A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, PROVIDING FOR
THE HOLDING OF A SPEC IAL ELECTION ON MARCH 13,
1984 AT WHICH THERE WILL BE SUBMITTED TO THE
VOTE OF THE ELECTORATE THE QUESTION OF THE
ISSUANCE OF GENERAL OBLIGATION BONDS OF SAID
CITY IN THE SUM AND FOR THE PURPOSE IN THIS
RESOLUTION STATED.

WHEREAS, the City Commission of the City of Miami Beach,
Florida (the "City Commission" ) , deems it advisable and in the
best interest of the City of Miami Beach (the "City" ) to issue
bonds of the City in the amount and for the municipal purpose set
forth below:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA THAT:
SECTION 1.
In accordance with the provisions of the Charter of the
City of Miami Beach, Florida and the general laws of the State of
Florida, a special election is hereby called and directed to be
held in the City of Miami Beach, Florida from 7: 00 o'clock a.m.
to 7: 00 o'clock p.m. on March 13, 1984 to determine whether the
issuance of general obligation bonds aggregating not more than
Nine Million Eight Hundred Thousand Dollars ($9, 800, 000 . 00) shall
be approved by the qualified electors. Said bonds shall be
payable from ad valorem taxes levied on all taxable property in
the City without limit as to rate or amount, the full faith and
credit of the City to be pledged to the payment of principal of
and interest on such bonds. Said bonds shall bear interest at
rates determined at the time of the sale thereof, not exceeding
the maximum legal interest rate. The purpose of said bonds shall
be to finance the construction, reconstruction, replacement and
improvement of water and sewer facilities, streets, lighting,
landscaping and property acquisition, in furtherance of the
Redevelopment Plan, on file in the Office of the City Clerk, for
the area south of Sixth Street in the City.
SECTION 2.
Voting precincts in the City for the special election shall
be as established by the proper and appropriate Dade County
election officials. Each elector shall vote at the polling place
and in the voting precinct in which the OFFICIAL REGISTRATION
BOOKS show that such elector resides . A list of the voting
precincts and the polling places therein (subject to change by
the Supervisor of Elections of Dade County, in accordance with
the laws of the State of Florida) is attached hereto as Exhibit
A.
SECTION 3.
Registration of persons desiring to vote in the special
election shall be in accordance with the general law of the State
of Florida governing voter registration. Qualified persons may
register to vote at the City registration office located in the
lobby of the City Hall, 1700 Convention Center Drive, Miami
Beach, Florida 33139, each and every Wednesday until February 8,
1983 between the hours of 9: 00 A.M. and 4: 30 P.M. , and at such
other voter registration centers and during such times as may be
provided by the Supervisor of Elections of Dade County. All
questions concerning voter registration should be directed to the
Dade County Elections Office, 1444 Biscayne Boulevard, Miami
Florida 33132; Mailing Address: P.O. Box 012241 Miami, Florida
33101; Telephone: (305) 579-4384.
SECTION 4.
The appropriate and proper Dade County election officials
shall conduct the special election hereby called except for the
canvassing of returns of the special election, which duty shall
be performed by the City Commission. The official returns for
each voting precinct shall be furnished to the City Clerk of the
City on the night of the special election as soon as the ballots
from all voting precincts have been tabulated. The official
certification of the results of the special election shall be
made by the City Commission.

SECTION 5.
The Notice of Election shall be substantially in the
following form:
NOTICE IS HEREBY GIVEN THAT A SPECIAL ELECTION
HAS BEEN CALLED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AND WILL BE HELD
IN SAID CITY FROM 7: 00 A.M. UNTIL 7: 00 P.M. ,
ON THE THIRTEENTH DAY OF MARCH, 1984 AT WHICH
TIME THERE SHALL BE SUBMITTED TO THE DULY
REGISTERED AND QUALIFIED VOTERS OF THE CITY OF
MIAMI BEACH THE FOLLOWING QUESTION:

SHALL THE CITY OF MIAMI BEACH ISSUE GENERAL
OBLIGATION BONDS IN AN AMOUNT NOT TO EXCEED

The Notice of Election shall further set forth the several
polling places in the voting precincts as established in
accordance herewith, and shall further set forth pertinent
information regarding eligibility of electors to participate in
said election.
SECTION 6.
The form of the ballot to be used in the special election

Such ballot and its preparation shall be in compliance with
the laws of the State of Florida with respect to the use of an
electronic voting system.
SECTION 7.
For the purposes of determining the results of the bond
election, the bonds shall be approved if a majority of the votes
cast in the bond election shall be in favor of their issuance.
SECTION 8.
Absentee voters participating in the special election shall
be entitled to cast their ballots in accordance with the
provisions of the laws of the State of Florida with respect to
absentee voting.
SECTION 9.
The City shall pay all expenses for conducting the special
election and will pay such expenses to Dade County or directly to
all persons or firms, upon receipt of an invoice or statement
approved by the Supervisor of Elections of Dade County, Florida.
SECTION 10.
The law firm of MORGAN, LEWIS & BOCKIUS of Miami and
Philadelphia is hereby approved to serve as bond counsel for the
City in connection with the proposed bond offering.
SECTION 11.
The firm of DEAN WITTER REYNOLDS INC. , is hereby designated
to serve as financial consultant for the purpose of rendering the
usual and customary services of financial consultants in the
marketing of the bonds and obligations hereinabove described.

SECTION 12.
This Resolution shall be available in the Office of the City
Clerk. The City Clerk shall publish notice of election as
provided in this Resolution in the Miami Beach Sun Reporter , a
newspaper of general circulation in the City, once each week for
the four consecutive weeks preceding the date of the election, in
accordance with Section 10-5 of The Code of The City of Miami
Beach, as well as once in the fifth week prior to the election,
pursuant to Section 100. 342, Florida Statutes.
SECTION 13.
If any word, phrase, clause, sentence or paragraph hereof
shall be held invalid by any Court of competent jurisdiction,
such holding shall not affect any other word, phrase, clause,
sentence or paragraph hereof.
SECTION 14.
All resolutions or parts of resolutions in conflict or
inconsistent herewith are hereby repealed insofar as there is any
conflict or inconsistency with the provisions hereof.
SECTION 15.
This Resolution shall be effective immediately upon its
passage.
