A RESOLUTION AUTHORIZING THE EXECUTION OF QUIT
CLAIM DEEDS OF A CERTAIN PORTION OF COLLINS AVENUE
AS ORIGINALLY DEDICATED ADJACENT TO THE EAST BOUND-
ARIES OF LOTS 9 , 10, 11 AND S . 1/2 OF 12 OF THE
AMENDED PLAT OF OCEAN FRONT SUBDIVISION; ACCEPTING
A PORTION OF THE OUTLETS AJOINING COLLINS AVENUE
ON THE WEST SIDE OF OUTLOTS 9 , 10, 11 AND S . 1/2
OF 12 OF THE AFOREMENTIONED SUBDIVISION.
WHEREAS, for the reasons more particularly set forth
in Commission Memorandum No. 8176 the City Commission of the
City of Miami Beach deems it In the best interest of said City
to execute the deeds attached hereto as Exhibits "A" and "B",
and accept the deed attached hereto and marked Exhibit "C" ; and
WHEREAS, the City Manager has recommended that the
City execute and accept said deeds and the City Attorney has
approved same as to from and legal sufficiency;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Clerk be and they are hereby authorized and directed to execute
deeds in the form attached hereto marked Exhibits "A" and "B" ,
and accept a deed in the form attached hereto marked as Exhibit
PASSED and ADOPTED this 23rd day of April , 1980 .

SUBJECT: Quit Claim Deeds of Excess Right-of-Way for Lots 9,
10, 11 and the South Half of Lot 12 of the Amended
Plat of First Oceanfront Subdivision
In 1965 the Department of Transportation realigned the new construc-
tion of Collins Avenue adjacent to the above property to preserve the
Crystal House landscaping. This was done at the request of the Crystal
House owner and resulted in excess right-of-way on the east side of
Collins Avenue. The Commission has established a precedent of return-
ing excess right-of-way to the abutting owners upon request when there
is no conflict with existing improvements , City utilities or other
City facilities . The return of excess right-of-way to abutting
property owners is an established practice of governments when a
determination is made that the right-of-way cannot be used for high-
way purposes or other public purposes .
The owners of the above lots have requested the City to deed the
excess right-of-way to the adjoining property with the City retain-
ing an easement for the maintenance and installation of utilities .
Also, they will deed to the City a similar tract of land on the west
side of Collins Avenue that presently is being used by the State for
highway purposes .
This proposal has been reviewed by the Public Works Department and
it has been determined that the excess right-of—way is not needed
for any highway purposes .
The City Attorney has reviewed this request along with the quit claim
deeds granting the excess right-of-way to the abutting property owners ,
and the quit claim deeds granting to the City the portions of the
outlots presently being used for highway purposes and advises that
the Commission, if it sees fit , authorize the execution of the quit
claim deeds .
The Administration recommends that the City Commission adopt the
attached resolution authorizing conveyance of the right-of-way in
question and authorize execution of the attached quit claim deeds
by the Mayor and City Clerk for and on behalf of the City of Miami
Beach, Florida, and accept the quit claim deeds granting the portion
of the outlots used for highway purposes to the City.

QUIT-CLAIM DEED
THIS QUIT-CLAIM DEED, Executed this 23rd day of
April. , A. D. , 1980 , by CITY OF MIAMI BEACH, a Florida
Municipal Corporation, first party to CRYSTAL HOUSE, INC. , f/k/a
5055 COLLINS , a CONDOMINIUM, INC. , a Florida corporation, not
for profit, second party:
(Wherever used herein the terms "first party" and
"second party" shall include and plural heirs,
legal representatives , and assigns of individuals
and the successors and assigns of corporation,
wherever the context so admits or requires. )
WITNESSETH, That the said first party , for and in consideration
of the sum of TEN ($10 .00) DOLLARS in hand paid by the said second
party, the receipt whereof is hereby acknowledged, does hereby remise ,
release and quit-claim unto the said second party forever, all the
right, title, interest, claim and demand, which the said first party
has in and to the following described lot , piece or parcel of land,
situate, lying and being in the County of Dade , State of Florida ,
to-wit :
A parcel of land described as follows :
Commence at a point of beginning being the S . W. corner
of Lot 10 of the Amended Plat of FIRST OCEAN FRONT
SUBDIVISION, according to the Plat thereof, as recorded
in Plat Book 9 at Page 78 , of the Public Records of
Dade County, Florida; thence run Northerly along the
West line of said Lots 10 , 11 and the South one-half of
Lot 12 of the aforesaid Subdivision to a point being the
N. W. corner of the South one-half of Lot 12 of the
aforesaid Subdivision; thence run Westerly on an extension
of an imaginary lot line being the North lot line of the
South one-half of Lot 12 extended to its intersection with
the present Easterly right-of-way line of Collins Avenue as shown
on the State Road Department Right-of-Way Map. Sec. 87060-
2502 ; thence run Southerly along the said present Easterly
right-of-way line of Collins Avenue to a point intersecting
with an extension of the South lot lino of Lot 10 under said
Subdivision extended to its point of intersection with the
present Easterly right-of-way line of Collins Avenue as prev-
iously described; thence run Easterly along said extension of
the South lot line of said Lot 10 to the Point of Beginning;
all of said land lying immediately to the West of Lots 10 ,
1.1 and the: South one-half of I,at 12 of the Amended Plat of
FIRST OCEAN FRONT SUBDIVISION, according to the Plat thereof ,
as recorded in Plat Book 9 at Page 78 , of the Public Records
of Dade County , Florida.
SUBJECT TO:
Any and all existing easements in favor of Grantor and/or
any public utility reserving unto the Grantor the right
to establish any further easements of a non-exclusive
nature as may be required from time to time for public purpose.
TO HAVE AND TO HOLD, the same together wtih all and singular
the appurtenances thereunto belonging or in anywise appertaining,
and all the estate, right, title, interest, lien, equity and claim
whatsoever of the said first party, either in law or equity, to the
only proper use , benefit and behoof of the said second party forever.
