ORDINANCE NO.
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE CODE OF
THE CITY OF MIAMI BEACH, ENTITLED "ADMINISTRATION," BY
AMENDING ARTICLE III, ENTITLED "AGENCIES, BOARDS AND
COMMITTEES," BY AMENDING DIVISION 25, ENTITLED
"TRANSPORTATION, PARKING, AND BICYCLE-PEDESTRIAN
FACILITIES COMMITTEE," BY AMENDING SECTION 2-190.94, ENTITLED
"COMPOSITION," TO AMEND THE COMPOSITION OF THE
TRANSPORTATION, PARKING, AND BICYCLE-PEDESTRIAN FACILITIES
COMMITTEE; AND PROVIDING FOR REPEALER, CODIFICATION,
SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, the City's Transportation, Parking, and Bicycle-Pedestrian Facilities
Committee (the "Committee") "serve[s] in an advisory capacity to the City Manager and the City
Commission in matters of transportation and parking as they relate to the unique neighborhoods
of the city; and to improve the lives of the city's residents and visitors by promoting the
development, sound management, safety and use of public facilities dedicated to bicycles and
pedestrians in the city"; and
WHEREAS, the Mayor and City Commission now desire to amend the composition of the
Committee, in order to provide the City Commission with greater flexibility to appoint qualified
members, and to reduce or eliminate the occurrence of vacancies on the Committee.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That Section 2-190.94 of Chapter 2 of the Miami Beach City Code is hereby
amended to state as follows:

Sec. 2-190.94. Composition.
The committee shall consist of 14 voting members. The mayor and city commissioners shall
each make one direct appointment, with the other seven members of the committee to be
comprised of members from the following community organizations, each of which must delegate

(1) Miami Beach Chamber of Commerce's Transportation and Parking Committee;

On an annual basis, the members of the committee shall elect a chairman chairperson and such
other officers as may be deemed necessary or desirable, who shall serve at the will of the
committee. Seven members shall consist of a quorum of the committee and shall be necessary
in order to take any action.
SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. SEVERABILITY.
If any section, sentence, clause or phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the•
validity of the remaining portions of this ordinance.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the
Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or
re-lettered to accomplish such intention, and the word "ordinance" may be changed to "section,"
"article," or other appropriate word.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on /►44t4 L3, Ze.19 +�

RECOMMENDATION
Pursuant to the request of Commissioner John Elizabeth Aleman, the attached Ordinance has
been placed on the March 13, 2019 City Commission meeting agenda for Second
Reading/Public Hearing.
City Code Section 2-190.94 establishes the composition of the City's Transportation, Parking,
and Bicycle-Pedestrian Facilities Committee (the "Committee"). The Committee is currently
comprised of 14 members, seven of whom are directly appointed by the Mayor and each
member of the City Commission. Each of the remaining seven members are comprised of
members of seven enumerated community organizations.
The attached Ordinance amends the composition of the Committee, to reduce the number of
at-large members from seven to four, and to provide that the four at-large members of the
Committee shall be comprised of members of the following community organizations, each of
whom shall be appointed by majority vote of the City Commission:
(1) Miami Beach Chamber of Commerce's Transportation and Parking Committee;
(2)A South Beach neighborhood or business association;
(3)A Mid-Beach neighborhood or business association; and

FINANCIAL INFORMATION
The attached Ordinance shall have no more than a nominal impact on the City's financial
resources.
