A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, PLACING CERTAIN NEGOTIATED
AND AGREED UPON LANGUAGE INTO THE CONTRACT
BETWEEN THE CITY OF MIAMI BEACH AND THE
FRATERNAL ORDER OF POLICE AND RATIFYING THE
NEGOTIATED WAGE SETTLEMENT.
WHEREAS, the City of Miami Beach and the Fraternal Order of Police reopened
wage negotiations and certain other negotiations per Contract and have agreed on
certain issues, the following language, which has been agreed to by both parties, shall
be considered as a part of the Fraternal Order of Police Contract and shall be placed
therein:
WAGE SETTLEMENT
Across-the-board increases shall be paid on the pay periods next commencing on or
nearest the following dates:
January 1, 1984 (retroactive) 3%
July 1, 1984 5%
October 1, 1984 3%
July 1, 1985 5%
The Contract will expire on December 31, 1985.
AMENDMENT #1 REOPENER
In the event an amendment is passed by referendum limiting the City's ability to
receive tax revenue (Amendment 1), at any time after the passage of the
Amendment, if the City Manager elects to do so, the City may notify the Union of
its desire to reopen negotiations on the subject of whether the 5% increase due
July 1, 1985, shall be changed, in the event of such notice the parties will bargain
on that subject in accordance with Chapter 447, Part II, Florida Statutes.
In the event Amendment I is not passed, the Union may notify the City of its desire
to reopen negotiations on the subject of whether the Contract should expire on
December 31, 1985 or earlier. In the event of such notice the parties will bargain
on this subject in accordance with Chapter 447, Part II, Florida Statutes.
SECTION 15. HEART DISEASE PRESUMPTION
Any condition or impairment of health of any Police Officer caused by heart
disease resulting in total or partial disability or death shall be presumed to have
been accidental and to have been suffered in the line of duty unless the contrary be
shown by satisfactory evidence; provided, however, that such Police Officer shall
have successfully passed a physical examination upon entering into such service as
a Police Officer, which examination failed to reveal any evidence of heart disease.
If at any time this Section is placed before an Arbitrator for interpretation or
application, what is "satisfactory evidence' shall be determined by the Arbitrator.
If rights of employees are placed before the Bureau of Workers Compensation then
what is "satisfactory evidence" will be determined by the Bureau in accordance
with Workers Compensation law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA:
