RESOLUTION 83-17471 RESOLUTION NO. 83-17471 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH AUTHORIZING THE DIRECTOR OF THE MIAMI BEACH CONVENTION CENTER TO EXECUTE CERTAIN AMENDMENTS TO CONVENTION CENTER LEASES , WHICH AMENDMENTS CONCERN TECHNICAL, NON--SUBSTANTIVE CHANGES OF A MINOR NATURE. WHEREAS, the City Commission is cognizant that there are amendments to numerous leases submitted by the Convention Center Director to the City Commission for its approval and the Mayor ' s execution; and WHEREAS , the majority of these Miami Beach Convention Center lease amendments concern technical, non-substantive changes of a minor nature which include, without limitation: changes in dates of the lease, changes in the number of events, performances , or shows scheduled within the term of the lease, and changes in the dates but not the amount of payments made by the lessee; and WHEREAS, the aforementioned lease amendments of a minor nature unduly consume the time and energy of the Connvention Center staff, the City administration, and the Mayor and Commissioners by its currently required transmittals to and from the aforementioned City departments and officials, and the amendments ' placement on the City Commission agenda; and WHEREAS, the City Commission of the City of Miami Beach finds that it is in the best interests of an expedient and efficient operation of the administration of the Convention Center and the limited time of City employees and elected officials to exempt Convention Center lease amendments of a minor, technical, and non-substantive nature from the foregoing procedures by authorizing the Convention Center Director to execute those certain amendments after they have been approved as to form by the Office of the City Attorney and approved by the City Manager or his designee, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: That the Director of the Convention Center be authorized to execute the following routine amendments to Convention Center leases as set forth herein, after they have been approved as to form by the Office of the City Attorney and approved by the City Manager or his designee: 1. Amendments which change times and/or dates of proposed period of occupancy for show3, events or performances scheduled by the lessee and which do not conflict with other periods of occupancy allocated to another lessee by the city; 2 . Amendments which change times of payment (s) made by the lessee to the City of Miami Beach for use of the Convention Center premises and facilities; provided, however , that this shall not include amendments decreasing the sums of money paid by lessee to the City of Miami Beach; 3 . Amendments which correct typographical or clerical errors within the lease; OFFICE OF THE CITY ATTORNEY 1700 CONVENTION CENTER DRIVE -MIAMI BEACH, FLORIDA 33139 4 . Amendments which increase the period of occupancy for the lessee or increase the number of shows , events, and performances scheduled by lessee resulting in increase in sum (s) paid to the City; provided, however , that such sums do not exceed of the amount of Five Thousand ($5 ,000 . 00) Dollars and that they do not conflict with another period of occupancy allocated to another lessee by the City.
