A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, FOLLOWING A DULY PUBLISHED NOTICED PUBLIC HEARING, AS
REQUIRED PURSUANT TO SECTION 82-93(B) OF THE CITY CODE, FINDING THAT THE
CRITERIA SET FORTH IN SECTION 82-94 OF THE CITY CODE HAS BEEN SATISFIED,
AND APPROVING A REVOCABLE PERMIT REQUEST BY 420 LINCOLN ROAD
DEVELOPMENT, LLC, OWNER OF THE PROPERTY LOCATED AT 1601 DREXEL
AVENUE, MIAMI BEACH (THE "PROPERTY"), TO ALLOW THE THREE (3) PROJECTING
SIGNS THAT EXIST ON THE PROPERTY, AND WHICH ENCROACH UPON THE CITY'S
RIGHT OF WAY, AS FOLLOWS: (1) THE FIRST EXISTING SIGN IS LOCATED AT THE
NORTHERNMOST SECTION OF THE WEST FACADE OF THE PROPERTY, ALONG
DREXEL AVENUE, AND ENCROACHES APPROXIMATELY THREE FEET EIGHT INCHES
(3'-8") BY ONE FOOT TEN INCHES (1'- 10") IN WIDTH; (2) THE SECOND EXISTING
SIGN IS LOCATED AT THE EASTERNMOST SECTION OF THE SOUTH FACADE OF THE

DIRECTLY BELOW THE SECOND SIGN, AND ENCROACHES FOUR FEET (4') BY ONE
FOOT (1') IN WIDTH OVER THE PUBLIC RIGHT-OF-WAY; AND AUTHORIZING THE
MAYOR AND THE CITY CLERK TO EXECUTE THE REVOCABLE PERMIT.
WHEREAS, 420 Lincoln Road Development, LLC (the "Applicant") is the owner of
the property located at 1601 Drexel Avenue (the "Property") in Miami Beach, and is
requesting a revocable permit to allow the encroachment of three (3) existing projecting
signs; and
WHEREAS, the first existing sign is located along the northernmost section of the
west facade of the building, along Drexel Avenue, and encroaches approximately three
feet eight inches (3'-8") by one foot ten inches (1'- 10") in width; and
WHEREAS, the second sign is located along the easternmost section of the south
facade, along 16th Street, and encroaches approximately three feet eight inches (3'-8") by
one foot ten inches (1'- 10") in width (the "Second Sign"); and
WHEREAS, the third sign is also located along the easternmost section of the
south facade, along 16th Street, directly below the Second Sign, and encroaches four feet
(4') by one foot (1') in width into the right-of-way;
WHEREAS, this permit request is compliant with development approvals granted
by the Planning Board ("PB") on May 23, 2017 and Historic Preservation Board ("HPB") on
March 13, 2017 (the "Prior Orders"); and
WHEREAS, the Prior Orders approved the use of the Property as a restaurant to
be operated by Time Out Market and, like all restaurants in Miami Beach, Time Out Market
desires to provide signage on site so that patrons can recognize and locate the restaurant;
and
WHEREAS, the final signs require a 4' x 1'-10" encroachment into the abutting
public right-of-way along 16th Street and Drexel Avenue, respectively; and
WHEREAS, pursuant to Section 82-93(a) of the City Code, notices of the public
hearing have been mailed to owners of land lying within 375 feet of the existing permit
area at least 15 days prior to the public hearing; and
WHEREAS, Public Works has analyzed the criteria contained in Sections 82-94;
and
WHEREAS, pursuant to Section 82-94 of the City Code, the City Commission
shall
review the revocable permit request and determine whether the request shall be granted
or denied following the public hearing;
WHEREAS, the Public Works Department's review, and recommendation to grant the
Permit request is set forth in the Commission Memorandum accompanying this Resolution,
which Memorandum is incorporated by reference herein.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, following a duly published noticed public
hearing, as required pursuant to Section 82-93(b) of the City Code, find that the criteria set
forth in Section 82-94 of the City Code has been satisfied, and approve a revocable permit
request by 420 Lincoln Road Development, LLC, owner of the property located at 1601 Drexel
Avenue, Miami Beach (the "Property"), to allow the three (3) projecting signs that exist on the
Property, and which encroach upon the City's right of way, as follows: (1) the first existing sign
is located at the northernmost section of the west facade of the Property, along Drexel
Avenue, and encroaches approximately three feet eight inches (3'-8") by one foot ten
inches (1'- 10") in width; (2) the second existing sign is located at the easternmost section of
the south facade of the Property, along 16th street, and encroaches approximately three feet
eight inches (3'-8") by one foot ten inches (1'- 10") in width (the "Second Sign"); and (3) the
third existing sign is located at the easternmost section of the south facade of the Property,
along 16th street, directly below the Second Sign, and encroaches four feet (4') by one foot (1')
in width over the public right-of-way; and authorize the Mayor and the City Clerk to execute

RECOMMENDATION
The Administration recommends approving the Resolution.
ANALYSIS
420 Lincoln Road Development, LLC (the "Applicant") is the owner of the property located at
1601 Drexel Avenue (the "Property") in Miami Beach, and is requesting a revocable permit to
allow the encroachment of three (3) existing projecting signs.
The first existing sign is located along the northernmost section of the west facade of the

building, along Drexel Avenue, and encroaches approximately three feet eight inches (3'-8") by
one foot ten inches (1'- 10") in width. The second sign is located along the easternmost section
of the south facade, along 16th Street, and encroaches approximately three feet eight inches
(3'-8") by one foot ten inches (1'- 10") in width (the "Second Sign"). The third sign is also
located along the easternmost section of the south facade, along 16th Street, directly below the
Second Sign, and encroaches four feet (4') by one foot(1') in width into the right-of-way.
This permit request is compliant with development approvals granted by the Planning Board
("PB") on May 23, 2017 and Historic Preservation Board ("HPB")on March 13, 2017 (the "Prior
Orders").
The Prior Orders approved the use of the Property as a restaurant to be operated by Time Out
Market and, like all restaurants in Miami Beach, Time Out Market desires to provide signage on
site so that patrons can recognize and locate the restaurant. The final signs require a 4' x 1-10"
and a 3'-8" x 1,-10" encroachment into the abutting public right-of-way along 16th Street and
Drexel Avenue, respectively.
Pursuant to Section 82-93(a) of the City Code, notices of the public hearing have been mailed
to owners of land lying within 375 feet of the existing permit area at least 15 days prior to the
public hearing. Public Works has analyzed the criteria contained in Sections 82-94.
Additionally, Pursuant to Section 82-94, of the City Code, the City Commission shall review the
revocable permit request and determine whether the request shall be granted or denied based
upon the following criteria:
(1) That the applicant's need is substantial.
The Applicant respectfully requests the revocable permit in order to provide necessary signage
for the success of the restaurant use approved by the Prior Orders. Signage is a critical
component of any business' success. The success of any business relies, in part, on providing
signage that is clearly visible and identifiable. The Property is also located in an area where
vehicular traffic is prominent. Therefore, visible signage is critical. The proposed signage
complies with all City regulations and provides the necessary visibility to make this a successful
site.
Part of the success of this project requires viable tenants that are prepared to make a long term
commitment to Miami Beach. In order for those tenants to succeed in this City, they need
visibility and name recognition. The proposed signage meets all the requirements of the Code
and affords the tenant visibility for vehicular and pedestrian traffic, and provides brand
recognition, which draws in the clientele. The revocable permit will allow for an overhang to
slightly encroach on the City's right-of-way and in turn permit the provision of necessary, visible
sig nage.
(2) That the applicant holds title to the abutting property.
The Applicant owns the Property.
(3) That the proposed improvements comply with applicable codes, ordinances, regulations,
neighborhood plans and laws.

The proposed overhang will comply with applicable codes, ordinances, regulations,
neighborhood plans and laws. The Applicant has requested a revocable permit to ensure that
encroachment of the required overhang complies with the applicable regulations.
(4) That the grant of such permit will have no adverse effect on governmental/utility easements
and uses on the city property.
The grant of the revocable permit will allow the Applicant to improve the Property with the
approved design. The encroachment will be installed at an appropriate height, allowing for a
minimum clearance of 14' — 3", which permits free pedestrian passage below the overhang and
does not obstruct the right-of-way. The encroachment will have no adverse effect on
governmental/utility easements and uses on the property.
(5) That the grant of the revocable permit will enhance the neighborhood and/or community with
such amenities as, for example, but without limiting the foregoing, enhanced landscaping,
improved drainage, improved lighting, and improved security, and/or public benefits proffered by
the applicant;
The proposed encroachment will allow for the use of the Property as approved by the HPB and
PB. Additionally, the Applicant is providing key public benefits through the provision of parking at
the existing parking garage as well as improved landscaping around the Property. Not only does
this site provide parking for Miami Beach residents and visitors, but the Applicant also intends to
improve the two planters located directly in front o the entry doors to the Time Out Market
space. Specifically, the planters located on the City's right-of-way, northeast corner of 16th
Street and Drexel Avenue. The Applicant proposes to improve the area around the existing
trees with add-a-pave or similar type product, as approved by the City, as well as perennial
peanut grass. The approved development will make better use of the Property and improve the
pedestrian experience of the neighborhood.
(6) That granting the revocable permit requested will not confer on the applicant any special
privilege that is denied by this article to other owner of land, structures or buildings subject to
similar conditions located in the same zoning district.
Granting the revocable permit will not confer any special privilege upon the Applicant. Any
property owner within the City of Miami Beach can apply for a revocable permit provided that the
application meets the criteria stated in the Code, does not interfere with the utilization of public
property, and enhances the community.
(7) That granting the revocable permit will be in harmony with the general intent and purpose of
this article, and that such revocable permit will not be injurious to surrounding properties, the
neighborhood, or otherwise detrimental to the public welfare. In order to grant a revocable
permit, the city commission must make an affirmative finding with respect to each of the criteria
set forth above. These findings may be made by one motion addressed to all findings or, at the
request of any member of the commission, a finding or findings shall be considered separately.
The revocable permit application shall be considered as a whole unless any member of the city
commission shall request that the application be considered in parts, in which event the
application shall be considered in such parts as requested. In light of the particular
circumstances involved with each separate revocable permit request, the grant of any revocable
permit shall not constitute or be deemed a precedent for the grant of any other revocable permit;
and

Granting the revocable permit will not devalue any of the adjacent properties and will not have a
detrimental effect on the public welfare. In fact, it will allow for an improved design upon the
Property and a favorable use in the neighborhood.
CONCLUSION
The Administration recommends approving the Resolution.

Avenue and 16th Street. Pursuant to the City's Zoning Map, the Property is zoned
CD-3, High Intensity Commercial Zoning District, and is located within the
Flamingo Park Local Historic District.
Approved Development. The Prior Orders approved the use of the
Property as restaurant to be operated by Time Out Market. Like all restaurants in
Miami Beach, Time Out Market, desires to provide signage on site so that patrons
can recognize and locate the restaurant. Additionally, two (2) of the signs will
provide the necessary signage for the existing parking garage. See Exhibit A,
Existing Sign Rendering. Accordingly, the Applicant seeks a Revocable Permit in
accordance with Section 82-94 of the Code to allow this minor encroachment for
the existing signs.
Satisfaction of the Revocable Permit Criteria. The City Code provides the
ability to obtain a revocable permit for encroachments into the public rights of
way. The Applicant satisfies the revocable permit criteria stated in Section 82-94
of the City Code as follows:

in the clientele. The revocable permit will allow for an overhang to slightly
encroach on the City's right of way and in turn permit the provision of necessary
visible signage.

The Applicant owns the Property.
• The proposed improvements will comply with applicable codes,
ordinances,regulations, neighborhood plans and laws.
The existing signs will comply with applicable codes, ordinances,
regulations, neighborhood plans and laws, as evidenced by the HPB and PB
approvals. The Applicant has requested a revocable permit to ensure that
encroachment of the existing signs complies with the applicable regulations.
• The grant of the application will have no adverse effect on
governmental/utility easements and uses on the property.
The grant of the revocable permit will allow the Applicant to improve the
Property with the approved design. The encroachments will be installed at an
appropriate height,allowing for a minimum clearance of 14'3",which permits free
pedestrian passage below the signage and does not obstruct the right-of-way. The
encroachment will have no adverse effect on governmental/utility easements and
uses on the property.
• That the grant of the revocable permit will enhance the
neighborhood and/or community by such amenities as, for
example, enhanced landscaping, improved drainage, improved
lighting, and improved security.
The proposed encroachment will allow for the use of the Property as
approved by the HPB and PB. Additionally,the Applicant is providing key public
benefits through the provision of parking at the existing parking garage as well as
improved landscaping around the Property. Not only does this site provide
parking for Miami Beach residents and visitors, but the Applicant also intends to
improve the two planters located directly in front of the entry doors to the Time
Out Market space. Specifically, the planters located on the City's right-of-way,
northeast corner of 16th Street and Drexel Avenue, as well as the existing planter
located on the City's right-of-way, along the northeast corner of Drexel Avenue
and 16th Street. Both planters measure approximately five feet by five feet (5' x5').
The Applicant proposes to improve the area around the existing trees with add-a-
pave or similar type product, as approved by the City, as well as Perennial Peanut
grass. The approved development will make better use of the Property and
improve the pedestrian experience of the neighborhood.

• That granting the revocable permit requested will not confer on
the applicant any special privilege that is denied by this article to
other owner of land, structures or buildings subject to similar
conditions located in the same zoning district.
Granting the revocable permit will not confer any special privilege upon
the Applicant. Any property owner within the City of Miami Beach can apply for
a revocable permit provided that the application meets the criteria stated in the
Code, does not interfere with the utilization of public property, and enhances the
community.
• That granting the revocable permit will be in harmony with the
general intent and purpose of this article, and that such revocable
permit will not be injurious to surrounding properties, the
neighborhood, or otherwise detrimental to the public welfare.
Granting the revocable permit will not devalue any of the adjacent
properties and will not have a detrimental effect on the public welfare. In fact, it
will allow for an improved design upon the Property and a favorable use in the
neighborhood.
Conclusion. The approval of this revocable permit application is necessary
to successfully operate the approved restaurant use at the Property. We
respectfully request your recommendation of approval for the revocable permit to
allow the HPB and PB approved use and design to be carried out. We believe that
the granting of the revocable permit is compatible with the City's requirements
and will ultimately result in a great improvement to the Property and the

With the understanding that this Opinion of Title is furnished to the City of Miami Beach, as
inducement for acceptance of a Declaration of Use, Unity of Title, Declaration of
Restrictions, Development Agreement or as an inducement for acceptance of a subdivision
plat or tentative plat, covering the real property, or other land use approval hereinafter
described, it is hereby certified that I have examined that certain Title Search Report ("Title
Report") issued by First American Title Insurance Company, under FATIC File Number 1062-
4173533 covering the period from May 14, 1920 through February 8, 2019, at 8:00 am
