RESOLUTION 87-19080 RESOLUTION NO. 87_19080 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE METROPOLITAN DADE COUNTY BOARD OF COUNTY COMMISSIONERS TO SUPPORT THE ZONING APPLICATION OF MIAMI CHILD'S WORLD, INC., AND THE CITY OF MIAMI BEACH, FLORIDA FOR THE DEVELOPMENT OF A THEME PARK AT THE CITY OF MIAMI BEACH OJUS TRACT, DADE COUNTY, FLORIDA. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT: WHEREAS, the City and Miami Child's World, Inc., entered into a Lease Agreement on September 30, 1983 (the "Lease Agreement") for lease of the Ojus Property located at 1511 N.E. 207th Street, Miami, Dade County, Florida; and WHEREAS, the Lessee represented to the City that the one year design approval and permitting phase (Phase I), as set forth in the Lease Agreement, was proven impractical and the Lessee requested a further extension of such Phase I; and WHEREAS, the City Commission of the City of Miami Beach authorized the Mayor to execute an amendment to the Lease Agreement between the City of Miami Beach and Miami Child's World, Inc., by adopting Resolution No. 86-18485 on June 18, 1986; and WHEREAS, Miami Child's World, Inc., and the City of Miami Beach have filed a Zoning Application calling for an Unusual Use-Theme Park and Supporting Elements, certain zoning district boundary changes from GU to IU-1, to permit an access road through the GU portion of the property; and WHEREAS, the development of a Theme Park Project on the Ojus Tract will add greatly to the promotion of tourism in Dade County by providing an additional family tourist attraction; and WHEREAS, the development of the proposed Theme Park will benefit Metropolitan Dade County by providing additional jobs and strengthening broad-base of the local economy; and WHEREAS, revenues derived by the City from this agreement will provide for additional services to the citizens of Miami Beach. NOW THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH THAT: 1. The City Commission of the City of Miami Beach urges the Metropolitan Dade County Board of County Commissioners to support the Zoning Application of Miami Child's World, Inc., and the City of Miami Beach, Florida, for the development of a Theme Park at the City of Miami Beach Ojus Tract, Dade County, Florida. Parkins City Manager SUBJECT: ZONING APPLICATION BY MIAMI CHILD'S WORLD, INC., AND THE CITY OF MIAMI BEACH ON THE OJUS TRACT Background: On August 7, 1987, a letter requesting an Amendment to the Zoning Application originally filed on December 7, 1984, by Miami Child's World, Inc., and the City of Miami Beach, was submitted to the Zoning Hearing Section, Building and Zoning Department, Metropolitan Dade County, Florida. This Amendment deleted the earlier request to re-zone the westerly 79.75 acres from GU to IU-i, and instead, requested a special exemption to permit an access road through a portion of the property. The request, under this application, is for an Unusual Use-Theme Park and Supporting Elements, and a special exemption to permit a 100-foot wide access through a more restrictive zoning GU-Interim. The revised Zoning Application and Supporting Data Elements that was submitted to Metropolitan Dade County has been reviewed by the Zoning Processing Section and the Development Impact Committee whose Hearing was held on Wednesday, October 14, 1987, at the Metro-Dade Center. Current Status: As a result of the discussions of the Development Impact Committee Hearing on this project, revised plans were made in order to relocate the Theme Park outside the limits of a natural forest preserve area which was found to exist in the development area on the Ojus Tract. Accordingly, the revised general site plan and Theme Park plan dated October 23, 1987, have been resubmitted to Metropolitan Dade County and include the following: Total area: 37.67 acres Landscaped area: required 15% - provided 45% Paved area: roads, parking 28.3% Buildings, rides, walkways, etc. 26.7% Parking data: standard parking spaces 784 handicapped parking spaces: 16 total provided 800 Peak in-ground attendance 3,155 people ADMINISTRATION RECOMMENDATION: In that the City of Miami Beach is a co-applicant in the Zoning Application, Miami Child's World, Inc., has requested the City Commission adopt a Resolution urging the Metropolitan Dade County Board of County Commissioners to support the Zoning Application for the development of Miami Child's World Theme Park at the City of Miami Beach Ojus Tract. The City Administration recommends the adoption of the attached Resolution.
