A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH EXPLORING ALTERNATIVES FOR
FINANCING OPERATING COSTS OF THE EXPANDED
CONVENTION FACILITY AND ESTABLISHING A POLICY
RELATIVE TO RELINQUISHING OWNERSHIP AND
CONTROL OF THE CONVENTION CENTER.
WHEREAS, it is the hope and belief of the Miami Beach
City Commission that there will not be any deficits in the
operation and maintenance of the enlarged Convention Center ; and
WHEREAS, these facilities are being expanded mainly for
the benefit of all of Dade County with its 60 ,000 hotel rooms,
many restaurants and support businesses and the hope that a
revival of Miami Beach with its 3,000 convention grade hotel rooms
will be stimulated; and
WHEREAS, it is the intent of the City Commission that
the people of Miami Beach should not be saddled with all of the
costs for operating and maintaining the enlarged Convention Center
and without conditioning the completion and operation of the
expanded Convention Center facility, the City will use its best
efforts to bring this to reality; and
WHEREAS, Miami Beach is contributing its present 578, 000
square foot facility that may be worth well over one hundred
million dollars, to the expanded Convention Center which will
mainly benefit all of Dade County; and
WHEREAS, the City of Miami Beach and the Dade League of
Cities, the Greater Miami Chamber of Commerce and the Beacon
Council have consistently had the view that, "It is unfair to tax
a single municipality with the . . . operating deficits of a
facility that benefits the entire county, "
WHEREAS, the Miami Beach Homeowners Association, Inc.
and Mildred Falk as an individual agree to withdraw their cross
appeals in order to promptly terminate the bond validation suit,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH that it will explore alternatives to
achieve these desired objectives, and
FURTHER BE IT RESOLVED that the City Commission declares
OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE -MIAMI BEACH,FLORIDA 33139
it to be the policy of the City of Miami Beach that it will not
relinquish ownership or control of the Convention Center without a
vote of approval by the people of Miami Beach.

COME NOW the undersigned parties, Metropolitan Dade County,
Mildren Falk, the Miami Beach Homeowners' Association, Inc. and
Joseph Abelow, who, upon mutual consideration, stipulate to the
dismissal with prejudice of the appeal and cross-appeal filed
herein.
Without in any way affecting the validity, enforceability or
finality of this Stipulation and Notice of Voluntary Dismissal,
the undersigned appellees, by execution of this dismissal, hereby
instruct and direct their attorney, Joseph H. Weil, to execute a
similar dismissal for the purpose of clearing the record.
