RESOLUTION 87-18852 RESOLUTION NO. 87-1 52 A RESOLUTION OF THE CITY OF MIAMI BEACH, FLORIDA CALLING A PUBLIC HEARING TO CONSIDER AMENDING ORDINANCE NO. 1891, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF MIAMI BEACH AND THE MAPS ATTACHED THERETO BY: (1) EXCLUDING A CERTAIN PARCEL OF LAND FROM THE RM-14 (MULTIPLE FAMILY LOW DENSITY) DISTRICT AND INCLUDING SAME IN THE RM-60 (MULTIPLE FAMILY MEDIUM DENSITY) DISTRICT, and (2) AMENDING SECTION 6-16 THEREOF ENTITLED "MU MUNICIPAL USE DISTRICT" TO ALLOW FOR AIR RIGHTS DEVELOPMENT ON CITY OWNED PARCELS; PROVIDING FOR SEVERABILITY, INCLUSION IN THE COMPREHENSIVE ZONING ORDINANCE, REPEALING ALL ORDINANCES IN CONFLICT AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT, WHEREAS, for the past thirteen years, the City has been involved in litigation regarding the zoning of the property located between Collins Avenue and Harding Court from 76th to 79th Streets (currently zoned RM-14). WHEREAS, on March 25, 1986, the Third District Court of Appeals ordered the City to rezone the subject properties to a classification not less restrictive than 60 units per acre, and on April 16, 1986, the City Commission adopted Resolution No. 86-18426, which accepted a settlement offer from the property owners, which required the City to initiate proceedings for the rezoning of the property to permit 60 units per acre. WHEREAS, on September 23, 1986, the Planning Board held a public hearing to consider the request for a change of zoning from RM-14 (Multiple Family Low Density) to RM-60 (Multiple Family Medium Density) and unanimously recommended that the City Commission approve the request. WHEREAS, the City Commission held a public hearing on November 19, 1986 at which time the Commission voted unanimously to transmit the proposed ordinance amending Ordinance No. 1891 by changing the zoning from RM-14 (Multiple Family Low Density) to RM-60 (Multiple Family Medium Density) to the Florida Department of Community Affairs for review in conjunction with the associated amendment to the Miami Beach Comprehensive Plan. WHEREAS, on October 20, 1986, the Planning Board held a public hearing to consider amending the definition of the "MU-Municipal Use" District. Following the hearing and in consideration of the Department's affirmative recommendation, the Board voted unanimously in favor of the amendment to the Zoning Ordinance. WHEREAS, the City Commission held a public hearing on December 17, 1986 at which time the Commission voted unanimously to transmit the proposed ordinance amending Section 16-6 of Ordinance No. 1891, entitled "MU Municipal Use District" by adding the following under Uses Permitted: "Private use, or joint City and private use of property owned by the City or the Miami Beach Redevelopment Agency, including air rights", to the Florida Department of Community Affairs for review in conjunction with the associated amendment to the Miami Beach Comprehensive Plan. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that a public hearing for consideration of the aforementioned proposals is hereby called to be held before the City Commission in its chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, beginning at 2:35 P.M. on May 20, 1987, and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of said Public Hearing to be published in a newspaper of general circulation in the City of Miami Beach, at which time and place all interested parties will be heard.
