SUBJECT: LEASE AGREEMENT FOR SECURITY GUARD BUILDING/PALM ISLAND
In February, 1979, the Palm and Hibiscus Islands Homeowners
Association requested City approval for the creation and
establishment of a special taxing district for the purposes of
providing funds for guard and security services . Pursuant to
Article II , Chapter 18 of the Code of Metropolitan Dade County,
the City Commission adopted Resolution No . 79-15827 (see
attached) which approved the creation of the special taxing
district subject to compliance with applicable Metropolitan Dade
County charter requirements . Subsequent to the adoption of this
Resolution, Metropolitan Dade County conducted public hearings
and then held a special election for all affected property
owners . The residents overwhelmingly voted in favor of the
creation of this district . Based on this action, Metropolitan
Dade County proceeded with the administrative actions necessary
to create the taxing district . As in all other districts ,
Metropolitan Dade County will act as the administrative agent .
The County will levy and collect the tax and be responsible for
making payment to the guard service .
This special taxing district will provide for an unarmed ,
uniformed guard stationed at the security building located at
the entrance of Palm Island on a 24-hour a day, 7-day per week
basis . The cost of this service will be borne by only the
residents of these islands . Furthermore, this guard will have
no authority to restrict either the access or egress to the
islands . The guard stationed at the house will have no barrier
or any other physical device to restrict the passage of
pedestrians or vehicles onto these islands . It is hoped that
the mere presence of the guard will serve as a deterrent in
keeping undesirables off the islands.
The attached Lease Agreement with Metropolitan Dade County will
permit the guard service to use the City' s security building
located at the entrance of Palm Island. The special taxing
district will incur all operating costs , including water , waste
disposal service and electricity. The term of this Lease is
from November 1 , 1980 through October 31 , 1982 . Both parties
will have the right to cancel said Lease Agreement at any time
by giving at least sixty ( 60) days written notice prior to its
effective date.
ADMINISTRATION RECOMMENDATION
It is recommended that the Mayor and City Commission adopt the
attached Resolution authorizing the execution of a Lease Agree-
ment with Metropolitan Dade County for purposes of providing the
use of the security building at the entrance of Palm and 96
Hibiscus Islands in conjunction with the special taxing district
which has been created for guard and security services .

A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING EXECUTION
OF LEASE AGREEMENT WITH METROPOLITAN DADE COUNTY
FOR THE PURPOSE OF LEASING THE SECURITY GUARD
BUILDING LOCATED AT THE ENTRANCE TO PALM ISLAND,
MIAMI BEACH, FLORIDA.
WHEREAS, for the reasons more particularly set forth in
Commission Memorandum No.e.S.37, the City Commission of the City of
Miami Beach deems it in the best interest of the citizens of Miami
Beach to enter into a lease agreement with Metropolitan Dade
County, the terms of which are familiar to the City Commission, a
copy of which is included in the Agenda Package for the meeting at
which this Resolution was adopted; and
WHEREAS, the City Manager recommends the City enter into
said lease agreement, and the City Attorney has approved same as to
form and legal sufficiencies;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City
Manager and City Clerk be and they are hereby authorized and
directed to enter into said Agreement for said Lease Agreement for
and on behalf of the City of Miami Beach.
