RESOLUTION 84-17740 RESOLUTION NO. 84-17740 A RESOLUTION OF THE CITY OF MIAMI BEACH APPROVING SITE SELECTION AS TO LOCATION OF 41ST STREET/OFF-STREET AND WEST AVENUE OFF- STREET PARKING PROJECTS; DECLARING ACQUISI- TION CQUISI-TION OF THOSE PROPERTIES IDENTIFIED AND DESCRIBED AS: FORTY-FIRST STREET PROJECT - LOTS 1, 2 , 10 , 11, AND 12 , BLOCK 55 , AND LOTS 14 , 15, AND 16 , BLOCK 54 , ORCHARD SUB- DIVISION NO. 2 AND 3 , PLAT BOOK 8 , PAGE 116 , PUBLIC RECORDS OF DADE COUNTY, FLORIDA (NORTH SIDE OF 40TH STREET BETWEEN ROYAL PALM AVENUE AND PRAIRIE AVENUE) AND WEST AVENUE PROJECT - LOT 15 , BLOCK 40 , ALTON BEACH REALTY COMPANY SUBDIVISION, PLAT BOOK 6 , PAGE 165, PUBLIC RECORDS OF DADE COUNTY, FLORIDA (WEST AVENUE BETWEEN LINCOLN ROAD AND 17TH STREET) , TO BE A PUBLIC NECESSITY; AUTHORIZING THE ACQUISITION OF SAID PROPER- TIES BY PURCHASE, DONATION OR THE FILING OF EMINENT DOMAIN PROCEEDINGS AND DECLARATION OF TAKING, AS NECESSARY. WHEREAS, for the purposes of constructing future park- ing areas, the City of Miami Beach desires to acquire several parcels of land located in the City of Miami Beach, within the area located on the north side of 40th Street between Royal Palm Avenue and Prairie Avenue and located on West Avenue between Lincoln Road and 17th Street, and WHEREAS, for reasons more particularly set forth in the attached Commission Memorandum dated May 16 , 1984 , the City Commission desires to approve the site selection of the afore- mentioned sites as the site of the 41st Street/Off-street Park- ing Project and West Avenue Off-street Parking Project; and WHEREAS, the legal descriptions of the specific prop- erties to be acquired are: 41ST STREET PROJECT Lots 1, 2 , 10 , 11 and 12 , Block 55, and Lots 14 , 15 and 16 , Block 54, ORCHARD SUBDIVISION NO. 2 and 3 , according to the Plat thereof as recorded in Plat Book 8 at Page 116 of the Public Records of Dade County, Florida; and WEST AVENUE PROJECT Lot 15 , Block 40 , ALTON BEACH REALTY COMPANY SUBDIVISION, according to the Plat thereof as recorded in Plat Book 6 at Page 165 of the Public Records of Dade County, Florida; AND, WHEREAS, the City Commission finds, determines and declares that it is necessary to approve the site selection OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE -MIAMI BEACH,FLORIDA 33139 of the above-described properties and to acquire fee simple title to such properties for use in connection with construction of the 41st Street/Off-Street Parking Project and West Avenue Off-street Parking Project; and WHEREAS, the City Commission finds, determines and declares that the acquisition of the above-described properties is a public necessity and is necessary, practical and in the best interest of the City of Miami Beach; and WHEREAS, the City Commission finds, determines and declares that the acquisition of the above-described properties by purchase, donation, or eminent domain proceedings is for the public use and benefit, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, that: 1. This City Commission finds, determines and declares that the matters set out in the foregoing recitals are true and correct and they are hereby incorporated as a portion of this resolution. 2. The recommendation of the City Manager as to the selection of the above-described properties as the sites for the 41st Street/Off-street Parking Project and West Avenue Off- street Parking Project is hereby accepted and approved. 3. The recommendation of the City Manager as to the acquisition of the above-described properties as the sites for the 41st Street/Off-street Parking Project and West Avenue Off- street Parking Project is hereby accepted and approved. 4 . This City Commission declares that it is neces- sary to acquire fee simple title to: 41ST STREET PROJECT Lots 1, 2 , 10 , 11 and 12 , Block 55 , and Lots 14 , 15 and 16 , Block 54 , ORCHARD SUBDIVISION NO. 2 and 3 , according to the Plat thereof as recorded in Plat Book 8 at Page 116 of the Public Records of Dade County, Florida; and -2- OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE -MIAMI BEACH,FLORIDA 33139 WEST AVENUE PROJECT Lot 15 , Block 40 , ALTON BEACH REALTY COMPANY SUBDIVISION, according to the Plat thereof as recorded in Plat Book 6 at Page 165 of the Public Records of Dade County, Florida; 5. This City Commission authorizes the City Manager and the City Attorney, through their staffs or through special counsel engaged for such purposes, to acquire the above-de- scribed properties through purchase, donation, or through emi- nent domain proceedings, including declaration of taking.
