A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY
MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONSTRUCTION
CONTRACT IQC NO. FLO4GC4-051716-LCI BETWEEN THE CITY OF MIAMI
BEACH, FLORIDA, AND LEE CONSTRUCTION GROUP, INC., FOR
ADDITIONAL STRUCTURAL, ELECTRICAL, AND FIRE ALARM SCOPE FOR
THE PROPERTY MANAGEMENT EMERGENCY GENERATOR, IN AN
AMOUNT OF $93,042.16, PLUS A 10% OWNER'S CONTINGENCY IN THE
AMOUNT OF $9,304.21, FOR A TOTAL AMOUNT OF $102,346.37; WITH THE
FOREGOING SUBJECT TO AND CONTINGENT UPON CITY COMMISSION
APPROVAL OF A CAPITAL BUDGET AMENDMENT REQUIRED TO FUND
CHANGE ORDER NO. 1.
WHEREAS, the City needs to install one (1) emergency generator at the Property
Management Department (the Project); and
WHEREAS the Project consists of one (1) 500KW generator, as well as a number of
ancillary items (e.g., automatic transfer switch); and
WHEREAS, the National Joint Powers Alliance (NJPA), now known as Sourcewell, a
national cooperative that bids contracts aggregating the spend volume of agencies across the
country, awarded Contract No. 071415-GGI for IQC construction services, and said contract
includes an award to Lee Construction Group, Inc., through the Gordian Group's IQC process, to
provide services to the City pursuant to the contract; and
WHEREAS, on February 14, 2019, after negotiations, the Contractor submitted a bid
proposal in the amount of $248,000.00, for the Project plus an additional $19,143.74 owner
contingency; and
WHEREAS, on March 13, 2019, the Mayor and City Commission adopted Resolution No.
2019-30740, authorizing the City Manager to execute a work order with Lee Construction Group,
Inc., utilizing the competitive bid Sourcewell cooperative contract for construction services;
WHEREAS, due to unforeseen conditions, the City and the engineer of record, TLC
Engineering, Inc., have identified additional work that needs to be performed, including
modifications to the concrete pad to meet flood base elevation, fire alarm, and electrical changes;
and
WHEREAS, on April 23, 2019, after negotiations, the Contractor submitted a Change
Order proposal in the amount of $93,042.16, plus a 10% owner's contingency in the amount of
$9,304.21, for a total amount of$102,346.37; and
WHEREAS, the Administration recommends approval of the Change Order proposal, as
the proposal has been reviewed by staff, the engineer of record, and the Gordian Group, and
determined to be reasonable and fair.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission
hereby approve and authorize the City Manager to execute Change Order No. 1 to the
construction contract IQC No. FLO4GC4-051716-LCI between the City Of Miami Beach, Florida,
and Lee Construction Group, Inc., for additional structural, electrical, and fire alarm scope for the
Property Management Emergency Generator and Transfer Switch Project, in an amount of
$93,042.16, plus a 10% owner's contingency in the amount of $9,304.21, for a total amount of
$102,346.37; with the foregoing subject to and contingent upon City Commission approval of a
Capital Budget amendment required to fund Change Order no. 1.

RECOMMENDATION
The Administration recommends approval of the Resolution.
ANALYSIS
On February 1, 2018, the City engaged TLC Engineering, Inc. for the engineering services and
design of the Property Management emergency generator(the"Project").
In the interest of time, the City chose to expedite the Project and utilize the IQC process. Through
the IQC process, Lee Construction, Inc. ("Contractor") was identified as the most qualified and
experienced contractor to complete the identified scope per TLC Engineering, Inc. construction
documents. The City and the Gordian Group met with the Contractor to review the scope for the
Project. On on February 14, 2019, after negotiations, the Contractor submitted a bid proposal in the
amount of$248,000.00, for the Project plus an additional $19,143.74 owner contingency.
Due to unforeseen conditions such as the requirement to relocate the automatic transfer switch,
elevate the concrete platform to 3'-6" above base flood elevation, increase in the size of the concrete
pad three times it's original size to accommodate the transfer switch relocation, as well as fire alarm,
and electrical changes in compliance with the current Florida Building Code. The scope work
depicted above was not captured in the original bid set documents.

On April 23, 2019, the Contractor submitted a change order proposal in the amount of $93,042.16,
for the additional work, plus a 10% owner's contingency, for a total amount of $102,346.37. The
proposal was reviewed by the engineer of record, and the Gordian Group, and determined to be
reasonable and fair.
CONCLUSION
The Administration recommends that the Mayor and City Commission approve and authorize the City
Manager to execute change order No. 1 to the construction contract IQC work order No. 062105.01
between The City Of Miami Beach, Florida, and Lee Construction Group, Inc., for additional
structural, electrical, and fire alarm repairs for the Property Management emergency generator, in an
amount of $93,042.16, plus a 10% owner's contingency in the amount of $9,304.21, for a total
amount of $102,346.37; and subject to a capital budget amendment required to fund change order
No. 1.
