2003-3420 OrdinanceORDINANCE NO. 2003-3420 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 102 OF THE CITY CODE, ENTITLED "TAXATION"; AMENDING DIVISION IV THEREIN, ENTITLED "TAX"; AMENDING ARTICLE V THEREIN, ENTITLED "OCCUPATIONAL LICENSE TAX"; AMENDING SECTION 102-379 THEREIN, ENTITLED "SCHEDULE OF TAXES"; SAID AMENDMENT PROVIDING FOR AN INCREASE IN FEES CHARGED ANNUALLY FOR OCCUPATIONAL LICENSES OF FIVE PERCENT (5%) EVERY OTHER YEAR (ROUNDED TO THE NEAREST DOLLAR), EFFECTIVE ON OCTOBER 1, 2003 (FISCAL YEAR 2003-04); FURTHER INCREASED BY 5% EVERY OTHER YEAR ON OCTOBER 1, UNTIL SUCH FEES HAVE CAUGHT UP WITH THE CUMULATIVE CHANGE IN CONSUMER PRICE INDEX (CPI) MEASURED BETWEEN JUNE 1994 THROUGH MARCH 2003, WHICH IS 24.5%; PROVIDING FOR ANOTHER CHANGE EQUAL TO THE CUMULATIVE PERCENTAGE CHANGE IN CPI FROM MARCH 2003 TO SEPTEMBER 2011; FURTHER ADDING AN ANNUAL FEE CATEGORY FOR ADULT ENTERTAINMENT ESTABLISHMENT; AND ADDING A CLASSIFICATION AND AN ANNUAL FEE CATEGORY FOR NIGHTCLUBS (OR A VERSION OF DANCEHALL LICENSE, AS DEFINED IN THE CITY'S ZONING ORDINANCE); PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, the Occupational License Ordinance was adopted on June 7, 1995 and rates were established based on the 1994 study and have not been increased since that time; and WHEREAS, pursuant to Florida Statute, occupational licenses are limited to a maximum increase of 5% every other year; and the change in CPI from June 1994 through March 2003 was 24.5%; and WHEREAS, at its meeting on May 12, 2003, the Finance and Citywide Projects Committee recommended fee increases for occupational license, certificate of uses, and fire inspection fees; and WHEREAS, the Finance and Citywide Projects Committee recommended an increase in the fees charged for occupational licenses of 5%, said increase commencing on October 1, 2003 (Fiscal Year 2003-04), with future increases, every other year, to be based on the annual escalation provision of the Consumer Price Index (ClP); and WHEREAS, the Finance and Citywide Projects Committee also recommended adding a classification for an Adult Entertainment Establishment, with an annual occupational license fee of $5,000; and WHEREAS, the Finance and Citywide Projects Committee also recommended adding a classification and an annual fee category for nightclubs (or a version of a dancehall license, as defined in the City's Zoning Ordinance), based on maximum occupant capacity, at $3 per occupant, with a $300 minimum; and WHEREAS, on first reading of the aforestated amendments to the Occupational License Ordinance on July 2, 2003, the Mayor and City Commission adopted the Finance and Citywide Projects Committee's recommendations, except for the provision as to the portion pertaining to automatic fee escalations (after fiscal year 2005-06). NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA. SECTION 1. That Chapter 102 of the City Code; Division IV therein; Article V therein; Section 102-379 therein is amended as follows. Sec. 102-379 Schedule of Taxes License taxes for the following businesses, occupations, or professions are hereby levied and imposed as set forth below. Effective on October 1,2005 (Fiscal Year 2005-2006), the following license taxes will be increased by five (5%) percent rounded to the nearest dollar, and further increased by 5% every other year on October 1, until such fees have caught up with the cumulative percentage chanqe in the Consumer Price Index (CPI) measure between June 1994 throuqh March 2003, which is 24.5%. Further providinq for another chanqe equal to the cumulative percentaqe chanqe in the CPI from March 2003 to September 2011. As provided in Resolution No , a review of the annual permit fee will be required whenever the chanqe in the Consumer Price Index (CPI), between the latest CPI and the date of the CPI used for the last fee adjustment, is five percent (5%) or greater. Item Summary/Recommendation: Occupational licenses are limited to a maximum increase of 5% every other year. Such fees were last increased in June 1995, based on a 1994 study. The change in CPI from June 1994 through March 2003 is 24.5%. Therefore, it is recommended that these fees be automatically increased on October 1,2003 by 5% and further, increased by 5% every other year on October 1, until such fees have caught up with the cumulative change in the CPI as of that date. The certificate of use fee was last increased in 1992. The cumulative change in CPI from September 1992 to March 2003 is 30%. Therefore, it is recommended that the fee be increased by 10% on October 1,2003, 10% on October 1,2004, 10% October 1,2005 and on October 1, 2006 by the cumulative change in the CPI from March 2003 to September 2006. From: Subject: ADMINISTRATION RECOMMENDATION: Approve the Ordinance Amendment on second reading. ANALYSIS: On first reading of the ordinance amendment on July 2, 2003, the Mayor and City Commission accepted the Finance and Citywide Projects Committee's recommendations, with the exception of the automatic annual increase provision, which was not accepted. It was then recommended that a methodology be put in place to review the fees when a threshold change in the CPI occurs. Therefore, it is recommended that a review of the fees be initiated whenever the change in the CPI, between the current CPI and the date of CPI used to establish the last rate adjustment, is greater than five percent (5%). Upon reaching this threshold, and following a survey of fees for similar services in surrounding communities and/or an analysis to review the current cost of providing such services, adjustment to such fees will be incorporated into an amended ordinance or resolution, as appropriate, and submitted to the Mayor and City Commission for approval. This process will help to insure that the city is recovering costs for services provided and keeping fees competitive and in line with cost of living increases. This policy will be presented to the Mayor and the City Commission on July 30, 2003, for approval on a separate resolution. BACKGROUND: In May of 1993, there was a major reform of the Occupational License Tax Statute (Chapter 205 of the Florida Statutes). The key provision of this reform allowed local governing authorities more control over their licensing revenue. During June 1994, the Miami Beach City Commission appointed an Equity Rate Study Commission ("ERSC") whose members were representative of the local business community. The findings of the ERSC were advisory in nature only. The statute required that the City Commission review their finding and adopted a license ordinance prior to October 1, 1995. The Mayor and City Commission approved the Occupational License Ordinance upon first reading at the May 17, 1995, commission meeting, and referred the matter to the Finance and Citywide Projects Committee for their review. Subsequently, the Occupational License Ordinance was adopted on second reading June 7, 1995 and rates were established based on the 1994 study and have not been increased since that time. The Certificate of Use Ordinance was established in 1988 to recover building, planning, and zoning inspections and annual follow up. The fee was last increased by 50% by Ordinance No. 92-2797 on September 16, 1992. The Annual Fire Prevention and Fire Safety Inspection fee was first established on March 5, 1997, to recover the cost of providing fire prevention and fire safety inspections within the City, by Ordinance No. 97-3072 and has not been increased since that date. On July 31, 2002, the City Commission directed the Administration to combine the City occupational license, certificate of use, and fire safety permit on a single certificate as of October 1,2002. Additionally, the Commission directed the Administration to change the annual issue date of the certificate of use and the fire safety permit from Ju ne 1 to October 1, to coincide with the annual issuance of the occupational license. On May 12, 2003, the Finance and Citywide Projects Committee recommended fee increases for occupational license, certificate of use, and fire inspection fees. Additionally they requested that an automatic annual escalation provision, based on the increase in the annual CPI, be implemented to ensure that rates keep up with the increased cost of providing services. Occupational License The Finance and Citywide Projects Committee recommended an increase in the fee charged for each occupational license of 5%, and that the new rate take effect upon approval of the amended Ordinance. Additionally, the Committee recommended that an annual escalation provision, based on CPI, be included in the Ordinance. The fee is based on maximum occupant capacity, at $3 per occupant, with a $300 minimum, to recover nightclub inspection overtime costs, which are currently in excess of $75,000 per year. The rate is to take effect upon approval of the amended Ordinance. Additionally this fee shall increase at the rate of the cumulative change in CPI, every other year automatically on October 1, not to exceed 5%. However, on first reading of the ordinance amendment on July 2, 2003, the Mayor and City Commission accepted the Finance and Citywide Projects Committee's recommendations, with the exception of the automatic annual increase provision, which was not accepted.
