A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH , FLORIDA , ENDORSING THE
STIPULATION IN RITE-RESEARCH IMPROVES THE
ENVIRONMENT, INC. , AND CITY OF MIAMI BEACH V. LEE
THOMAS ADMINISTRATOR OF THE ENVIRONMENTAL
PROTECTION AGENCY ( AS SUBSTITUTE FOR RUSSEL
TRAIN , DOUGLAS M . COS TL E , ANNE GORSUCH AND
WILLIAM RUCKELSHAUS ) ; THE ENVIRONMENTAL
PROTECTION AGENCY ; THE DEPARTMENT OF
ENVIRONMENTAL REGULATION OF THE STATE OF FLORIDA;
THE MIAMI-DADE WATER AND SEWER AUTHORITY; AND
METROPOLITAN DADE COUNTY.
WHEREAS , the City and Rite Research agree to conclude the
prosecution of the litigation known as Rite Research Improves the
Environment , Inc. et al . v. Thomas, et al . under the following
conditions :
A. Dade County agrees in good faith, within a reasonable
time, to prepare and submit applications not only to the State of
Florida ( through the DER or any other applicable State agencies)
but to any Federal agencies that might be appropriate, in order
to receive a grant ( or grants ) to fund the extension of the
outfall line. It is not necessary for Dade County to obtain a
grant of funds, as long as it acts in good faith to obtain monies
and demonstrates that it is using its best efforts to achieve an
extension of its outfall for the purpose of obtaining additional
environmental protection.
B . Dade County also agrees that if , at first , its
application, or applications, were not to be accepted, it would
continue its best efforts to process applications for funding the
outfall extension, so that it can achieve the results which not
only Plaintiffs but Dade County desires .
NOW, THEREFORE, BE IT DULY RESOLVED THAT THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, endorses the stipulation in
Rite-Research Improves the Environment, Inc. , and City of Miami
Beach v . Lee Thomas , Administrator of the Environmental
Protection Agency (as substitute for Russell Train , Douglas M .
Costle, Anne Gorsuch and William Ruckelshaus) ; the Environmental
Protection Agency; the Department of Environmental Regulation of
the State of Florida; the Miami-Dade Water and Sewer Authority;
and Metropolitan Dade County.
PASSED and ADOPTED this 18th day of March , 1987 .
