional materials. FIU will fund and communicate the procedure to students. D. Dual En o lment Transfer Guarantees. Per S. 1007.271,F.S.,Dual Enrollment Transfer Guarantees will be provided,by FIU,to home education students. 3.12 AAA. A. The M-DCPS, in cooperation with FIU, agrees to provide an educational program for secondary school-age students in accordance with state law,the rules of the State Department of • Education,FIU,and the M-DCPS,as follows: ii• 1. Teachers. The M-DCPS shall provide Language Arts,Mathematics, and Social j. Studies teachers,counselor(s),paraprofessionals,and other administrative and clerical staff consistent with the School Allocation Plan Handbook for Computing Unit Allocation to Schools. The teachers, counselor(s),paraprofessionals,and other administrative and clerical staff will advance the instructional and resource goals of the AAA. Said teachers are the employees of M-DCPS and shall be supervised by M • - DCPS personnel. All M-DCPS employees performing teaching,administrative,or other activities on FIU's campus must abide by FIU campus policies and procedures. Intentionally omitted. 15 • I • ti • I• 2. Materials and Equipment.The M-DCPS will provide,free of charge, books/instructional materials,other materials and equipment for all high school credit classes conducted on FlU campuses,on the same basis as books/instructional materials, other materials,and equipment are supplied to regular classes within M-DCPS. M- DCPS shall also provide free of charge to all students college textbooks, in accordance ; with s. 1007.271(14),F.S., and the FIU student identification card. • 3. Work Space. The M-DCPS will provide the necessary equipment and supplies for the everyday function of M-DCPS' staff,as well as computers with access to M- DCPS' Office of Information Technology. M-DCPS will also pay for the parking costs of the M-DCPS personnel working in the Dual Enrollment program at the FlU campus(es). 4. Educational Program Cost. The M-DCPS shall be obligated to pay costs or expenses in connection with the Agreement as set forth in Paragraphs 3.08 and 3.08 A above regarding dual enrollment tuition costs per the new law that entered into force on July 1,2013. Beginning with the 2013-2014 School Year, 12th grade students at AAA will enroll in four(4)college Dual Enrollment courses in the fall term and four(4) college Dual Enrollment courses in the spring term,in addition to any corresponding labs. Beginning with the 2013-2014 School Year, 11th grade students at AAA will enroll in three(3)college Dual Enrollment courses in the fall term and three(3)college Dual Enrollment courses in the spring term, in addition to any corresponding labs. M- DCPS will monitor the registration of students to ensure that they adhere to this course number restriction. The number of courses will be subject to review on an annual basis I. during the duration of this Agreement. Any change will be communicated by M-DCPS to FIU in writing with ample time prior to the beginning of the fall term of each year. There shall be no cost to the school-age student for the AAA educational program provided thought this Agreement.M-DCPS,however, is required to pay FIU from FEFP • funds the standard tuition rate per credit hour as dictated by s. 1007.271,F.S. 5. Student Educational Records. To the extent authorized by law,student educational records,when requested by FIU, shall be made available as provided by the School Board Policy#8330. Student records will be maintained by the corresponding • home school in which each student is enrolled. 6. Rules. The rules of M-DCPS shall be adhered to in relation to M-DCPS teachers and other M-DCPS employees. Notwithstanding the terms of this Item 7,M- DCPS teachers and other M-DCPS employees must comply with FIU's policies, procedures and regulations while performing activities on FIU campuses. • 16 7. Student Discipline. All students enrolled in M-DCPS' dual enrollment program, shall be disciplined under M-DCPS' and FIU's disciplinary rules and as provided in �> Section B, 9 below. S. Graduation. Students will receive a diploma issued by the corresponding home school. The GPA/rank in class will be calculated for each graduating students at each of his/her corresponding home schools for that year. Bonus points will be assigned to dual enrollment courses as designated by M-DCPS. 9. Lunch. Students eligible for free or reduced lunch,pursuant to federal guidelines,will be provided a lunch from a neighboring M-DCPS. Students not eligible for a free or reduced price lunch will need to provide their own lunches. 10. Enrollment Procedures. Students and their parents will meet with M-DCPS personnel to complete the agreement for participation in the dual enrollment program. Information regarding the appropriate application forms and mandatory testing required by FIU will be provided by M-DCPS personnel. 11. Transportation.Bus services to FIU campus(es)for eligible students will be provided by M-DCPS. B. FIU agrees to provide the following services covered by this Agreement: 1. Notice of Unsatisfactory Progress. Notice of student unsatisfactory progress in FIU classes shall be reported to designated M-DCPS AAA principal. i • • 2. Classrooms and Furniture. Building spaces will include specific rooms designated as classrooms. Classroom space will be provided for each high school course at AAA during designated hours. The classrooms will contain the same furniture that is provided to FIU students. 3. Work Space. Appropriate provisions,depending on availability of resources, will be made available to teachers,teacher assistants and clerical personnel, including a secured office area for confidential student records and private meetings with staff and/or parents. 4. Facilities and Equipment. FIU will make appropriate facility provisions at no cost to the School Board for the purpose of parent/student orientations, Open Houses, .. • and other school-related activities scheduled throughout the school year. Furthermore, 17 • FIU,depending on availability of resources,will make reasonable provisions to provide technical assistance support at no cost and will allow the use of audio/visual equipment at said events,when deemed necessary by M-DCPS personnel. 5. Materials and Equipment. FIU will not charge students for tuition, registration,laboratory fees,as per s. 1007.271,F.S. FIU will provide telephone and Internet access to M-DCPS staff members at M-DCPS'cost. FIU will provide,free of charge, instructional technology equipment on the same basis as said equipment is provided to instructional personnel at FIU to support classroom use. 6. Student Records. Subject to applicable laws, all documentation,including,but not limited to,test results, course credits,and any other educational records maintained by FIU to support the implementation of the AAA and to assist M-DCPS to provide an appropriate education for the students involved will be available to M-DCPS personnel and handled in accordance with state and federal confidentiality and privacy acts. E. . 7. Course Offerings. FIU shalle rovidappropriate courses for dual enrollment at p times consistent with the schedule established by FIU for students in this program. FlU and M-DCPS warrant and agree that all dual credit enrollment programs shall meet the provisions of the current State of Florida laws and regulations. 8. Facilities. FlU shall use its best efforts to provide educational facilities consistent with goals and objectives of the AAA dual enrollment program. 9. Student Discipline. While students are in the FIU campus educational program, the FIU Student Conduct Code and other policies and regulations regarding academic and behavioral discipline,as contained in the FIU Student Handbook, shall apply. Students must also follow all rules and regulations found in the M-DCPS Code of ! Student Conduct and school-site rules. 10. Enrollment Procedures.ures. Eli ible students and their parents will be provided with the forms and information necessary to apply to admission to FlU and complete the required entrance examinations. C. The Parties hereto mutually agree as follows: • 1. Students who accept admission into AAA do not have the opportunity for full-time dual enrollment(otherwise known as the Early Admissions Program)at a later date. Continued participation in this AAA program is dependent upon the student's continued satisfactory progress in all portions of the program, i.e.,the dual • 18 enrollment component and the M-DCPS component. Failure to progress satisfactorily may result in dismissal from the program. A student may also be dismissed for failure to comply with either M-DCPS rules,policies and procedures • or FIU's regulations,policies and procedures. Reasonable efforts shall be made by M-DCPS personnel to work with students,parents,and FlU teachers to resolve problems prior to the dismissal of any student. 3.13 Other FlU Dual Enrollment Opportunities. A. FLAME. The Florida Action for Minorities in Engineering(FLAME)program is a joint program between the M-DCPS and FIU.The program is specially designed for minority high school students and provides a unique educational experience in the field of Engineering. During their Senior year, eligible students can take six(6)credits of dual enrollment Engineering/Computer Science courses at the FIU College of Engineering and Computing. Students can take these credits during the Fall and Spring semesters. The courses to be offered under this program will be determined annually based on needs and interest of schools,and in accordance with dual enrollment regulations. These courses will be communicated to M-DCPS in writing with ample time to accommodate implementation and/or course enrollment. 1. Eligibility. Students follow the same eligibility guidelines pertinent to the on • - campus dual enrollment program. 2. Cost.The program cost follows Florida State's guidelines,but with the caveat that • a minimum enrollment of 20 per class may be required in order to implement the class. 1•. 3. Optional Non-Credit Comnonent. a. Each cohort will consist of a minimum of 20 students. The non-credit component will be implemented during the entire semester and is irrespective of the number of credits. The number of hours for workshops and/or field trips will vary depending on the course as well as the type of industry,science museum,etc. b. A non-credit fee of$200 per student will be charged to cover the cost of course materials,Engineering kits,workshops and field trips,where appropriate, that are associated with the delivery of courses. 19 B. Partners in Progress Program (PIP). • The PIP is a partnership between FIU and M-DCPS that allows 11th grade students to challenge themselves at the college level by taking two(2) courses at FIU during the summer,as recommended. 1. Eligibility. Students must have a high school GPA of 2.7 or higher and must have earned a minimum score in a standardized college placement test. Consideration will be given to students who have participated in one of FIU's Pre-College Programs in the past, i.e. College Reach-Out Program, Upward Bound,Educational Talent Search, Upward Bound Math and Science,National Achievers Society,etc. C. Teaching Academy. FIU's College of Arts, Sciences and Education("CASE"),in partnership with M-DCPS,will continue to implement a Teaching Academy at Ronald W.Reagan/Doral Senior High School for eligible,full-time high school students interested in future careers in education.As stipulated in a separate agreement,to be executed between CASE and M-DCPS, dual enrollment courses will be part of the curriculum. p. STEM Education Academy. FIU's CASE in partnership with M-DCPS will collaborate to pilot a STEM Education Academy for eligible,full-time high school students at Southwest Miami Senior High School. The mission of the Academy is to reduce the local science and mathematics teacher shortage,at the secondary education level, by targeting high-performing students and offering them a path towards science and mathematics degrees and teaching opportunities.The program curriculum consists of 10 FIU courses, including a Biological Science Research Internship to be deployed at FIU and summer Dual Enrollment course options. A separate agreement,to be executed between FIU's CASE and M-DCPS will carry all specifics related to coursework and other considerations. 3.14 FIU's Online Dual Enrollment. • A. Per the Florida Department of Education's guidelines,there does not exist a distinction in the law between dual enrollment courses taught in a face-to-face format versus those offered online(see source:http://www.fldoe.org/core/fileparse.php/5423/urlt/DualEnrollinentFAO.pdf). 20 1. Courses. As part of FlU's dual enrollment program, eligible students would be able to enroll in FIU's online courses. The list of courses will be disseminated separately to M-DCPS per a written established deadline.M-DCPS will confirm that the online courses satisfy credits for high school graduation as dual enrollment courses. Special Note: With the exclusion of the exceptions indicated Section 3.09,D,it is recommended that students consider taking only two (2)courses per semester. • 2. )Eligibility.The requirements for students to participate in an online dual enrollment courses follow the same FIU on-campus eligibility criteria,as articulated in • Sections 3.03,A,3 and 3.05 of the Agreement. GPA waivers,extended to the off-campus dual enrollment program,will not be accepted for online courses. (For more information, refer to Number 5 below.) 3. Online Dual Enrollment Delivery Modality,Support,and Requirements. FIU offers online courses via different modalities as described below. Students would need to have available laptops, computers and/or other electronic device to be able to carry out the coursework. Hardware and operating systems must be compatible to support ! . online learning. Snecial Note: All online modalities are taught by FIU faculty and/or adjunct instructors. ■ facilitated Dedicated Section with Coordination (Co-Teaching.Modei) o Facilitation/Coordination: A high school teacher,qualified to deliver subject within the high school setting(i.e., a Subject-Matter Expert),will actively • communicate/coordinate the course with the Fill online instructor.Additionally, the high school teacher will monitor and supervise students and proctor exams in a school computer-lab setting. . ' o Schedule: The online course is deployed based on the M-DCPS academic • semester calendar;while students participate during the school day, online assignments can be completed outside of school hours. o Enrollment: The course enrollment consists of high school students from the same school. o Cost: o 1-50 students: $3,000 per section o 51 and above: $60 additionally per student • 21 f . . I Facilitated Dedicated Section without Coordination (Facilitated Model): o Facilitation/Coordination: M-DCPS faculty or staff monitor and supervise students and proctor exams in school computer-lab setting. o Schedule: The course is deployed based on M-DCPS academic semester calendar; while students participate during the school day,online assignments can be • completed outside of school hours. o Enrollment: High school students can enroll in the course from different high schools. o Cost: > Note: The cost of this section can be shared amongst several high schools based upon a prorated rate. ➢ 1-50 students: $4,000 per section > 51 and above: $80 additionally per student ■ Non-Facilitated Integrated Section OR Non-Facilitated Dedicated Section (Traditional FIU Online Courses offered during FIU Summer Terms): o Facilitation/Coordination: A facilitator is not required or appointed. • o -Schedule: The schedule is based upon FIU's academic semester calendar. o Enrollment for Non-Facilitated Integrated Section:The course includes high school and FIU students. o Enrollment for Non-Facilitated Dedicated Section: The course is offered solely to dual enrollment students,as determined by FIU. o Cost: Summer is exempt from payment. A description of the services to support the online courses will be made available to • students, including information on holding virtual office hours,posting course materials on the class website,etc. Electronic and/or telephone advising will be available per a contact information that will be provided to students by FIU Online. FIU Online will implement security measures to ensure the integrity of the online deployment of the dual enrollment courses and the authenticity of the identity of the enrolled student. 4. Online Dual Enrollment Course Announcement. M-DCPS'Division of Academics, Office of Academics and Transformation,Department of Advanced Academic Programs will disseminate,as provided by FIU,online course announcements through its various communication channels. 22 € 5. Registration and Enrollment Procedures. The online dual enrollment program will not allow the academic GPA waivers for participation in the program. In accordance with the Agreement,M-DCPS is responsible for student recruitment and for verifying • eligibility of students to participate in online dual enrollment courses. Students must register and submit documents requested by FIU prior to registration and in accordance with registration deadlines and practices communicated by FIU. a: 6. Class-size Enrollment In order to deploy quality online education,FIU will communicate to M-DCPS any online class-size applicable restriction. As such,it is important that students and schools submit all required documents within set deadlines to ensure access to registration. • 7. Withdrawal Procedures. Withdrawal procedures are aligned to the Add/Drop schedule depending on the modality.Facilitated Dedicated Section with Coordination • (Co-Teaching Model)and Facilitated Dedicated Section without Coordination (Facilitated Model)modalities follow the school calendar and counselors and/or Dual Enrollment coordinators will receive specific instruction on how to Add/Drop students from the FIU dual enrollment office. The Non-Facilitated Integrated Section or Non- Facilitated Dedicated Section(Traditional FIU Online Model) follow the FIU summer term academic calendar and adhere to the FIU Add/Drop schedule. The Registrar's Office must receive an official withdrawal from a dual enrollment courses(s)within the stipulated timeframe Students who do not officially withdraw from a class may receive a failing grade. Such a failing grade does become a part of a student's permanent transcript records and could have a negative effect on future college admissions,scholarship opportunities,and/or financial aid. All withdrawal deadlines will be communicated to students by the Dual Enrollment :. staff. • Special Note: While observing the"Drop and"Add period,it is recommendable that upon dropping an online course during short summer FIU terms,online dual enrollment students do not add a new online course(s) in view that online courses would havealready been in progression. 8. Payment and Fees. A student who is enrolled in dual enrollment in the state university is exempt from the payment of tuition and fees,pursuant to s. 1009.25 F.S. ("Fee Exemptions")and the fee exemption includes application,registration,tuition,and laboratory fees for courses taken through dual enrollment. M-DCPS will be responsible for payment as denoted in the various online modalities described in Section 3.14,A. 3 above. 23 • I , In view that the school district will not receive funds from FEFP for summers, summer • term enrollment, including online dual enrollment,is exempt from payment from the school district. 9. Learning Outcomes. Online courses will be governed by the same student learning outcomes as established for the face-to-face on-campus courses held at FIU. 10. Course Books and Materials. M-DCPS Will provide,free of charge, college books and instructional materials for online credit courses,on the same basis as books and instructional materials are provided to regular classes within M-DCPS. M-DCPS shall also provide free of charge to all students college textbooks, in accordance with s. 1007.271(14), F.S., and the FIU student identification card. To guarantee student success, it is essential that M-DCPS provide students with books on a timely manner prior to the beginning of the online course(s). FIU's Dual Enrollment staff will need confirmation that student book • vouchers have been provided to the students. 11. Student Discipline. While students are enrolled in FlU courses, including online courses,the FIU Student Conduct Code and other policies and regulations regarding academic and behavioral discipline, as contained in the FlU Student Handbook, shall apply. 12. Online Policies.Regulations and Procedures. The deployment of online courses will be governed by all FIU policies,regulations and procedures. 3.15 Dual Enrollment Courses Offered Directly at High Schools. is A. Eligibility Requirements. FlU has eligibility requirements. M-DCPS must ensure that students meet these eligibility requirements. FIU agrees to permit high school students enrolled in M-DCPS who have met the university's eligibility requirements,to dually enroll in regularly offered FIU courses at high schools. These courses will also meet the student's high school diploma requirements. Students' eligibility to participate in dual enrollment will be governed by Appendix D,which stipulates the courses that are available.(This list is subject to change.) Students participating in dual enrollment options must meet the following entrance eligibility • requirements: (1)enrolled in a course of study which will fulfill requirements for high school graduation; (2) 3.0 unweighted high school GPA; (3)standardized college placement score indicating college-readiness,such as the PERT and discipline-specific exams such as ALEKS for Mathematics; (4) satisfy any course prerequisites; and(5)meet any additional criteria set by FIU. 1. FIU and M-DCPS are committed to ensuring student success,while providing access to accelerated educational opportunities. As long as students achieve, and maintain, a 24 GPA of 3.0 or better in FlU college-level coursework and a 3.0 unweighted GPA in their high school academic work, students will be allowed to continue in the dual enrollment program. This GPA requirement extends alike to on-and off campus FIU dual enrollment. Any student who earns a grade lower than a 'C' in any one (1)dual enrollment course will,however,not be allowed to continue participating in the dual enrollment program. 2. For students taking dual enrollment courses for the first time in their studies: In the case that a student takes the first course ever as a dual enrollment course and obtains a 'C' in his/her first dual enrollment course,the student will be allowed to continue in the dual enrollment program contingent on a request from the counselor and/or Dual Enrollment coordinators to continue eligibility based on: a)the offering of additional academic support from the school involved and b)the close monitoring of the student's progress in the second dual enrollment course. If,however,a student earns a`C' in another course taken during his/her semester as a first-time dual enrollment student(special note: consider that at this point a college GPA of 3.0 has • not been established),the student's eligibility will be discontinued.FIU will monitor the status of this conditional eligibility closely and communicate directly with the • District findings related to the academic performance of the student. 3. Special dual enrollment credit courses,as applicable,may have admission and eligibility requirements that differ from those stated above. B. Enrollment Procedures. The M-DCPS is responsible for student recruitment and for • allowing qualifying students to participate in FIU's dual enrollment courses offered directly at high schools. Students and their parents will meet with school personnel to complete a dual enrollment form as a way to agree to participate in the dual enrollment program. School personnel will provide the appropriate application forms and eligibility information to students and parents. Students may enter or leave the program only at the start of a term in August or January. Students are limited to the courses listed in Appendix D;this list is subject to change. In terms of eligibility,exceptions may be made pursuant to s. 1007.271(3),F.S.,by means of an M-DCPS Waiver Form. Academic waivers can be extended to students with unweighted GPA between 2.7 and 2.99 for the FIU high school campus enrollment program,contingent on additional educational support provided to students by M-DCPS who receive such waiver(refer to information below). High schools must report waivers to FIU at the beginning of each term by submitting student rosters reflecting the students'unweighted GPAs. Schools will be informed by FIU and the M-DCPS' Division of Academics, Office of Academics and Transformation, Department of Advanced Academic Programs of the process for submitting these rosters to FIU at the beginning of each semester. As requested,this information will be shared with M-DCPS,as 25 well as,any study or data generated that focuses on student achievement by those receiving waivers. 1. Assessment of Impact of Waivers.In order to ensure student success and achievement,the extension of waivers will be assessed on a regular basis by FIU. Thus,the submission of data by high schools on a timely manner is imperative and required. The waivers will only be allowed in the case that M-DCPS provides additional support to students to ensure their success. This support can take the form, for example,of tutorials or the implementation by M-DCPS of a mentorship program. i• FlU has the prerogative to'cancel or mods the extension of waivers if the M-DCPS data collected and submitted to FIU indicate that the waivers do not support student achievement and success. C. Marketing and Other Operational Matters. FIU and the M-DCPS will work collaboratively to market the programs,provide staff development,transition students,evaluate courses and assess overall results. D. Guidance. FIU and the M-DCPS will work collaboratively to provide guidance and monitor dually enrolled students. E. payment. The high schools shall pay FIU$1,500 for academic monitoring and oversight fees per unique dual enrollment course by high school instructional staff who serve as courtesy appointment lecturer for FIU. Additionally,if an FIU faculty or adjunct instructor is hired to teach a class on a high school campus, a fee of$5,000 will be charged to the high schools for the • provision of educational services. The adjunct instructor will provide instruction consistent with • the M-DCPS' school calendar and schedule,unless otherwise agreed upon in writing by the school site principal.The$1,500 fee is waived for academic monitoring and oversight when a FIU faculty or adjunct instructor teaches the course. FIU's APA will invoice the District for these academic • monitoring and oversight fees two(2)weeks after the registration period has ended. Special Note: In terMs of future annual Dual Enrollment agreements, academic monitoring and oversight fees, FlUfaculty/adjunct cost, and/or the introduction of other fees, will be re-evaluated annually in spring terms within the context of FIU's availability of resources. Furthermore, depending on the availability of such resources, any proposed change in the fee structure will be communicated in advance, and in writing, to M-DCPS prior to the renewal of Dual Enrollment agreement(s). 1. Payment Modality. FIU's APA will be responsible for the invoicing of academic monitoring and oversight fees tied to the dual enrollment offered via the FIU credentialed courtesy instructors. In addition,FIU's APA will invoice cost per term 26 i i for the dual enrollment offered via FIU's university faculty/adjuncts directly on the j r high school campus. The invoicing and payment procedures currently in place will govern the payment processes. Payment must be received from M-DCPS in a timely manner(i.e.,within 60 days of the receipt of the invoice by M-DCPS). e• Failure to pay in a timely manner as stipulated above could lead to the assessment on M-DCPS of i • a late payment fee of five (5)percent of the pending balance. Failure to pay may be considered a breach of contract for which FIU may terminate the Agreement based on the provisions of Section 4.04'("Termination"). F. Teacher Credentialing.In accordance with FIU faculty credentialing requirements,a college-level instructor must have at least a master's degree in the teaching discipline or a master's degree with a concentration in the teaching discipline(a minimum of 18 graduate semester hours in the teaching discipline). (Refer to Appendix E.) High schools requesting to teach a dual enrollment course should send the name of the course requested,proposed instructors' curricula vitae,and official transcripts to FIU's APA Dual Enrollment staff.The credentialing and course approval process for dual enrollment courtesy appointment lecturers occurs in the academic unit. . M-DCPS must follow FlU's APA's dual enrollment guidelines and meet deadlines for course requests and student registration period. Qualified teachers will receive courtesy appointments to teach college-level courses at the high schools under the supervision of the pertinent FIU academic unit. Courtesy appointments do not receive financial compensation from FIU. 1. Per s. 1007.271,F.S.,each courtesy lecturer credentialed by FIU must provide a copy of the current syllabus for each course taught to the FIU department chair,before the start of each term. The content of each syllabus must meet the same standards required for all college-level courses offered by FIU. 2. In the case that a credentialed instructor is expected to go on leave for whatever reason,M-DCPS will notify FIU with ample time, ideally,a semester prior to the leave,to allow other resources to be identified to replace the courtesy lecturers. G. Evaluation.Dual enrollment courses taught directly at high schools will need to abide by the following terms: 1)the evaluation of the courtesy appointment instructor by FIU,and 2)the submission of artifacts of student work for FIU evaluation purposes(as part of the University Core Curriculum course assessment required by the Southern Association of Colleges and Schools Commission on Colleges [SACSCOC]). FIU mentors shall collect from the courtesy appointment lecturer at the high school a sample of the completed artifacts per the FIU college and/or school requirements of all course enrollment across all sessions(periods)taught, including random sample(s)from each session.In addition,Florida Statute,as modified by Chancellor's Memorandum,CM-95-06,requires that every course taught by FIU must be evaluated by its 27 students. The results of eight(8)of the questions in the Student Assessment of Instruction must be made public and may be accessed through FIU's website. The results of the remaining I I questions and the student comments are not made public and are available only to the instructor, the FIU department chair,and any others from FIU involved in the Professional Development, Mentoring,and Oversight Program. H. Professional Development,Mentoring,and Oversight. FIU has instituted a - t-" Professional Development,Mentoring,and Oversight Dual Enrollment Program to ensure the courtesy lecturers are prepared to teach an FIU course. FIU will use some,or all,of the oversight activities listed below to determine any additional needed professional development and/or mentoring:a)announced classroom visitation(observation of teaching and structured feedback using rubrics),b)review of syllabi (examining syllabi for all FIU specified components to ensure that syllabi provide sufficient details to students including plagiarism and academic misconduct policy),c)review of other teaching materials(PowerPoints,handouts, lesson plans or lecture notes,use of primary and secondary sources,etc.),d)assessment of student learning(rubrics used for each type of student assignment and feedback provided to students for improvement-graded and ungraded student work), and,e)review of exams/quizzes,and other types of student assessment(student artifacts like homework,electronic or paper portfolios, essays,reports,term I :" papers,oral and/or video recordings of student performance).For purposes of assessment processes,the courtesy lecturer will need to save two(2)years' worth of student papers and exams as these may need to be collected for an on-campus review. 1. Dual Enrollment Faculty Mentor Handbook. FIU has developed a guide to support the oversight activities of FIU-assigned faculty mentors. These mentors provide academic oversight and coaching feedback to credentialed courtesy lecturers delivering FIU courses at high schools. 2. FIU Professional Developmen Training. Courtesy appointment lecturers teaching FIU dual enrollment courses at high schools are required to participate in two(2) annual professional development training programs,as these training opportunities become available on FIU's campus or FIU-designated venue. a. Training,on an optional basis,will be provided to M-DCPS' counselors and Dual Enrollment coordinators within the annual training forums held for courtesy appointment lecturers. 3. FIU will provide M-DCPS' Division of Academics, Office of Academics and Transformation,Department of Advanced Academic Programs copies of FIU's academic units'reports,by means of spreadsheets,tied to academic monitoring and oversight.These oversight spreadsheets will be submitted to M-DCPS at least 60 28 � i . calendar days after the semester. Additionally,these spreadsheets will summarize findings of students'course evaluations and teachers' surveys. M-DCPS agrees that reports prepared by FlU academic units and Academic Planning and Accountability written summaries will only be used for the continued development •and improvement of the high school dual enrollment program.As such,reports will not be used as part of the M-DCPS teachers'formal evaluation and/or process. I. Student Educational Records. Refer to Section 3.09 C for more information. J. Student Safety and Security. High schools are responsible for developing policies and procedures to ensure the safety and security of students. Students must be made aware of all procedures and contingency plans in case of emergency situation(s). K. Library Resources. To support the learning experience,FIU will extend library resources to its off-campus dual enrollment students via FlU online library resources and databases. L. Advising Services. Depending on availability of resources,FIU will offer academic advising to dual enrollment students, collaborating closely with guidance counselors and/or Dual Enrollment coordinators of schools. M. Academic Grievance(s). Refer to 3.07 for more information. N. Course Syllabus. All dual enrollment courses taught at high schools will follow Fill's course outline(s) and the same procedures for courses taught on the FIU campus(es). 1. All dual enrollment courtesy lecturers are required to provide students with course • syllabi. Syllabi must contain(at minimum)the following information: • the course name,course and section numbers,course description,course objectives and learning outcomes,prerequisites and co-requisites(if any),and semester and year offered; 1-• • the instructor's name,telephone number,e-mail address,department or school, office location and office hours; • required purchases,as applicable,including texts(including ISBN), lab supplies, artistic supplies,professional and ancillary items; • a tentative outline including major topics,anticipated dates of assignments, performances,artistic submissions,&/or exams; • performance measures that will be considered for evaluation in awarding final grades; • any policies of the instructor and/or department that may impact.a student's enrollment or final grade; •• • how the final grade is to be calculated(please review information below on 29 FIU's revised grading scale); and, • attendance standards, if required. 2. FIU Revised Grading Scale as of Fall 2016: Grade Points Per Credit Hour: A 4.00 �. A- 3.67 B+ 3.33 B 3.00 B- 2.67 • C+ 2.33 C 2.00 D 1.00 F 0.00 Special Note: While appropriate for college-level study,course materials and class discussions may reflect topics not typically included in high school secondary courses, • which some parents may consider advanced for minors. Courses will not be modified to accommodate variations in student age and/or maturity. O. Tonal Enrollment Off-site High School Course Limitation. In keeping with the •• notification requirements of SACSCOC's Substantive Change Policy,FIU can offer less than 49 percent(57 credits) of degree programs through its M-DCPS partner schools. No more than 19 different course titles may be offered on a high school campus over a three-(3)year period. Several sections of the same M-DCPS course are only counted as one(1)offering. Adherence to • • the course limitation policy would be strictly monitored by FIU's APA's Dual Enrollment staff. Any breach of this policy could signal the termination of the Agreement. P. Restriction. In order to comply with Section 1007.271,Florida Statutes,dual enrollment courses taught on a school campus may not be combined with any non-college credit high school course.Through the M-DCPS' communication system,Division of Academics, Office of Academics and Transformation,Department of Advanced Academic Programs will annually notify schools, in writing,that dual enrollment courses cannot be combined with any non-college credit high school course.The written communication will be sent to APA once it has been 30 ` 1. I disseminated for APA's records. On a semester's basis,high school principals must attest in writing that dual enrollment courses are not being combined with any non-college,credit high school course. The attestation must be sent to FIU's APA's Dual Enrollment staff within the timetable and procedure established and communicated to the principals. Q. Credits. Credits and grade points will be assigned according to policies established by FIU -. and M-DCPS based on State statutes. l: 1. Transmission of Student Grades in Dual Enrollment Courses. All students enrolled in dual enrollment classes will be graded on the same basis as other college students in the same courses. Students participating in FIU dual enrollment courses at high schools will receive grades and credit for their college work. These grades and credits are posted on the college transcript. Dual enrollment course grades become part of a student's permanent college and high school transcript and are calculated into the student's permanent postsecondary • GPA maintained by FIU. Entering students' grades is the responsibility of the FN courtesy lecturers or FIU adjunct instructors/faculty. R. Materials and Equipment. The M-DCPS shall provide dual enrollment students, free of charge,required college textbooks and other instructional materials to students in accordance with Section 1007.271 (14),Florida Statutes. 1. In order to be in compliance with the SACSCOC principle 3.4.9 related to Academic Support Services,high schools must provide adequate technology in the classrooms to support college-level instruction.FIU's APA will collaborate closely with the schools to verify that the technology available is adequate. In addition,FlU's APA will conduct visits to further verify a)the adequacy and b)the maintenance of such adequacy.FIU will have the right to cancel any course offering that does not meet requirements . regarding the adequacy of technology. Students must have access to computers and/or computer labs to complete assignments outside of class periods. • S. Courses. Dual enrollment courses for students in the aforementioned special programs, as applicable,may exceed those described in the link provided in Appendix B,as outlined in the • programs' published scope and sequence. T. Class Size. FIU has set maximum number of students allowed in Dual Enrollment courses. Maximum class size is found on the current listing of approved course offerings for M- DCPS high schools. (Refer to Appendix D.) The requirement must be met. High schools must provide,in writing, on a semester's basis to APA the number of sections offered based on class 31 rolls. This information must be provided prior to the implementation of sections. HU has the prerogative to cancel any course(s) that breach the class size requirements. 3.16 Joint Responsibilities Accelerated Mechanisms. A. FIU and M-DCPS warrant and agree that all dual enrollment courses shall meet the provisions of the current State of Florida laws and regulations. FIU and M-DCPS shall establish budgetary procedures to support specialized dual enrollment programs that will include the following provisions: 1. Students enrolled in dual enrollment may be included in the calculation of full-time student membership of the basic program of grades six(6)-12 by M-DCPS. 2. Students enrolled in dual enrollment instruction may be counted as full-time equivalent by FIU. 3. Dual enrollment courses are free to students who attend a Florida public college or university;this includes registration,matriculation, or laboratory fees for courses taken I, through dual enrollment. Instructional materials(such as books)are provided to public school students free of charge;however,students enrolled in home education programs or non-public secondary schools must provide their own materials. 4. Dual enrollment college credit will transfer to any Florida public college or university offering a course with the same prefix and number and must be treated as though taken at the receiving institution.If students do not, upon high school graduation, • attend the same college or university where they earned the dual enrollment credit,the application of transfer credit to general education,prerequisite,and degree programs • may vary at the receiving institution. Students and parents need to be informed of this caveat. • B. When a student with special needs has been accepted into the dual enrollment program at FIU and attends dual enrollment courses on a M-DCPS site,M-DCPS will cover the cost of the provision of the accommodations determined necessary per the Exceptional Student Education/Americans with Disabilities Act(ESE/ADA)(according to the student's Individual Education PIan or 504 Plan). When a student with special needs has been accepted into the dual enrollment program at FIU and attends dual enrollment courses on the FIU campus,the student must register with FlU's Disability Resource Center(DRC)to coordinate academic accommodations. Accommodations are • determined on a case-by-case basis and vary based on the faculty course design. Each and every 32 semester, students with special needs are provided the opportunity to request or decline the provision of academic accommodations. Students must complete and submit the Notification of Academic Accommodations form to the DRC. This form and additional information about DRC services are available at: http://studentaffairs.fiu.edu/get-support/disability-resource- center/request-accommodations/index.php 3.17 Transportation. All students must provide their own transportation. Bus services to FIU campuses)for eligible AAA students,however,will be provided by M-DCPS. Students parking on FIU campus(es)are subject to a decal fee,payable by students,to FIU. ARTICLE 4-GENERAL CONDITIONS 4.01 No Waiver of Sovereign Immunity. Nothing contained in this Agreement is intended to serve as a waiver of sovereign immunity by any agency or political subdivision to which • sovereign immunity may be applicable. 4.02 No Third Party Beneficiaries. The Parties expressly acknowledge that it is not their • intent to create or confer any rights or obligations in or upon any third Party person or entity under this Agreement.None of the Parties intend to directly or substantially benefit a third Party by this Agreement.The Parties agree that there are no third Party beneficiaries to this Agreement and that no third Party shall be entitled to assert a claim against any of the Parties based upon this • Agreement.Nothing herein shall be construed as consent by an agency or political subdivision of the State of Florida to be sued by third Parties in any matter arising out of any contract.. 4.03 Non-Discrimination.The Parties shall not discriminate against any employee or participant in the performance of the duties,responsibilities,and obligations under this Agreement because of race,age,religion, color,gender,national origin,marital status,disability,or sexual orientation. 4.04 Termination. This Agreement may be cancelled with or without cause by any Party during the term hereof upon 30 days'written notice to the other Party of its desire to terminate this ## Agreement.Any student enrolled at the time of termination would be permitted to complete the class in which he/she is enrolled. 4.05 Records.Each Party shall maintain its own respective records and documents associated • with this Agreement in accordance with the records retention requirements applicable to public records. Each Party shall be responsible for compliance with any public documents request served upon it pursuant to Chapter 119,Florida Statutes,and any resultant award of attorney's fees for non-compliance with that law. This J agreement supersedes any other agreement in place and nullifies any such agreement(s). Accordingly,the Parties agree that no deviation from the terms hereof shall be predicated upon any prior representations or agreements,whether oral or written. 4.07 Amendments. No modification,amendment,or alteration in the terms or conditions • contained herein shall be effective unless contained in a written document prepared with the same or similar formality as this Agreement and executed by each party hereto. 4.08 Prenaration of Agreement. The Parties acknowledge that they have sought and obtained whatever competent advice and counsel as was necessary to form a full and complete understanding of all rights and obligations herein and that the preparation of this Agreement has been their joint effort.The language agreed to herein express their mutual intent and the resulting • document shall not, solely as a matter of judicial construction,be construed more severely against • one of the Parties than the other. 4.09 Waiver. The Parties agree that each requirement,duty and obligation set forth herein are substantial and important to the formation of this Agreement,and therefore,are material terms 34 hereof. (Any Party's failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision or modification of this Agreement.) A waiver of any breach of a provision of this Agreement shall not be deemed a waiver of any subsequent breach and shall not be construed to be a modification of the terms of this Agreement. 4.10 Compliance with Laws. Each Party shall comply with all applicable federal and state laws, codes,rules,and regulations in performing its duties,responsibilities,and obligations pursuant to this Agreement. This Agreement will be amended,as necessary,to comply with • regulations or policies of FIU,the State of Florida,the Florida Board of Governors-and/or SACSCOC, as they might be revised from time to time. 4.11 Support Personnel. In connection with this Agreement, special services such as those provided by counselors,visiting teachers,school social workers,and occupational/placement specialists,will be provided by M-DCPS' student services staff members at appropriate regional offices. 4.12 Governing Law.This Agreement shall be interpreted and construed in accordance with, and governed by,the laws of the State of Florida. Any controversies or legal problems arising out of this Agreement and any action involving the enforcement or interpretation of any rights hereunder shall be submitted to the jurisdiction of the State courts of Miami-Dade County Florida. FIU is subject to s. 1007.271,F.S.regarding dual enrollment. Each party is responsible for its own attorney fees. I�I 4.13 Binding Effect. This Agreement shall be binding upon and inure to the benefit of the i • Parties hereto and their respective successors and assigns. 4.14 Assignment. Neither this Agreement nor any interest herein may be assigned, {.- transferred,or encumbered by any Party without the prior written consent of the other Party. There shall be no partial assignments of this Agreement including,without limitation,the partial assignment of any right to receive payments from M-DCPS and FIU. 4.15 Force Majeure. If, as a result of an act of force majeure, including without limitation, an act of God,war, internal unrest and upheaval,hurricane or natural disaster,hurricane warning or hurricane watch issued by the US National Weather Service,tropical storm watch or tropical storm warning issued by the US National Weather Service,riot,labor dispute, strike,threat thereof, intervention of a government agency or instrumentality or other occurrence beyond the reasonable control of either organization, either M-DCPS or FIU is hindered in performing its obligations hereunder or is thereby rendered unable to perform its obligation hereunder,then,in such event, that organization shall have the right,upon notifying the other of the occurrence of force majeure as herein defined,to suspend or postpone performance of the activity until the event of the force 35 t ' majeure has passed.In the event that either M-DCPS or FIU is unable to perform for a period in • excess of six(6)months at any time after the commencement date of this Agreement,the other Party may, at its option terminate.the Agreement.In the case that conditions improve and warrant :. the resumption of activities and deployment of educational programs and services,FIU and M- DCPS would have at least one(1)month to coordinate the resumption of activities per this . • Agreement. In no event shall a lack of funds on the part of either Party be deemed a force majeure. 4.16 place of Performance. In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid, illegal,unlawful,unenforceable or void in any respect, the invalidity, illegality, unenforceability or unlawful or void nature of that provision shall not affect any other provision and this Agreement and shall be considered as if such invalid, illegal, unlawful,unenforceable or void provision had never been included herein. 4.18 Use of Logos and Brands. A. Except as otherwise authorized in writing by FIU, M-DCPS shall do business in its own name and shall not trade upon the name or credit of FIU. All brochures,advertisements, website materials, or other solicitations for the dual enrollment program that include reference to FIU, regardless of medium and language, shall be subject to FIU's prior written approval. All information posted on websites and promotional materials must be updated regularly and • • accurately to reflect the nature and requirements of the dual enrollment program. The Parties agree that upon FIU's request, any information presented by the other Party in its publications � • and advertisements, including website information that is inaccurate or not supported by facts, • regardless of the language used, shall be immediately retracted and/or withdrawn. This • Agreement confers no rights upon M-DCPS to use the logos, marks and likeness of FIU in any advertising except as authorized by FIU in writing. • B. Except as otherwise authorized in writing by M-DCPS, FIU shall do business in its own name and shall not trade upon the name or credit of M-DCPS. All brochures, advertisements, website materials, or other solicitations for the program that include reference to the M-DCPS shall be subject to M-DCPS's prior written approval. This Agreement confers no rights upon FIU to use the logos,marks and likeness of M-DCPS in any advertising other than for the dual enrollment program and in a manner consistent with the provisions of this € paragraph. 36 : C. Neither FIU nor M-DCPS may use the SACSCOC logo. The use of this logo is reserved exclusively for SACSCOC. 4.19 Notice. When any of the Parties desire to give notice to the other, such notice must be • in writing, sent by US Mail, postage prepaid, addressed to the Party for whom it is intended at the place last specified; the place for giving notice shall remain such until it is changed by written notice in compliance with the provisions of this paragraph. Under this Agreement, FIU personnel will not require access to M-DCPS school grounds nor require direct contact with M-DCPS school students beyond the scope of its post-secondary curriculum delivered at an FIU classroom facility or at an offsite high school. With hundreds of dual enrollment courses available,there is great potential to further • engage and motivate students to pursue academically rigorous courses that capture their interests. Successful completion of dual enrollment courses allows eligible school students to simultaneously earn high school core or elective credit and postsecondary credit toward a career certificate,an associate degree,or a baccalaureate degree. Dual enrollment courses will receive the same weighting for the high school grade point average as Advanced Placement(AP),International Baccalaureate(IB),and Advanced International Certificate of Education(AICE) courses.In addition,dual enrollment courses that meet core state university admission requirements in English/Language Arts,Mathematics,Natural Sciences, Social Sciences,or World languages shall receive the same weighting as AP,IB, and AICE courses in the calculation of the high school grade point average used for admission decisions. Students should understand,however,that dual enrollment courses are college-level courses,and the amount of work and rigor of content in dual enrollment courses may be much greater than in high school courses.In addition,dual enrollment course grades become a part of a student's permanent college transcript and are calculated into the student's permanent postsecondary grade point average. Poor performance in dual enrollment courses may affect university admissions and financial aid.It is important to do well in these courses to realize the benefits of dual enrollment. Course selection is important for the dual enrollment student since different programs at a college require different courses to complete the certificate or degree.By choosing courses wisely,students can • reduce the time it takes to complete a program after high school graduation.Some students are even able to complete their college certificate or degree at the same time they graduate from high school. Students who don't know what they want to study in college should consult with an advisor to consider focusing on completing general education requirements in communications,mathematics,social • sciences,natural sciences,and humanities.All degree programs require general education coursework and,while there is some variation from institution to institution,there are general education courses that are common among most,if not all, institutions. Florida dual enrollment college credit will transfer to any Florida public college or university offering the Statewide Course Numbering System course number,and must be treated as though taken at the receiving institution.However,if students do not attend the same college or university where they earned the dual enrollment credit the application of transfer credit to general education,prerequisite, and degree programs may vary at the receiving institution.Private and out-of-state colleges and universities may or may not grant college credit for courses taken through dual enrollment.
