RESOLUTION WAIVING OBJECTION TO ENCROACHMENT
FROM PROPERTY AT 387 N. HIBISCUS DRIVE, HIBIS-
CUS ISLAND.
WHEREAS, the owner, Caridad Grace de Perolta, and others
having a beneficial interest in the following described land situ-
ate in Miami Beach, Florida, to wit:
Lot 11, and 20 Foot Strip of land Northerly of
and adjacent to Lot 11, Block 2 of HIBISCUS
ISLAND according to the Plat thereof as recorded
in Plat Book 8 , at Page 75 of the Public Records
of Dade County, Florida;
have petitioned the City Commission of the City of Miami Beach,
Florida, to waive objection to the encroachment upon a public
sidewalk created by an existing structure on said land, all as
shown by the attached "Sketch of Survey" prepared by J.H. Manucy,
Inc. , a duly registered Land Surveyor, dated March 10 , 1980; and
WHEREAS, the City Commission has found and determined
that said encroachment was unintentional and not made under claim
of right, and is not of such extent or degree as to substantially
affect or obstruct the use or the rights of the public;
NOW, THEREFORE, BE IT DULY RESOLVED that the City Com-
mission of the City of Miami Beach, Florida, does hereby, insofar
as it possesses the power so to do, waive objection to the exist-
ence of the encroachment shown by the attached "Sketch of Survey"
and consents to its continued existence during the lifetime of the
existing structure, but not thereafter.
PASSED and ADOPTED this 4th day of June , 1980 .

SUBJECT: Request for Release by City of an Encroachment
onto Public Property, 387 North Hibiscus Drive,
Hibiscus Island
AttorneyA. N. Perry has addressed communications to this office
re-
questingthat the above referenced subject matter be placed on the
Commission Agenda for consideration.
The encroachment referred to involves an overhang on the front of
the houseextendinginto the street right-of-way approximately 31/2 feet ,
and the westP ortion of the structure extends approximately 2 inches
into the right-of-way as shown on the attached survey.
After his review, the Director of Public Works advisedthat the en-
croachment would have no effect upon the existing utilities or the
royCityAttorney
roadway. The also reviewed this matter and has prepared
a resolution allowing the encroachment to remain until such time as
the building is demolished. The property owner would also have the
right t o maintain and repair the existing building including the en-
croachments.

The Administration recommends that the Commission approve the
resolution authorizing the encroachment to remain until such time
as the building is demolished.

Owner: Caridad Grace de Peralta
Dear Sir:
I represent the present owner of the above property, which is a residence
dwelling built in 1926. This property is under sale and the buyers' attorney
hasp rovided me with a survey which indicates that the overhang on the
front of the house extends into the street right-of-way approximately
3 1/2 feet and that the structure itself on the west side extends into the
street right-of-way about two inches (2").
Having reviewed this matter with the City Attorney's Office and with the
Public Works Director, both of whom have been provided with a copy of
the survey, they suggested that I write to you requesting to be placed on
the agenda for the next available City Commission meeting, which I
understand would be June 4th, in order to obtain from the Commission
by resolution, letter or other form, the following relief:
1. A Waiver of enforcement of said two encroachments.
2. A right to maintain and repair the existing building including
the aforesaid overhang.
3. That the set-back requirements would be enforced only upon
demolition of the existing building and the construction of a new one.
Apparently there have been a number of similar cases in the past and
the Commission has granted relief.
Accordingly, please place me on the City Commission Agenda for the
meeting of June 4th. Thank you.
