A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH UNANIMOUSLY URGING THE
FLORIDA STATE LEGISLATURE TO OPPOSE HOUSE BILL
1174 AND SENATE BILL 1099 WHICH IN THEIR
PRESENT FORM WOULD IMPOSE STATE CONTROLS ON
ZONING FOR GROUP HOMES WITHIN MUNICIPALITIES.
WHEREAS, the City Commission of the City of Miami Beach
is aware that House Bill 1174 presently before the Florida
Legislature which, if passed in its present form, would allow
group homes for up to six persons within a single-family
residential neighborhood and would also allow group homes for up
to 16 persons within all multi-family classifications and Senate
Bill 1099 which, similarly, would allow group homes of up to eight
people in single-family classifications; and
WHEREAS, the City Commission has no desire to
discriminate against group homes for elderly, physically or
developmentally disabled or dependent citizens and recognizes the
need for such group homes, but opposes House Bill 1174 and Senate
Bill 1099 because their passage would allow the State of Florida
to mandate the type of housing which would be allowed within
single-family classifications as well as multi-family
classifications; and
WHEREAS, the City Commission is aware from past
experience that the citizen of the City of Miami Beach are opposed
to state-mandated zoning for group homes,
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH as a unanimous body urges the Florida
State Legislature to vote against House Bill No. 1174 and Senate
Bill 1099 in their present form.
