A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE ADMINISTRATION TO APPLY TO THE STATE OF
FLORIDA DEPARTMENT OF NATURAL RESOURCES FOR
AN AMENDMENT TO EASEMENT NO. 26214 (3145-13)
GRANTED BY THE BOARD OF TRUSTEES OF THE
INTERNAL IMPROVEMENT FUND ON MARCH 1, 1982 ,
FOR ADDITIONAL LAND EASEMENTS IN ORDER TO
CONSTRUCT THE STONE REVETMENT ALONG THE
SHORELINE AT THE MIAMI BEACH MARINA, AND
REQUESTING THE WAIVER OF FEES.
WHEREAS, the City of Miami Beach, by agreement with a
developer , is constructing and developing a public marina,
public bay walk and public dry boat storage facilities with
ancillary support services on the landside portion of the Miami
Beach Marina site for the use of the public; and
WHEREAS, the lease agreement between the City and the
developer, Carner-Mason Associates, Ltd. , specifies that the
City be responsible for obtaining and maintaining all permits
for the Developer 's waterside construction associated with the
marina; and
WHEREAS, the original land lease with the State of
Florida Department of Natural Resources specified a submerged
land lease for shoreline restoration use by filling and
constructing a rip-rap bulkhead; and
WHEREAS, it has been determined by the City' s consult-
ant, Post, Buckley, Schuh and Jernigan, Inc. , that the existing
easement is insufficient due to the depth of the existing bay
bottom; and
WHEREAS, the additional land necessary to be leased
for the marina construction is as follows:

line of Lot 27 of Said Block 111; AND
PARCEL B: Bounded on the East by the
Westerly line of Said Block 111; bounded
on the South by the Westerly extension
of the Northerly 5. 00 feet of Lot 8 of
Said Block 111; bounded on the West by a
line 35. 00 feet Westerly of and parallel
with the Westerly line of Said Block
111; bounded on the North by the
Westerly extension of the Southerly line
of Lot 23 of Said Block 111. Containing
0.74 acres more or less.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COM-
MISSION OF THE CITY OF MIAMI BEACH, FLORIDA that they authorize
the Administration to apply to the State of Florida Department
of Natural Resources for an Amendment to Easement No. 26214
(3145-13) granted by the Board of Trustees of the Internal
Improvement Fund on March 1, 1982 , for additional land easements
in order to construct the stone revetment along the shoreline at
the Miami Beach Marina, and requesting the waiver of fees.
