RESOLUTION NO, 80-16184 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH TRAMS ELECTRIC OF FLORIDA, INC. WHEREAS, for the reasons more particularly set forth in Commission Memorandum No.7984 , the City Commission of the City of Miami Beach deems it in the best interest of the citizens of Miami Beach to enter into an agreement with TRAMS ELECTRIC OF FLORIDA, INC. , the terms of which are familiar to the City Commis- sion and which contract is included in the agenda package for the meeting at which this Resolution was adopted; and WHEREAS, the City Manager recommends the City enter into said agreement and the City Attorney has approved same as to form and legal sufficiency; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMIS- SION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager and City Clerk be and they are hereby authorized and directed to enter into said agreement for and on behalf of the City of Miami Beach. Toal City Manager SUBJECT: RATIFICATION OF ADMINISTRATIVE AGREEMENT AND AMENDMENTS COVERING EMERGENCY TRAM SERVICE ON LINCOLN ROAD MALL On October 3, 1979, the Commission instructed the Administration to re-establish tram service on the Lincoln Road Mall on an emergency basis as a result of the default of the prior contractor The Administration subsequently negotiated with Trams Electric of Florida and the City Manager executed an emergency agreement with that firm to allow for re-establishment of service. A copy of tha agreement is attached. Draft specifications were prepared for the re-bid of the base cont but the specifications and bidding process could not be completed time for the March 11, 1980 election at which time the contract wo have been placed before the voters as required by the city charter The next scheduled election is in November 1980 and provisions mus be made to continue the Lincoln Road Mall Tram Service to about December 15, 1980 at which time the formal contract should be ap- proved by the electorate and the new contractor ready for operatio Because of the delay, the initial emergency agreement is submitted for Commission approval with an amendment extending the term from the original 90 days and eliminating certain city subsidies con- tained in the original agreement. A summary of the agreement and amendment is attached. ADMINISTRATION RECOMMENDATION That the agreement and amendment be approved by the Commission.
