A RESOLUTION OF THE CITY COMMISSION O flE
CITY OF MIAMI BEACH, FLORIDA URGING THE.. STATTV't"T:
LEGISLATURE TO AMEND ITS SENTENCING
REGULATIONS TO INCLUDE MINIMUM MANDATORY
SENTENCES FOR FELONIES COMMITTED AGAINST THE
ELDERLY.
WHEREAS , the elderly citizens of this State have been
the frequent and unfortunate victims of felonies; and
WHEREAS, the need to deter such criminal acts is of
vital necessity mandating appropriate legislation;
WHEREAS, the provision of criminal penalties and of
limitations upon the application of such penalties is a matter
preempted by the State Legislature; and
WHEREAS , there is presently a lack of legislation in the
area of minimum mandatory sentences for felonies committed against
the elderly; and
WHEREAS, it is necessary to amend state laws regarding
criminal penalties in order to ensure certainty of punishment as
well as fairness to offenders and to elderly citizens of the
State.
NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that it urges the
State Legislature to amend its uniform sentencing policy by
developing and implementing legislation regarding sentences for
felonies committed against the elderly in an effort to ensure the
minimum mandatory sentence of five years.
