RESOLUTION NO. 81-16585
A RESOLUTION AUTHORIZING THE EXECUTION OF A
SURRENDER AGREEMENT WITH THE METROPOLITAN
MUSEUM & ART CENTERS, INC. FOR THE SURRENDER
OF A LEASEHOLD INTEREST IN CITY-OWNED PROPERTY
AT 4221 PINE TREE DRIVE.
WHEREAS, the City of Miami Beach is presently the
owner of the property located at 4221 Pine Tree Drive, Miami
Beach, Dade County, Florida, hereinafter referred to as the
"PROPERTY, " which property is more particularly described as:
Lot 5 of FLAMINGO BAY SUBDIVISION NO. 1
according to the Plat thereof, as recorded
in Plat Book 6 at page 101 of the Public
Records of Dade County, Florida.
WHEREAS, by an Agreement dated September 20, 1978 ,
the Metropolitan Museum & Art Centers, Inc. leased the above
described property for a period of three years; and
WHEREAS, by a letter dated November 12 , 1980, attached
hereto and incorporated by reference herein, the Metropolitan
Museum & Art Centers, Inc. is requesting a surrender of all its
rights, title, interest and claims under said lease; and
WHEREAS, the City of Miami Beach deems it in the best
interest of the City and its citizens to enter into this
Surrender Agreement and re-enter the premises;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor
and City Clerk be and they are hereby authorized and directed
to enter into the attached Surrender Agreement.

SURRENDER AGREEMENT
THIS AGREEMENT made and entered into this 4th
day of March , 1981, by and between the CITY OF
MIAMI BEACH, a Florida municipal corporation, hereinafter
referred to as the "CITY, " which term includes its successors
and assigns, and METROPOLITAN MUSEUM & ART CENTERS, INC. a non-
profit
on-profit and tax-exempt [501 (c) (3) ] corporation organized under
the laws of the State of Florida, hereinafter referred to as
the "MUSEUM, " which term includes its successors and assigns,
WITNESSETH :
WHEREAS, the CITY is presently the owner of the property
located at 4221 Pine Tree Drive, Miami Beach, Dade County, Florida,
hereinafter referred to as the "PROPERTY, " which property is more
particularly described as :
Lot 5 of FLAMINGO BAY SUBDIVISION NO. 1
according to the Plat thereof, as recorded
in Plat Book 6 at page 101 of the Public
Records of Dade County, Florida.

the surrender of the leasehold interest created by the Agreement
dated September 20, 1978 , by and beLween the City of Miami Beach
and Metropolitan Museum & Art Centers, Inc.

It is specifically agreed that MUSEUM and CITY
relinquish all rights, title and interest and claims under
said agreement.
IN WITNESS WHEREOF, the CITY has caused these
presents to be signed in its corporate name by its proper
duly authorized officers and its corporate seal to be here-
unto affixed, and the MUSEUM has caused these presents to be
signed in its corporate name by its proper duly authorized
officers and its corporate seal to be hereunto affixed, the
day and year first hereinabove written.

Dear Mr. Sumrall:
The time has flown since you first arranged for art classes on Miami
Beach and later were so instrumental in making 4221 Pine Tree Drive
available to us as a Museum and School.
We have most pleasant memories of our association, and what both
the Museum and Miami Beach officials attempted to bring to the
residents of Miami Beach in the way of exhibitions, art classes and
lectures. The Museum was aided in its efforts by a large staff hired
through the availability of CETA grants, which were renewed for three
years until 1979 when we, as well as other non-profit organizations, were
cut off from C ETA funds. This, coupled with the fact our permanent
quarters at Coral Gables were ready for our move, precluded our being
able to staff the location at 4221 Pine Tree Drive adequately.
• Due to budgetary restrictions, and the need to staff our lo'Thation at
1212 Anastasia Avenue, we have to release the guard/maintenance staff
member at the beach by December Slat, and the live-in maintenance
staff member), presently at Miami Beach, will he moving to Coral Gables
by I)ecember 31st and operating out of our main building. We had no
other choice.
The Miami Beach building will be available by January 1, 1981. Please
advise what additional a rrangenients you wi shi us to make such as shutting
off the electrical service, termination of lease agreement et('.

the assistance and encouragement over the past years,
