A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE AN AMENDED AGREEMENT
TO EXTEND EXISTING AGREEMENT BETWEEN THE CITY
OF MIAMI BEACH AND MALCOLM PIRNIE, INC. FOR
SEWERAGE SYSTEM IMPROVEMENTS.
WHEREAS , the City Commission has reviewed the Amended
Agreement by and between the City of Miami Beach, Florida and
Malcolm Pirnie, Inc. for Sewerage System Improvements, which was
approved pursuant to Commission Memorandum No. 358-84 , dated
June 5 , 1984; and
WHEREAS, the City Manager has recommended execution of
the Agreement and the City Attorney has approved it as to form,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH that the Mayor and the City Clerk are
authorized to execute the Amended Agreement by and between the
City of Miami Beach, Florida and Malcolm Pirnie, Inc. for
Sewerage System Improvements,
PASSED and ADOPTED this 5th day of June, 1984 .

It is proposed that the contract with Malcolm Pirnie, Inc. and Ray Hart &
Associates be extended for design services of approximately $2,000,000
worth of Sanitary Sewer construction. The fee is to be based on actual
design costs times 2.5, not to exceed 8% of actual construction cost, based
on the $2,000,000 construction project the fee would be $160,000. There
would be other sub-consultants costs for borings, soil investigations,
surveying and aerial photographs and based on unit cost would amount to
$29,200. It is also recommended that the contract be extended to allow for
preliminary design and cost estimates of the rest of the Sanitary Sewer
facilities within the South Pointe area, for the purposes of preparing
applications for Federal Grants at a fee of $15,000. This would be an option
that could be exercised by the Administration at a later date.
The above proposal will allow for the City to expeditite construction of the
Sanitary Sewer facilities in the South Pointe area and place it in a situation
prepared for any initial major development in the South Pointe area.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the Commission authorize the
extension of the existing contract with Malcolm Pirnie, Inc. and Ray Hart &
Associates in the amount of $189,200 and that funds in this amount be
appropriated from the existing Bonds Funds for transmitting sewage to
Virginia Key.

EXTENSION OF EXISTING CONSULTANT'S CONTRACT FOR DESIGN OF
THE SANITARY SEWER PHASE OF THE SOUTH POINTE BOND ISSUE
The Public Works Department has reviewed the timetable for the
improvements included in the South Pointe Bond Issue as they relate to the
development of major projects in the South Pointe area, and find that the
most critical projects effecting future development is the Sanitary Sewer
portion of the Bond Issue as these need to be in place before any major
construction can be completed. Also, the lead time required for purchasing
of pumping equipment, etc. necessitates that design proceed as
expeditiously as possible so that contracts might be awarded as soon as
possible.
To facilitate the above, the City has an existing contract with Malcolm
Pirnie, Inc., and Ray L. Hart & Associates for the design of the facilities to
transmit sewage to Virginia Key. The constructing cost was approximately
$30,000,000 at a fee of $3,197,735.96 which included full time inspection.
We are still working on the final phase of the project, and have under the
original contract an outstanding fee of a little over $14,000 which is part of
the EPA Grant which the City is being reimbursed 75% of the cost. In
addition, we have them under extra services for work not covered under the
EPA Grant for a fee of $3,900 and $3,600.
This contract could be extended for the design of the Sanitary Sewer
improvements included in the South Pointe Bond Issue. In fact, the
utilization of this firm would result in considerable time saved and costs
since they are totally familiar with our existing system and the project
would have to be interconnected with the force main to Virginia Key. The
City Attorney has reviewed the legality of this extension and advises that
we could extend the contract without going through the provisions of the
competitive Negotiating Act. This would save us time, in fact design could
be underway the end of May and result in award of some contracts in
October, 1984. Attached is a copy of the City Attorney's opinion.
The sale of Bonds for the South Pointe Issue will not occur until October or
November of 1984. Since the consultant's contract extension would require
immediate funding, a review of the Bond Funds for transmitting sewage to
Virginia Key indicates that as a result of the EPA Grant, existing funds
from the Issue can be used for improvements in the South Pointe area.
Therefore, it is proposed that the funding for engineering services be
provided from the existing Bond Funds.
