A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA AUTHORIZING AND
DIRECTING THE CITY ATTORNEY TO DECLARE A
DEFAULT OR TAKE OTHER APPROPRIATE ACTION
AGAINST SOUTH POINTE DEVELOPMENT COMPANY UNDER
THE DEVELOPMENT AGREEMENT FOR FAILURE OF THE
DEVELOPER TO PROCEED WITHOUT DELAY WITH
CONSTRUCTION OF PHASE I OF THE PROJECT.
WHEREAS, in City of Miami Beach Resolution No. 84-17862 ,
the City Commission of the City of Miami Beach authorized the
execution of a Development Agreement with the South Pointe
Development Company; and
WHEREAS, on October 9, 1984 , a Development Agreement was
entered into between the City of Miami Beach and South Pointe
Development Company; and
WHEREAS, pursuant to the Agreement, South Pointe
Development Company undertook responsibility to construct the
South Pointe Tower Condominium Project; and
WHEREAS , it has come to the attention of the City that
South Pointe Development Company has ceased construction of Phase
I of the project, which failure to proceed is in default of its
obligations under the development agreement; and
WHEREAS , the City wishes to take all necessary action to
enforce the obligation that the developer proceed without delay.
Now, THEREFORE, BE IT DULY RESOLVED by the City
Commission of the City of Miami Beach that the City Attorney be
authorized and directed to take appropriate action to declare a
default or take other appropriate action against South Pointe
Development Company under the Development Agreement for failure of
the Developer to proceed without delay with construction of Phase
I of the Project.
